MINUTES OF EXTRA ORDINARY MEETING OF NEWBY AND SCALBY TOWN COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Thursday, 19th December 2024 at 9am.
PRESENT: Councillors R Thompson (Chairman), H Bore, R Holliday, G Kendall, R Kendall, B Marley, J Smith, R Towse (left 10.12am).
ALSO IN ATTENDANCE: Approximately 12 members of public (left at various times). Mrs J Marley (Clerk to Council).
ABSENT: Cllrs. D Bastiman, S Foote, N Murphy, J Shepherd, C Thistleton.
164/24 NON-ATTENDANCE OF COUNCILLORS
164/24.1 Apologies received & noted from Cllrs. D Bastiman, J Shepherd and C Thistleton.
164/24.2 Resolved the reasons for absence given by Cllrs. Bastiman (medical appointment), Foote (health), Shepherd (medical appointment) and Thistleton (work commitment) be accepted.
165/24 DECLARATIONS OF INTEREST: None.
166/24 MINUTES
166/24.1 Having been previously circulated, the minutes of the Ordinary Meeting of Council held on 20th November 2024 were resolved to be a correct record and authorised for signature by Cllr. Thompson.
167/24 PUBLIC PARTICIPATION
A question was asked regarding Minute 157/24.5 (the minute had not included details of a question asked. Other matters raised (none of which were on the agenda) included 1] dis-satisfaction with the meeting schedule; 2] why a parishioner’s letter and response had not been included on this agenda; 3] general dis-satisfaction with Council and councillors; 4] concerns re. Danes Dyke surgery and why this Council was not doing more to help them find alternative premises.
168/24 MATTERS RAISED IN PUBLIC FORUM
Cllr. Bore explained minutes were a record of decisions taken and resolved no action be taken on the parishioner’s question. In respect of other matters raised there was no formal response to items 1] to 3] inclusive; item 4] resolved Clerk to speak with Cllr. Bastiman as it was believed he had spoken with the surgery.
169/24 EXTERNAL REPORTS
169/24.1 Police – resolved the Scalby report for November incidents [emailed to councillors 2/12/24] be received and noted.
170/24 UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS/ITEMS
170/24.1 Allotments [Minute 155/24.4 refers] – noted Clerk had emailed and spoken with landlord who hoped to be able to provide a preliminary response to the access track improvements in the near future.
170/24.2 Resolved the following reports from Councillors of any highway & footpath matters requiring attention be received & referred to the relevant authority:- blocked gully Coldyhill Lane. Also noted the footbridge at Church Beck had recently been replaced (by NYC Bridges Dept).
171/24 CORRESPONDENCE
171/24.1 Resolved details of proposed Tree Preservation Order 24/00006/TPO at 5 East Park Road, Scalby [circulated with agenda] be received & noted & agreed no objections.
171/24.2 Unlit street lights at bus stop on Field Lane – 1] noted a parishioner has complained about these lights; 2] in the absence of Cllr. Bastiman, the Clerk reported these lights although on the public highway were part of the legal agreement for the overall development of the High Mill site and as such would not be adopted by North Yorkshire Council until adoption of the full development had taken place. Resolved Council considered this unacceptable and pending NYC taking action to adopt lights located on the existing highway maintainable at public expense, Clerk to ask Taylor Wimpey to deal with the issue.
171/24.3 Correspondence received after 13/12/24 which the Chairman of the meeting deems it necessary to consider as a matter of urgency – resolved a letter from a parishioner regarding a blocked gully/flooding on the corner of The Meadows and The Green be received. Further resolved there was the potential for this flooding to go downhill and cause problems around the school; Clerk to try to obtain photographs and report to NYC Highways.
172/24 FINANCE, REGULATORY & GENERAL MATTERS
172/24.1 Cllr. Towse questioned why the breakdown of staffing costs was not available for all councillors to see prior to a decision being taken. A recorded vote was requested by Cllr. Towse:- for Cllrs. Bore, Holliday, G Kendall, J Smith, R Thompson, against Cllrs. R Kendall and Towse. Resolved the Schedule of Accounts payable for December 2024, Schedule 9 (£3,580-25) be authorised for payment. (Online authorisations to be done by Cllrs. Smith and Thompson.
172/24.2 Precept for 2025/26 [report circulated with agenda]. Resolved the recommendations of the report be accepted and a precept of £123,768 be set for 2025/26.
172/24.3 Financial Regulations – [report circulated with agenda]. A recorded vote was requested by Cllr. Towse:- for Cllrs. Bore, Holliday, G Kendall, J Smith, R Thompson, against Cllrs. R Kendall and Towse. Resolved recommendations of the report be carried.
172/24.4 Internal Audit report (July-October) [circulated with agenda]. Resolved report be received & noted.
172/24.5 Internal Audit – noted the current auditor would not be offering a service to this Council for the 25/26 financial year onwards. Resolved Clerk/RFO to make enquiries of NALC/YLCA etc regarding possible replacement and report to future Council meeting.
173/24 PLANNING APPLICATIONS & APPEALS NOTIFIED
Resolved comments on the following applications be submitted to the planning authority:-
- ZF24/01738/HS Single storey side and rear extension18 Ridge Green, Scalby — no objections.
- ZF24/01743HS Erect single storey rear extension, 15 Mill Way, Scalby – – no objections.
- ZF24/01809HS Erect single storey extensions to front and rear elevations, Parish Hall Cottage, Scalby Road Scalby – – no objections. Condition requested on any consent so as to ensure contractors/building operation does not compromise entrances, operation and parking at Parish Hall.
174/24 PLANNING DECISIONS – Resolved the following be noted:-
- NY/2024/0158 Install floodlights (4 per tennis court), Scalby Tennis Courts, Scalby Road, Scalby. Granted with conditions.
- ZF24/01439/HS Erect single storey extension to front, 5 St. Joseph’s Close, Newby. Granted with conditions.
- ZF24/01488/HAS Vary condition 1 of ZF23/00821/HS to allow alternative roof design, 56 Hackness Road. Granted with conditions.
- ZF24/01489/RG3 Erect prefabricated classroom and boundary fencing, Gallows Close Play Centre Endcliff Crescent Newby. Granted with conditions.
- ZF24/01573/HS Erect single storey, front, side and rear extensions with new porch and vehicular access, 530 Scalby Road Scalby. Granted with conditions.
175/24 PLANNING MATTERS RECEIVED AFTER 13/12/24 – None.
176/24 REPORTS FROM OUTSIDE BODIES & EVENTS ATTENDED – none to receive.
177/24 EXCLUSION OF PRESS AND PUBLIC
At 10.12am it was resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next items of business on the grounds they related to personnel/staffing, financial or legal matters.
PROCEDURAL NOTE:- Cllr. Towse left the room at this point. One of the security guards entered the room asking what was happening and it was explained that their services were no longer required and the Clerk would be speaking with their company in the near future.
178/24 CONFIDENTIAL BUSINESS – resolved there were no matters to consider.
There being no further business to be transacted, the Chairman declared the meeting closed at 10.17am.
