MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL,
held in the Committee Room, Newby & Scalby Community Hall, Scalby Road, Scalby,
on Wednesday, 11th July 2012 at 7pm

 

PRESENT:  Councillor TW Miller (Chairman), Councillors D Bastiman, Mrs E Black, W Black, S Foote, S Gething, Mrs G Kendall, R Pickersgill, Mrs C Snow, R Thompson, A Tyson, BF Watson

 ALSO IN ATTENDANCE:  R. Kaye (SBC Liaison) to 8.35pm, G Edwards (York Potash) to 7.20pm; County Cllr.. Backhouse, P. Afford (Scalby Football), B. Kendall (FONSA and In Bloom), Mrs J Marley (Clerk), 17 members of public (to 7.35pm)

87/12  DECLARATIONS OF INTEREST

87/12.1           Received  from Cllr. Bastiman – personal and prejudicial – agenda items 10.2, 10.3, 10.5 and 13 as he was SBC Cabinet member for Strategic Planning & Regeneration.

87/12.2           Received from Cllrs E and W Black, Mrs Kendall and Mrs Snow – personal and non-prejudicial as they were hall trustees.

87/12.3           Received from Cllr. Watson – personal & non-prejudicial – agenda item 13 as he was a member of the Borough Council’s Planning & Development Committee.

88/12  MINUTES

88/12.1           RESOLVED the minutes of the Council Meeting held on 13th June 2012 be approved as a correct record and signed by the Chairman;

PROCEDURAL MATTER  At 7.03pm, Standing Orders were suspended to allow the Public Open Forum & external reports.

89/12  POLICE REPORT

RESOLVED written report (circulated with agenda) be received. Cllr. Thompson referred to recent vandalism at the bowling club and attempts to remove the lightning conductor – clerk was asked to ensure the PCSO was aware of these incidents.

90/12  PUBLIC OPEN FORUM

G. Edwards of York Potash updated members on developments since his last visit. Several parishioners spoke in strong objection to the proposed application for 2 wind turbines at Scalby Hayes. Council was also asked to write in support of the Yorkshire & Humber Local Government Office’s request to the Minister for Health to reverse the decision to close the children’s heart surgery unit at Leeds.

91/12  COUNTY COUNCILLOR’S REPORT

NOTED County Cllr. Backhouse’s report 1] resurfacing of Coldyhill Lane from the zebra crossing to Scalby Road was already in this year’s highways works programme; 2] Cllr. Gething had reported dangerous levels of excess chippings on Redscar Lane and Moor Lane following resurfacing & the area had been swept accordingly; 3] meeting of Scalby library steering group at 7pm tomorrow; 4] a meeting was to be arranged to consider ways of addressing the long-standing problem with parking around Newby Primary School; 4] the recent flooding in Cleveland Avenue was due to the gullies being blocked with grass cuttings

92/12  SBC LIAISON OFFICER’S REPORT

Possible relocation of Scarborough Town Hall to be considered at cabinet meeting of 17th July with a final decision to be made at full council meeting of 20th July.

PROCEDURAL MATTER  At 7.30pm, Standing Orders were resumed.

93/12  MATTERS RAISED IN PUBLIC OPEN FORUM

93/12.1           NOTED: Mr Edwards report & the comments on planning application. Agreed Clerk write to Minister of Health.

93/12.2           The Chairman proposed that agenda item 13.3 be brought forward and it was so RESOLVED. Councillors therefore considered planning application 12/01201/FL submitted by Mr and Mrs Dean T two 11kW Gaia turbines (24.9m. high to blade tip)  at Scalby Hayes, Barmoor Lane, Scalby. Following a discussion which took into account the points which had been made during the Public Open Forum, Council resolved unanimously to object to the application on the grounds it did not accord with several planning policies including policies E1, E12, E27, E35, E36 and H10. 7.35pm All members of public left the meeting].

94/12  COUNCILLOR’S REPORTS ON HIGHWAY & FOOTPATH MATTERS

94/12.1           RECEIVED updates from Clerk (circulated with agenda) on previously reported highway and footpath matters;

94/12.2           NOTED 1] grass & weeds on north side of Station Lane from its junction with scalby Road; 2] from Green Lane zebra crossing towards scalby Road all gully covers loose as surrounding tarmac has been washed out; 3] Column 5 on Cross Lane not striking. RESOLVED  Clerk to pass to relevant authority for action.

95/12  REPORTS FROM OUTSIDE BODIES  The following were RECEIVED:

95/12.1           Allotments Friends Group – Mr Kendall reported  a committee had been elected at the Special General Meeting. Plot inspections had re-commenced and six “first warning” letters were to be sent out. The Annual Barbeque had been cancelled due to the wet weather.

