104/12.1 RESOLVED the minutes of the Council Meeting held on 11th July 2012 be approved as a correct record and signed by the Chairman;
PROCEDURAL MATTER At 7.03pm, Standing Orders were suspended to allow the Public Open Forum & external reports.
105/12 POLICE REPORT RESOLVED written report (tabled at meeting) be received.
106/12 PRESENTATION ON STREET LIGHTING
Presentation by Hazel Davidson (NYCC) on streetlight energy reduction scheme. She explained the ultimate aim was to get 60% of lights across the NYCC area switched off between midnight and 5am. The process was almost complete in Harrogate and just commencing in Knaresborough. Consultations had just begun in Scarborough for the town area and Newby electoral ward. Some lights had to remain on eg. those on main roads, accident or crime blackspots and near speed humps. Maps were provided of proposed changes in Newby ward and Ms Davidson asked for local knowledge in order to fine tune the changes. Some debate as to whether the lights were highway lighting or footway lighting. A range of concerns was expressed by members including potential increase in crime, lack of safety, decrease in provision of services already paid for by electors and the distinction between highway lighting and footway lighting. The Chairman thanked Ms Davidson for attending and she left at 7.50pm
107/12 PUBLIC OPEN FORUM
H. King of York Potash updated members on developments – minehead to be located near Redgates, Sneaton and public presentations to take place over next couple of weeks. Several parishioners spoke strongly about the very poor standard of grass cutting in the parish this year especially on Lady Edith’s Park. Parishioner asked if council intended putting any questions to the candidates for the forthcoming election for a Police & Crime Commissioner.
108/12 COUNTY COUNCILLOR’S REPORT
NOTED County Cllr. Backhouse’s report 1] replacement of white lines on Moor Lane and marking out of bus stops had been asked for as a matter of urgency; 2] a damaged silver birch tree on Newby Farm Road was to be dealt with by SBC Parks; 3] proposals to turn off some traffic lights between midnight and 5am were being fine-tuned; 4] he had already received complaints about the standard of verge cutting and he read out the reply he’d received. He also had enquiries in hand to establish how much money NYCC gave to SBC for grass cutting within the parish; 5] fence bordering school playing field would cost over £100,000 to replace so other remedies being looked at.

PROCEDURAL MATTER At 8.10pm, Standing Orders were resumed.
110/12 MATTERS RAISED IN PUBLIC OPEN FORUM
110/12.1 NOTED: Ms Davidson’s street lighting presentation. Copies of the maps are held by the Clerk. RESOLVED the matter be placed on the October agenda.
110/12.2 Grass cutting – general consensus that the standard of cutting had been considerably below that of previous years and while the wet weather in May and June had caused problems, it could not continue to be used as an excuse. Furthermore the highway gullies are getting blocked by the cuttings and the width of pavements was being eroded as a result of verges encroachment. RESOLVED Clerk to write to NYCC to get details of cutting schedule and service level agreement as it related to this parish.
110/12.3 No current intention to ask questions of Police & Crime Commissioner candidates. It was understood the candidates would be attending a meeting of SBC’s Urban Area Forum on 24th October, 7pm Scarborough Library in order to answer questions.
111/12 COUNCILLOR’S REPORTS ON HIGHWAY & FOOTPATH MATTERS
111/12.1 RECEIVED updates from Clerk (circulated with agenda) on previously reported highway and footpath matters;
111/12.2 NOTED 1] several sunk gullies reported; 2] damaged concrete bird’s mouth fencing alongside Church Beck (first reported 27/2/12) still not repaired; 3] school playing field fence still dangerously overhanging footpath (County Cllr. Backhouse aware of this and is working to get the problem remedied. RESOLVED Clerk to pass highway matters to relevant authority for action.
111/12.3 Update on flood alleviation measures around Church Becks – not available, RESOLVED defer to future meeting.
112/12 REPORTS FROM OUTSIDE BODIES The following were RECEIVED:
112/12.1 Allotments Friends Group – Cllr. W Black reported he had attended a recent general meeting and social event.
112/12.2 In Bloom Group – Mr Staveley reported 1] Garden Competition prizegiving was to take place on 21st September 6.30-9pm St Mark’s Parish Hall; 2] In Bloom Produce Show had been very successful.
112/12.3 Scalby Football & Cricket Clubs – Mr Afford reported Phil Perry of the Cricket club was now an Olympic Ambassador. In its centenary year the football club had 130 players. A substantial grant towards the cost of a new football strip had been received from the St. Nicholas Lodge of Scarborough Freemasons.
112/12.4 CAP Group – Cllr. Mrs Kendall reported issues raised at the meeting included an increase in antisocial behaviour, noise from the Open Air Theatre and inconsiderate car parking.
112/12.5 Road Liaison Committee – Next meeting 20th September.
112/12.6 NYMNP Coastal Area Parish Forum – Cllrs. Thompson and Watson jointly reported on the joint forum where items discussed included affordable housing and the impact on food production of the decline of the honey bee.
112/12.7 North Yorkshire & Cleveland Coastal Forum – Next meeting 25th September.
112/12.8 Yorkshire Local Councils’ Association – Next meeting 1st October.
112/12.9 Twinning Association – Cllr. Thompson reported next year’s visit was provisionally planned for the first weekend in June; the association’s dinner would be at the Yew Tree in Scalby on 26th September. Next meeting 9th October.
112/12.10 York and North Yorkshire Playing Fields – Cllr. Mrs Snow reported the meeting of 17th August had decided to send out a questionnaire to all members regarding the association’s future. Next meeting scheduled for 30th November.
112/12.11 Yorkshire Coast & Moors Area Committee – Cllr. Thompson reported on a meeting of the Transport Overview & Scrutiny committee which he had attended as a member of the Area Committee. Main subjects of discussion had been the A64 Brambling Fields and Hopgrove roundabout schemes.
112/12.12 North York Moors National Park Authority – Cllr. Thompson reported on recent training about planning appeals and how the inspectors made their assessments. He had also attended planning and finance meetings and a briefing on the proposed potash extraction scheme.

