MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL,
held in the Committee Room, Newby & Scalby Community Hall, Scalby Road, Scalby,
on Wednesday, 9th March 2011 at 7.15pm

 

PRESENT:  Councillors S G Foote (Vice Chairman in the Chair), Councillors: Mrs G Kendall, R Pickersgill, C Ridley, Mrs P C Snow, A. Tyson, R I Thompson (from 8.10pm) and B F Watson

 ALSO IN ATTENDANCE:  1 member of public (to 7.15pm); Mr R Kaye (SBC) & Mr T Teasdale (allotments) to 7.30pm; Mr P. Afford & Mr P Staveley (to 8.10pm); County Councillor Mrs H Swiers (to 8.15pm), Mrs J Marley (Clerk).

261/10            APOLOGIES FOR ABSENCE
Accepted from Councillor TW Miller, D Bastiman. Noted Cllr. Thompson would be late.

262/10            DECLARATIONS OF INTEREST
262/10.1         Councillor Mrs Kendall declared a personal and non-prejudicial interest in agenda item 17 as she was a plotholder.

262/10.         Councillor S Foote declared a personal and non-prejudicial interest in agenda item 7.2 as he was a member of the Sports Council Executive and agenda item 17 as he was a plotholder.

262/10.3         Councillors C Ridley and B F Watson declared their respective personal interests in all Borough Council planning applications as members of the Borough Council’s Planning Committee and took no part in the decisions.

262/10.4         Councillor BF Watson declared a personal and prejudicial interest in agenda item 13.3 as he was related to the applicant and left the room for this item [Minute 273/10.3].

PROCEDURAL MATTER
RESOLVED that      (i)         the meeting be suspended at 7:16 pm. Roger Kaye of Scarborough Borough Council provided feedback from the previously raised issues.

  1. Potholes on Hillcrest Avenue had been repaired again;
  2. The timing of the traffic lights at the junction of North Cliff Avenue and Burniston Road had been sorted and the timing on the adjacent Pelican crossing had been tweaked;
  3. Surface ponding on Red Scar Lane near 4 lane ends would be dealt with in the near future
  4. Repair of potholes was proceeding – Barmoor Lane would be done in the near future and NYCC had done their part of the road through Raincliffe Woods;
  5. The Scalby nameplate was now in place on the stone plinth at the bottom of Hay Brow.

The following new/revised issues were reported to Mr Kaye for action/comment:

  1. Two street lights out on the snicket from Scalby Road to South Street

(ii)        A written report from the Police was noted;

(iii)       Comments by a parishioner regarding a planning application at 36 Scalby Avenue were noted.

(iv)       On behalf of a parishioner, Cllr. Foote reported a possible breach of planning consent on a house being erected in the grounds of 12 Hay Lane (Clerk to refer matter to SBC Planning Enforcement)

263/10            REPORTS FROM OUTSIDE BODIES
The following Reports from Council Representatives, where indicated below, were RECEIVED:

263/10.1         Allotments Friends Group – Mr Teasdale reported George Dale had resigned as Chairman though was still a committee member. He also gave thanks for the recently awarded Community Chest Grant;

263/10.2         In Bloom Group – Mr Staveley reported 1] National Parks had given permission to plant around the village signs on Hay Brow and Red Scar Lane, 2] all the daffodil bulbs were now in; 3] the John Ellis memorial garden& the planting on Scalby road would be tidied, the Village Trust containers would be refurbished & a litter pick would soon take place;

263/10.3         Scalby Football Club – Mr P Afford reported 1] the fields had coped well with the winter, and 2] the Junior Team had done particularly well this season;

263/10.4         CAP Group. – No report, next meeting 5th April;

263/10.5         Roads Liaison Committee – Cllr. Watson reported the Officers had been returned unopposed at the AGM, where it had been agreed to raise the membership fee to £12. Nick West of NYCC Highways had given a most informative talk & answered members questions;

263/10.6         Coastal Area Parish Forum – Cllr. Watson reported on presentations by Mr Eves (Forestry commission) and John Beech (Coastal Projects). Details of the car park review were also given;

263/10.7         North Yorkshire and Cleveland Coastal Forum – No report;

263/10.8         Yorkshire Local Councils’ Association – Cllr. Foote reported the next Annual Training Day would take place in Beverley;

263/10.9         Twinning Association – Cllr. Ridley reported this year’s annual dinner was to be held in a fortnight’s time;

263/10.10      York and North Yorkshire Playing Fields – Cllr. Mrs Snow reported the annual conference would be held 15 to 18 June with a discussion “The Way Forward” scheduled for the 17th;

263/10.11      Yorkshire Coast & Moors County Area Committee – No report;

263/10.12      North York Moors National Park Authority – No report;

264/10            MINUTES
RESOLVED that the minutes of the Council Meeting held on 9th February 2011 be approved as a correct record and signed by the Chairman.

