Minutes Council meeting 11th March 2015

MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Rickinson Hall, St. Laurence’s Church Rooms, Scalby,
on Wednesday, 11th March 2015 at 7pm.

 PRESENT: Councillor Mrs G Kendall (Chairman), Cllrs. D Bastiman, S Foote, S Gething, R Pickersgill, Mrs C Snow, RI Thompson, R Towse, Mrs D Wiles (from 7.03pm).

ALSO IN ATTENDANCE:  County & Borough Cllr. A. Backhouse, M. Richards (FONSA) (left 7.56pm), P. Staveley (In Bloom), 46 members of public (most left at 7.40pm), Mrs J Marley (Clerk).

ABSENT:      Borough Cllrs. Mrs S Backhouse and A. Jenkinson, Cllrs. Mrs E Black, W Black, TW Miller, and B Watson.

The Chairman reminded those present that filming, photographing or audio recording of the proceedings was allowed – persons wishing to record were asked to notify the Clerk of their intention prior to the start of the meeting. In the interests of encouraging public participation, it was requested that anyone filming did not include members of the public “in shot”.

32/15  APOLOGIES FOR ABSENCE  Received & accepted from Cllrs. Mrs E Black and W. Black (visiting relatives abroad), Cllr. Watson (poorly).

33/15  DECLARATIONS OF INTEREST  

33/15.1           Cllr. Bastiman declared a personal interest in agenda items 12, 13 and 14 as he was a SBC Cabinet member & held the Strategic Planning & Regeneration portfolio.

33/15.2           Cllr. Mrs Kendall declared a personal interest in agenda item 9.2 as she was a director of Raincliffe Woods Community Enterprise.

34/15  MINUTES

34/15.1           Having been previously circulated, it was RESOLVED the minutes of the Council Meeting held on 11th February 2015 be approved as a correct record and signed by the Chairman.

PROCEDURAL MATTER  At 7.03pm, Standing Orders were suspended to allow the Public Open Forum.

35/15  PUBLIC OPEN FORUM

35/15.1           Many members of the public spoke on their concerns regarding the planning application to demolish NatWest Bank and erect a Sainsbury’s Local. In the main, concerns related to the impact of the development on the area and the existing businesses nearby, problems in respect of traffic, the lack of a demonstrated need for such a development, and the poor design of the development. Also mentioned was the proposed removal of the leylandii (which may be a bat roost) and noise from air conditioning units may affect neighbours. The council was also handed a copy of a petition which contained over 700 signatures against the development.

PROCEDURAL MATTER – At 7.34pm, Standing Orders were resumed. The Chairman moved and it was resolved that the order of business be varied by next considering agenda item 12.1.

36/15  PLANNING APPLICATION AT NATWEST BANK SITE

36/15.1           Application 15/00046/FL to demolish the NatWest and erect a Sainsbury’s Local food store including access, car parking and landscaping at 454 Scalby Road, Newby was considered. Members took into account the concerns of the public raised during the Public Open Forum. Councillors were unanimous in their decision to object to the application on the grounds there was a lack of demonstrated need or public appetite, the design/appearance of the building was contrary to Saved Local Plan Policy E12, the highway access was totally inadequate and unsuitable and the impact on the surrounding residential area was unacceptable.

At this point 44 members of public left the meeting

37/15  POLICE REPORT Resolved written report (tabled at meeting) be received.

38/15  EXTERNAL REPORTS

38/15.1           County Council:- County Councillor Backhouse reported a solution had been achieved regarding the problem on Newlands Park Crescent with trees obstructing resident’s gateways. He was also aware the problems with parking on the verges and pavements around Newby & Scalby Primary School continued. County Cllrs. Backhouse and Bastiman both reported that NYCC would not be moving the library into the space available at the proposed extra care facility on the old rugby club site.

38/15.2           Borough Council:-  No matters to report.

38/15.3           FONSA:- Mr Richards reported that with the exception of a half plot, all plots were let and there was no waiting list. 29 people had attended the annual dinner at the Yew Tree. A sunflower competition was to be held over the current growing season. The boundary fence on the land owned by SBC had still not been repaired despite it being reported several times over the last year. Resolved Clerk to contact SBC Estates and ask yet again that they ensure their tenant maintains the fence in a stock-proof condition.

38/15.4           In Bloom:- Mr Staveley reported litter picking had begun. The spring In Bloom Judging would take place on 15th April. School potato planting would start next week. Carol’s Quiz finished at the end of March.

At this point, Mr Richards & the remaining 2 members of public left the meeting.

