Minutes of Extraordinary Meeting of 5th June 2024

MINUTES OF EXTRAORDINARY MEETING OF NEWBY AND SCALBY TOWN COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 5th June 2024 at 9am.

 

PRESENT: Councillors R Thompson (Chairman), H Bore, R Holliday, B Marley, N Murphy, D Pickersgill, J Smith, C Thistleton.

ALSO IN ATTENDANCE: 20 members of public. Mrs J Marley (Clerk to Council).

ABSENT:       Cllrs. D Bastiman, S Foote, B Kendall, J Shepherd.

 

 

97/24              NON-ATTENDANCE OF COUNCILLORS

97/24.1            Apologies received & noted from Cllrs. D Bastiman, B Kendall and J Shepherd.

97/24.2            Resolved the reasons for absence given by Cllrs. Bastiman (prior commitment), Kendall (health) and Shepherd (prior commitment) be accepted.

 

98/24               DECLARATIONS OF INTEREST:  None.

 

99/24               MINUTES

99/24.1            Having been previously circulated, the minutes of the Annual Meeting of Council held on 8th May 2024 were resolved to be a correct record and authorised for signature by Cllr. Thompson.

 

100/24             EXTERNAL REPORTS

100/24.1          Police resolved the Scalby report for May incidents [tabled at meeting] be received and noted.

 

101/24             MATTERS FROM ANNUAL MEETING & COUNCILLOR’S REPORTS/ITEMS

101/24.1          At the Annual Meeting held on 8th May 2024 a member of public had asked why the meeting of 8th March 2024 was adjourned and the public had to leave [Minute 84/24 refers].  Resolved Council noted that checks (by Clerk) after the meeting indicated  that while the approved minutes showed no public had attended the meeting of 8th March 2024, at 9.34am on that day it had been “resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next item of business on the grounds it related to personnel / staffing, financial or legal matters”.

101/24.2          Reports 1] verge needed cutting back junction of Field Lane and Burniston Road; 2] tree branches obscuring warning light at pedestrian crossing Coldyhill Lane. Resolved Clerk to report to Highways.

 

102/24             CORRESPONDENCE

102/24.1          Class Q Permitted Development Rights – resolved letter from NYMNP (circulated with agenda) be received & noted.

102/24.2          Proposed extension of waiting restrictions, Greylands Park Avenue – resolved letter from NYC (circulated with agenda) be received. Further resolved no objection to the proposal.

102/24.3          Proposed disabled parking bay High  Street, Scalby – resolved letter from NYC (circulated with agenda) be received. Further resolved no objection to the proposal.

 

The Chairman suspended the meeting from 9.15am to 9.17am so as to allow the Clerk to leave the room in order to attend to a security matter with a member of public.

 

102/24.4          Proposed Tree Protection Order, 378 Scalby Road –  resolved letter from NYC (circulated with agenda) be received. Background information on the proposal was given by the Clerk. Resolved the proposal be supported.

102/24.5          Scalby Cricket Club – resolved email from Club requesting consent to undertake work at the clubhouse via a grant (circulated with agenda) be received. Further resolved that consent be given. This on the understanding the work was purely resurfacing of the existing area and no extending was to take place

102/24.6          Correspondence received after 31/5/24 which the Chairman of the meeting deems it necessary to consider as a matter of urgency.

 

103/24             FINANCE, REGULATORY & GENERAL MATTERS

103/24.1          Resolved the Schedule of Accounts payable for June 2024, Schedule 3 (£13,009-09) be authorised for payment. Cllrs. Smith and Thompson to do the online authorisations.

 

103/24.2          Resolved to pay HMRC by direct debit for future amounts due in respect of tax and national insurance & direct debit form signed in accordance with mandate.

 

 

104/24             PLANNING APPLICATIONS & APPEALS NOTIFIED

Resolved comments on the following applications be submitted to the planning authority:-

  1. ZF24/00332/FL Demolish existing building, erect 1 bungalow and 1 house, 143-145 Burniston Road, Newby – no objections.
  2. ZF24/00441/HS Replacement windows and create Juliet balcony to rear, 4 Wynbrook Court, North Street, Scalby – no objections.
  3. ZF24/00477/HS Erect 1½ storey side extension with rear dormer and single storey rear extension, 2 Norwich Close, Scalby – no objections.
  4. ZF24/00561/HS Erect single storey rear extension and porch to side, 2 Fieldstead Crescent, Newby – no objections.
  5. ZF24/00573/FL Erect single storey bungalow with new vehicular access, 32 Green Lane, Newby – no objections.
  6. ZF24/00625/FL Replacement windows in uPVC frames with double glazed units, St Laurence’s Church Hall, Church Hill, Scalby – no objections.
  7. ZF24/00634/HS Demolish single storey side extension, chimney outbuilding and garage. Erect single storey side extension and shed, 4 East Park Road, Scalby – no objections.

 

105/24             PLANNING DECISIONSResolved the following be noted:-

  1. ZF23/01311/OL Erect one dwelling and form vehicular access for existing dwelling, all matters reserved, 378 Scalby Road, Newby. Granted with conditions.
  2. ZF23/01568/AD Erect agricultural storage building for straw, Iansfield Farm, Burniston Road, Scalby. Appeal allowed.
  3. ZF24/00222/LB Install new roof vents, internal membrane, eaves protector, re-roof and new flashings, 29 and 31 High St, Scalby.  Granted with conditions.
  4. ZF24/00330/HS Erect single storey side and rear extension, 64 Newlands Park Grove, Newby. Granted with conditions.
  5. ZF24/00380/HS Erect two storey side extension and raise existing roof ridge line, 34 Hillcrest Avenue, Newby. Granted with conditions.

 

106/24            PLANNING MATTERS RECEIVED AFTER 31/5/24 None.

 

107/24             EXCLUSION OF PRESS AND PUBLIC

At 9.30am it was resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next item of business on the grounds it related to personnel/staffing, financial or legal matters.

Members of public present questioned the need for exclusion and demanded to know what confidential items were to be discussed. They did not leave the meeting room.  At 9.34 am the Chairman declared the meeting suspended and instructed Councillors to move to the Clerk’s office where the meeting could be re-convened.  At 9.41am the meeting was re-convened in the Clerk’s office

 

108/24             CONFIDENTIAL BUSINESS

Clerk reported a letter on a new legal matter had been recently received and it had been referred to Council’s insurers for advice. An update would be provided in due course. Resolved Clerk’s report be noted.

 

There being no further business to be transacted, the Chairman declared the meeting closed at 9.46am.