265/10            VACANCY OF CLERK AND RFO TO THE COUNCIL
NOTED 1] Mrs Marley has been appointed to the post of Clerk/RFO with effect from 21 February 2011; 2] Mr A J Spencer has agreed to provide holiday and sickness cover.

266/10            MATTERS OF REPORT FROM THE MINUTES  None.

267/10            CORRESPONDENCE
267/10.1         RECEIVED a copy of a letter dated 23 February 2011 from Mr AH White to N Wintringham of SBC Highways.

267/10.2         RECEIVED a letter dated 1 February 2011 from Scarborough Sports Council inviting Council to become a member. RESOLVED Council join at a cost of £10 & cheque authorised for signature.

268/10            QUALITY STATUS
The overall aims of quality status to remain on the agenda pending developments.

269/10            SCALBY VIADUCT
RESOLVED  Clerk to ask Cllr. Bastiman for a progress report.

270/10            COLD CALLING ZONES
RESOLVED to be removed from agenda.

FINANCE & GENERAL PURPOSES ISSUES

271/10            FINANCIAL MATTERS
271/10.1         RESOLVED due to elections, the May meeting to be held on 18th May.

271/10.2         RESOLVED that it be noted that grants have been awarded under the Sports and Recreational Community Chest Awards Scheme in respect of:

  1. Mid Week Badminton Club, cost of equipment & rents (£250)
  2. Scalby Over 60’s Club, for table tennis table (£200)
  3. 1st Scalby Rainbows, for sport/craft/learning materials (£250)

271/10.3         RESOLVED that the Schedule of Accounts for March 2011, Schedule 12 be approved and paid.

272/10            PARISH COUNCIL NOTICE BOARD [Minute 186/10 refers] 272/10.1         NOTED 1] information still not received from Yorkshire Coast college despite several requests; 2] board no longer fit for purpose. RESOLVED Clerk to arrange for refurbishment of board, cost not to exceed £300. Further RESOLVED Clerk to write to Yorkshire Coast College informing them alternative arrangements had been made.

276/10            CIRCULATION
NOTED Clerk’s suggestion that she placed documents considered to be of interest to Councillors in a folder for members to circulate amongst themselves prior to returning it to the Clerk. RESOLVED to trial this scheme for 6 months. Further RESOLVED a folder containing NYCC Parish Charter; White Rose Update [Feb 2011] and Clerks & Councils Direct [March 2011] was handed to Cllr. Foote for circulation.

277/10            EXCLUSION OF THE PUBLIC
Pursuant to Section 1(2) of the Public Bodies (Admissions to Meetings) Act 1960 RESOLVED that due to the confidential nature of the business about to be transacted, in relation to a legal matter, the public and press be excluded from the meeting

278/10            ALLOTMENTS
RECEIVED letter (tabled at meeting) dated 7th February 2011 from Smiths Gore as agents for the Duchy. The letter was as a result of a meeting which the Friends of Newby & Scalby Allotments had asked for with Smiths Gore and outlined items the Duchy required the Parish Council to deal with as soon as possible. The Clerk gave the background to the problems, outlined other matters on the allotments which gave her concern and suggested possible courses of action. RESOLVED 1] Clerk and Cllr. Tyson to work together to deal with the various matters on the allotments as felt appropriate and give a progress report to the April meeting; 2] expenditure not exceeding £500 be authorised; 3] Clerk to write to Friends of Newby & Scalby Allotments reminding them they are tenants of the Parish Council and as such have no authority to have any direct dealings with Smiths Gore or the Duchy.

There being no further business on the agenda the Chairman declared the meeting closed at 9:15 pm
