held in the Committee Room, Newby & Scalby Community Hall, Scalby Road, Scalby,
on Wednesday, 9th February 2011 at 7.15pm
PRESENT: Councillors B Miller (Chairman in the Chair), Councillors: D Bastiman, S G Foote Mrs G Kendall, R Pickersgill, C Ridley, Mrs P C Snow, R I Thompson (from 8.10pm) and B F Watson

244/10 DECLARATIONS OF INTEREST
244/10.1 Councillor Bastiman declared a personal and non-prejudicial interest in all planning issues and applications in his capacity as Portfolio Holder on Scarborough Borough Council with responsibility for Planning Issues and took no part in the decisions.
244/10.2 Councillors C Ridley and B F Watson declared their respective personal interests in all Borough Council planning applications as members of the Borough Council’s Planning Committee and took no part in the decisions.
244/10.3 Councillor R Pickersgill declared a personal interest in the North York Moors planning application at agenda item 12.1 as he was acquainted with the applicant.
PROCEDURAL MATTER
RESOLVED that (i) the meeting be suspended at 7:18 pm. Roger Kaye of Scarborough Borough Council provided feedback from the previously raised issues.
- Lamp 23 on Hackness Road repaired;
- Lamp no. 26 opposite the Miners Home Cottages/Hackness Road;
- Bench seat at Hay Lane/Scalby Nabs requiring repair still awaiting collection
- Requested grit bins on The Parkway – location does not meet NYCC criteria – this Council can install some at an initial cost of £170 for the bin & 2 fills, followed thereafter by annual cost of £75;
- Traffic lights at Green Lane/Scalby road junction set to 15 seconds green light time in each direction – this is to be monitored in order to establish the best settings;
- Repair of potholes was proceeding & Station Road was completed;
The following new/revised issues were reported to Mr Kaye for action/comment:
- The recent tarmac patches on Hillcrest Avenue have already broken up resulting in even larger potholes needing repair;
- The timing of the traffic lights at the junction of North Cliff Avenue and Burniston Road needs checking;
- Road from Throxenby Mere to junction with Forge Valley road badly potholed;
(ii) A written report from the Police was noted;
(iii) Comments by a parishioner regarding a planning application at South Beck Cottage, Hackness Road were noted.

245/10.1 Allotments Friends Group – No report;
245/10.2 In Bloom Group – Mr Staveley reported 1] the Farmer’s Market was proving increasingly popular, 2] it was hoped to have all the flowers beds planted up by the end of March; 3] Yorkshire in Bloom judging would take place between 21 March and 8 April; 4] Best Kept Garden Competition would have 3 categories this year; 5] the group was helping the Woodland Trust and other volunteers plant 420 trees in Raincliffe Woods;
245/10.3 Scalby Football Club – Mr P Afford reported progress was being made with establishing who owned Carr Lane;

245/10.13 Planning Training Event – Cllr. Miller reported on the North York Moors National Park event and outlined some of the likely changes as a result of the Localism Bill. Cllr. Watson asked about the impact on Permitted Development Rights.
246/10 MINUTES
RESOLVED that the minutes of the Council Meeting held on 12th January 2011 be approved as a correct record and signed by the Chairman.
247/10 MATTERS OF REPORT FROM THE MINUTES
1] Clerk reported SBC had confirmed they did not intend to take any action over changes to the building line on the east elevation of 476 Scalby Road [see Procedural Matter (iv) of 12/1/11 meeting and Minute 235/10.2].
248/10 CORRESPONDENCE
248/10.1 The Council considered the analysis of the Christmas Lights Judging and agreed the winners as follows:- Large Display – 129 Coldyhill Lane and 5 Coldyhill Crescent; Medium Display – 46 Newby Farm Crescent and 104 Coldyhill Lane; Small display – 15 West Park Avenue and 113 St Leonard’s Crescent. RESOLVED Chairman to present certificates & prize vouchers.
248/10.2 The Council considered a letter dated 6 January 2011 from Scalby School Drama Club giving thanks for Community Chest Award. RESOLVED the letter be received.
248/10.3 The Council considered a letter dated 6 January 2011 from SBC regarding the junction of Burniston Road and Field Lane [Minute 187/10 refers] RESOLVED the letter be received, Clerk to clarify works to be done at Burniston Road end. Noted County Cllr. Backhouse’s report that instigating the 50mph limit on the Burniston Road-Coastal Road section had been delayed due to financial constraints.
248/10.4 The Council considered a letter dated 7 January 2011 from SBC announcing next meeting of NYCC, SBC & Parish Council will be 6pm Monday 14th March RESOLVED Cllrs. Miller and Foote attend.
248/10.5 The Council considered a letter dated 25 January 2011 from Signet Planning regarding public display for proposed development at High Mill Farm & inviting members to a preview Thurs 10th Feb 12noon to 1pm. RESOLVED several members likely to attend the preview, remainder would attend the public session.
248/10.6 The Council RECEIVED a letter dated 31 January 2011 from Scalby Toilets Trust giving thanks for Community Chest Award.
248/10.7 The Council considered a letter dated 1 February 2011 from Scalby Village Trust giving thanks for Community Chest Award & inviting members to its presentation on 7 March 2011. RESOLVED Cllr. Foote to represent this Council.
248/10.8 RECEIVED a questionnaire (undated) from North York Moors National Park regarding their service review and how it should spend its money over the next 4 years. RESOLVED Cllr. Miller & Clerk authorised to complete on behalf of Council.
248/10.9 The Council considered a letter dated 1 February 2011 from Ian Proudfoot about the Parish Council’s comments on the recently refused planning application to vary delivery times at Proudfoot’s Newby store. Noted that an error on SBC’s covering letter to the application had resulted in a misunderstanding. RESOLVED Council’s comments had to stand since the planning application has been determined by Scarborough Borough Council. Should an appeal or re-submission be made, Council could re-consider its comments.

252/10.1 RESOLVED the External Auditor’s report on 2009/10 accounts be received.
252/10.2 RECEIVED the Internal Auditor’s report & the Acting Clerk’s report on the Internal Audit function. RESOLVED Acting Clerk’s recommendations be accepted in their entirety.
252/10.3 RESOLVED that it be noted that grants have been awarded under the Sports and Recreational Community Chest Awards Scheme in respect of:
- Scalby & Newby Village Trust, for Christmas lights (£500)
- Scalby Toilets Trust, for maintenance & cleaning (£500)
- Friends of Newby & Scalby allotments, for noticeboards, marquee & tables (£500)
252/10.4 A query was raised on item 10 on the Schedule of Accounts for February 2011 & the Acting Clerk read out the advice received from the YLCA on 27/1/11. Proposed Cllr. Foote seconded Cllr. Ridley and RESOLVED that payment of expenses linked to Cllr. Miller’s additional CPRE representation be approved. RESOLVED that the Schedule of Accounts for February 2011, Schedule 11 be approved and paid.