113/12 CORRESPONDENCE
113/12.1 SBC consultation on Community Asset Transfer Plan [deferred from July meeting]. AGREED no comments.
113/12.2 Designation of Local Green Spaces [Minute 96/12.2 refers] – NOTED the application for the field next to the allotments cannot be accepted since this land lies within the National Park.
113/12.3 RECEIVED & NOTED letter of 22nd August 2012 from SBC [circulated with agenda] inviting comments on request by Signet Planning to vary to 40% across all phases the amount of affordable housing on High Mill Farm section 106 agreement. RESOLVED agreement should not be varied, the 50% requirement on Phase 1 should stand.
113/12.4 RECEIVED letter from YLCA dated 29/8/12 [circulated with agenda] inviting nominations for two representatives to SBC’s Standards Committee. RESOLVED Cllrs. W Black, Miller and Thompson be nominated. Clerk to issue nomination forms.
113/12.5 RECEIVED letter from parishioner dated 18/7/12 regarding problem with verge parking [circulated with agenda]. RESOLVED Clerk to write to Parking Enforcement at SBC.
113/12.6 RECEIVED & NOTED letter from NYCC Highways dated 16/7/12 with a service update [circulated with agenda].
113/12.7 RECEIVED & NOTED York & N. Yorks Playing Field Association [letter & questionnaire circulated with agenda]. RESOLVED responses to questionnaires be collated and returned to Y&NYPFA.
113/12.8 RECEIVED & NOTED letter from Scarborough North CAP group dated 1/9/12 re. verge parking [circulated with agenda RESOLVED Clerk to reply to CAP Group and write to County Councillors and Police.

FINANCE & GENERAL PURPOSES ISSUES
114/12 FINANCIAL MATTERS
114/12.1 RESOLVED the Schedules of Accounts for August 2012, Schedule 5 and September 2012, schedule 6 be approved & paid.
114/12.2 Public seats in the parish [minute 97/12.3 refers]. NOTED Clerk’s report that the financial information needed from Scarborough Borough Council had not yet been received. RESOLVED defer to a future meeting.
114/12.3 Internal Auditor’s report [circulated with agenda] on Schedules 1-3 RECEIVED & NOTED.
114/12.4 External Auditor’s unqualified report [circulated with agenda] on 2011/12 accounts RECEIVED. The Auditor’s comment that gratuity payments could now only be made if they were a contractual obligation was NOTED. In this respect it was further NOTED the Clerk had circulated with the agenda a copy of paragraph 18 of her contract of employment which made it clear there was a contractual obligation to pay a gratuity

114/12.5 RECEIVED letter dated 24/7/12 from Scarborough Citizen’s Advice Bureau requesting donation. RESOLVED a donation of £250-00 be made and cheque authorised for signature.
115/12 GENERAL PURPOSE MATTERS
115/12.1 Freedom of Information requests & requests to register formal complaints in respect of code of conduct breaches – NOTED requests dated 14th June, 18th July, 9th August, 12th August, 31st August and 4th September in respect of the register of member’s interests have been (or are being) dealt with by the Clerk following consultation with the Vice Chairman and the YLCA.
115/12.2 Complaints Policy – RECEIVED Clerk’s report [circulated with agenda]] and RESOLVED the policy be adopted with immediate effect.
115/12.3 Standing Orders and Financial Regulations – RECEIVED Clerk’s report [circulated with agenda]] and RESOLVED Clerk’s recommendation be accepted. In accordance with standing order 76, the resolution stood adjourned without discussion to the October council meeting.
115/12.4 RECEIVED requests for dispensation from Cllrs. Bastiman, Thompson and Watson. Clerk outlined the reasons why dispensations were requested and the advice received from YLCA. RESOLVED (6 votes for and 2 against) that all three requests for dispensations be granted until the date of the next Annual Parish Council Meeting so as to allow the members to speak and vote on all matters except those connected with planning applications and appeals.