39/15  COUNCILLOR’S REPORTS & UPDATES

39/15.1           Received & noted verbal report from Chairman on the recent meeting with the Chairman of the Twinning Association. Resolved 1] Council to inform Pornic it no longer wished to exchange gifts on an annual basis; 2] request to put previous gifts received on display in the homes of members of the Twinning Committee not acceptable – Clerk to write to Community Hall Trust to ask if it was prepared to display the pictures in the hall.

39/15.2           Received & noted verbal report from Cllr. Bastiman on the recent meeting of the Flood Working Group – minimal progress had been made. The Environment Agency was now looking at widening the existing beck and sheet piling both banksides in order to protect the highway. Through its agents Smiths Gore, the Duchy of Lancaster (as riparian owners) had been reluctant to commit itself to any expenditure and it was resolved the Clerk write to Smiths Gore to remind them of their riparian responsibilities and encourage them to commit expenditure to the proposed project.

39/15.3           Received & noted update [circulated with agenda] from Clerk on highway, footpath and other general matters since last meeting. In respect of the broken VAS sign, Cllr. Bastiman made it clear  the sign was paid for by the Parish Council and as such it was not for NYCC to say it could not be repaired. Resolved Clerk to inform NYCC accordingly and investigate costs of repair.

39/15.4           Received & noted column 20 Hackness Road (dull emitter) had still not been repaired –  to be again passed to NYCC Highways.

40/15  CORRESPONDENCE

40/15.1           Received & noted Community Speed Watch programme [details circulated with agenda].

40/15.2           Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:-

  1. Email from Scalby Village Trust inviting all councillors to its AGM on 25th March, 7.30pm in St. Laurence’s Church Rooms – there will also be a discussion on the plans for the Temperance Hall. Received & noted.
  2. Raincliffe Woods Community Enterprise (which recently successfully took on management of the woods on a Community Asset Transfer from Scarborough Borough Council) has asked that a member of the parish is nominated to their board. Cllr. Mrs Kendall was a member of RWCE’s development group and is a founding director of RWCE. Resolved decision deferred to April meeting to allow Clerk to obtain advice from YLCA. Strong concerns that none of the other parishes in the wood’s area (East Ayton, Hackness, Irton and West Ayton) have been invited. Clerk to write to RWCE accordingly.

41/15.1           Resolved the Schedule of Accounts payable for March 2015 (Schedule 12) [tabled at meeting] be approved.

41/15.2           Internal auditor’s report for Quarter 3 of 2014/15 account year [circulated with agenda] received & noted.

42/15  GENERAL PURPOSE MATTERS

42/15.1           Receipt of summons etc. by electronic means – received & noted Clerk’s report [circulated with agenda] and resolved recommendations be approved.

46/15  REPORTS FROM OUTSIDE BODIES

The following were RECEIVED:

46/15.1           CAP Group. – next meeting 7/4/15 (Cllr. Gething).

46/15.2           Roads Liaison Committee – Cllr. Mrs Kendall reported on the meeting of 19/2/15. There was discussion as to the value of attending this committee since most of the items considered now related to the south of the borough. Next meeting 28/5/15 (Cllrs. Mrs Kendall & Thompson).

46/15.3           NYMNP Coastal Area Parish Forum – Cllr. Thompson reported he had attended the meeting on 25/2/15, but gave no details of the business discussed.

46/15.4           North Yorkshire and Cleveland Coastal Forum – no report, next meeting believed to be Sept. 2015.

46/15.5           Yorkshire Local Councils’ Association – next meeting 1/6/15.

46/15.6           Twinning Association – Cllr. Thompson reported on recent meetings and the fact SANTA hoped the Parish Council would not withdraw its support.  SANTA was also asking who would represent the Parish Council at this year’s visit to Pornic on 18th to 23rd June (Cllrs. Mrs Snow and Thompson not available) – as Parish Council elections were to be held on 7th May resolved to defer this matter until Council meeting on 13th May. Next SANTA meeting 14th April.

46/15.7           Yorkshire Coast & Moors County Area Committee – next meeting 26/3/15 (Cllr. Thompson).

46/15.8           North York Moors National Park Authority – Cllr. Thompson reported he had attended a recent planning committee meeting and also a meeting to discuss the Tour de Yorkshire which had considered how best to encourage tourism and co-ordinate publicity for the event.

46/15.9           Any other reports not previously notified – None.

47/15              CIRCULATION – None.

There being no further business on the agenda, the Chairman declared the meeting closed at 8.46pm.