95/12.2           In Bloom Group – Mr Kendall reported 1] In Bloom judging was to take place on 16th July; 2] In Bloom Produce Show to be held 29th July in Parish Hall.

95/12.3           Scalby Football & Cricket Clubs – Mr Afford reported Phil Perry of the Cricket club had been an Olympic Torch runner (in Thirsk) and thoroughly enjoyed the day even though it had been very hot.

95/12.4           CAP Group – Next meeting 24th July.

95/12.5           Road Liaison Committee – Next meeting September.

95/12.6           NYMNP Coastal Area Parish Forum – next meeting 17th July.

95/12.7           North Yorkshire & Cleveland Coastal Forum – Next meeting September.

95/12.8           Yorkshire Local Councils’ Association – Cllr. Mrs Kendall reported Cllr. Blackburn (Cayton) has been elected Chairman of the Scarborough Branch. A very useful presentation on flashing speed warning signs had been given.

95/12.9           Twinning Association – Next meeting 9th August.

95/12.10         York and North Yorkshire Playing Fields – Cllr. Miller reported the meeting of 6th July had been unable to elect a committee and a further meeting was to be held in a fortnight when the future of the group would be decided.

95/12.11         Yorkshire Coast & Moors Area Committee – Cllr. Thompson reported the Youth support Service was soon to be rolled out to Newby and Scalby.

95/12.12         North York Moors National Park Authority – Cllr. Thompson reported the authority was streamlining its committee structure in order to make cost savings

95/12.13         CPRE – Cllr. Mrs Kendall reported the next meeting was to be held in September. Cllr. Miller (who was a member of CPRE County branch in his own right) reported there was currently no officially recognised CPRE branch for this area.

96/12  CORRESPONDENCE

96/12.1           RECEIVED Invitation to NYMNP Joint Area Parish Forum (Tuesday 17/7/12, 5.45pm onwards at Danby) [circulated with agenda].AGREED Cllrs. Foote, Thompson and Watson to attend.

96/12.2           RECEIVED letter from SBC regarding designation of local green spaces [letter of 14/5/12 and pro forma circulated with agenda]. RESOLVED Clerk to submit the following sites for inclusion within the emerging local plan:- 1] nursery field, 2] field next to the allotments, 3] Linden Road open space and playground, 4] Carr Lane playing fields, 5] Church Beck green, 6] Moor Lane field, 7] Millennium field.

96/12.3           SBC Planning – Officer Delegation Scheme. RECEIVED & NOTED letter of 1st June 2012 from SBC [circulated with agenda] in response to council’s query at April meeting regarding 12/00742/COND. Mr Kaye also gave additional information which was NOTED.

Mr Kaye left the meeting at 8.35pm.

96/12.4           RECEIVED invitation to YLCA AGM (Saturday 21/7/12, 1.30pm for 2pm, Poppleton). AGREED Cllr. Mrs Kendall to attend as this council’s representative.

96/12.5           RECEIVED SBC consultation on Community Asset Transfer Plan [letter, consultation draft and questionnaire circulated with agenda]. AGREED defer to September meeting.

FINANCE & GENERAL PURPOSES ISSUES

97/12  FINANCIAL MATTERS

97/12.1           Monthly rent – RESOLVED standing order in sum of £300, payable first day monthly commencing 1st August 2012 until further notice to Newby and Scalby Community Hall Trust be signed.

97/12.2           In the light of Cllr. Miller’s report at minute 95/12.13, it was RESOLVED the cheque for £29 to the CPRE for annual membership be removed from the schedule of accounts payable. RESOLVED the amended Schedule of Accounts for July 2012, Schedule 4 be approved & paid.

97/12.3           Public seats in the parish. RECEIVED Clerk’s report [circulated with agenda]. RESOLVED 1] taking over responsibility for public seats from Scarborough Borough Council was a good idea in principle; 2] Clerk to take matter forward, negotiate with SBC and report back to Council.

98/12  GENERAL PURPOSE MATTERS

98/12.1           Code of Conduct [Minute 82/12.1 refers].NOTED the Disclosable Pecuniary Interest Regulations were now in force. RECEIVED the final version of the NALC Code of Conduct [circulated with agenda] and RESOLVED this version of the code be adopted with immediate effect.

98/12.2           RESOLVED no Council meeting to be held during August.

98/12.3           Queen Elizabeth II Fields in Trust application as it relates to Carr Lane Playing Field. RECEIVED Non-charitable Deed of Dedication [circulated with agenda] for consideration. Council was of the opinion the terms of the deed were too restrictive and not in the best interests of either Council or the JJ Burchell Bequest. RESOLVED Deed not be signed.
