MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Rickinson Hall, St. Laurence’s Church Rooms, Scalby,
on Wednesday, 14th September 2016 at 7pm.
PRESENT: Councillor R Towse (Chairman), Cllrs. DJ Bastiman, Mrs E Black, S Foote, R Pickersgill, Mrs D Wiles
ALSO IN ATTENDANCE: Mrs L Staveley for P. Staveley (In Bloom), PCSO 5498Begg and PCSO 5627Kitson (left 7.08pm), 6 members of public (left various times), Mrs J Marley (Clerk).
ABSENT: Cllrs. G Edmunds, Mrs R Holliday, TW Miller, Mrs PC Snow, RI Thompson, County Cllr. A Backhouse, Borough Cllrs. L. Backhouse, V Inman, A Jenkinson, H Lynskey.
The Chairman reminded those present that filming, photographing or audio recording of the proceedings was allowed – persons wishing to record were asked to notify the Clerk of their intention prior to the start of the meeting. In the interests of encouraging public participation, it was requested that anyone filming did not include members of the public “in shot”.
127/16 APOLOGIES FOR ABSENCE Received & accepted from Cllrs. G Edmunds (work), Mrs R Holliday (holiday), TW Miller (health), Mrs PC Snow (family bereavement), RI Thompson (holiday), County Cllr. A. Backhouse (prior commitment), P Afford (prior commitment).
128/16 DECLARATIONS OF INTEREST – Received & noted from Cllr. Pickersgill and Towse (agenda item 11.4 as applicant known to them).
With Council’s agreement, the Chairman varied the order of the agenda so that item 6 was considered next.
129/16 POLICE REPORT Written report was received. Good reductions in burglaries, but worrying increase in theft. Information & leaflets re. new Community Messaging handed to those present.
At this point (7.08pm) the Police left the meeting.
130/16 MINUTES
130/16.1 Having been previously circulated, it was RESOLVED the minutes of the Council Meeting held on 13th July 2016 be approved as a correct record and signed by the Chairman.
PROCEDURAL MATTER
With councillor’s agreement the order of the agenda was varied so the remaining items were considered in the order 4, 9.4,5, 11.4, 11.7, 7 onwards.PROCEDURAL MATTER
At 7.10pm, Standing Orders were suspended to allow the Public Open Forum.
131/16 PUBLIC OPEN FORUM
Members of public spoke to three separate matters.
131/16.1 Parking around The Green [Minute 83/16.1 refers]. Concerns centred on lack of enforcement following start of new school year and the wish not to lose the improvements which had been made.
132/16.2 Planning application at 5 Hillcrest Avenue. A parishioner spoke in support of this application (an email from the parishioner had been received on 9th September, and all councillors present had a copy). The applicants also spoke to give further information on their application. A parishioner spoke with objections to the application.
132/16.3 Planning application at 8 Field Close Road. Member of public spoke on behalf of Scalby Village Trust in respect of its concerns.
PROCEDURAL MATTER – At 7.17pm, Standing Orders were resumed.
133/16 MATTERS RAISED IN PUBLIC OPEN FORUM None.
133/16.1 Parking around The Green [Minute 83/16.1 refers]. All present agreed situation was vastly improved on six months ago. Chairman explained he had felt it inappropriate to ask SBC to start enforcement as soon as new school year began. Council took the view that it was not possible to remove all parking by parents – a certain amount was inevitable and had to be accepted. Cllr. Mrs Wiles (as a School Governor) to ask if 1] a resident could attend a Governor’s Meeting to put the resident’s case and 2] ask if school gates could be opened 5 minutes earlier.

133/16.2 Planning application at 5 Hillcrest Avenue. Members noted all the views expressed.
133/16.3 Planning application at 8 Field Close Road. Members noted the concerns expressed.
134/16 PLANNING APPLICATION 16/01341/HS
134/16.1 [Brought forward] Agenda item 11.4
Taking into account representations made by the applicant, supporters and objectors, the Council agreed it supported this application as submitted.
At this point (7.45pm) three members of public left the meeting.
135/16 PLANNING APPLICATION 16/01744/FL
135/16.1 [Brought forward] Agenda item 11.7
Council took into account representations made by the representative of Scalby Village Trust. There was a general feeling the proposal was essentially “garden grabbing” and inappropriate for the site. A site visit was essential to fully appreciate the impact which the proposals would have, both to the immediate area and to the longer distance views into the area from Field Close Road. Council agreed it strongly objected to the application as submitted.
At this point (7.50pm) a member of public left the meeting.
136/16 EXTERNAL REPORTS
136/16.1 County Council:- No report to receive.
136/16.2 Borough Council:- Borough Cllr. Bastiman reported a letter in an August issue of the Scarborough News suggesting Scalby Manor Caravan Park was about to be sold by Scarborough Borough Council was wrong – the current occupiers of the site held a lease until 2028. The illegal campers near Scalby Mills Bridge had been moved on and the site cleaned by SBC. A recent meeting of the Flood Group with the Environment Agency had been disappointing – no progress whatsoever had been made by the EA.
136/16.3 FONSA:- No representative present.
136/16.4 In Bloom:- Mrs Staveley reported prizegiving for the Schools Potato Competition would take place on 21st September and on 23rd September for the Garden Competition. Council thanked the In Bloom group for all its hard work.
137/16 COUNCILLOR’S REPORTS & UPDATES
137/16.1 Scalby Library [Minute 119/16.1 refers] – received & noted update by Cllr. Towse which included 1] problems with boundaries and rights of way had been referred to NYCC who were dealing 2] following a meeting with the Management Volunteers a draft Heads of Terms was almost complete and 3] it was hoped to have a full report available for the October meeting.
137/16.2 Received & noted update [circulated with agenda] from Clerk on highway, footpath and other general matters since last meeting. Also received & noted report that the notice of a Casual Vacancy in the Newby Ward (caused by the death of Cllr. Gething) had been placed on noticeboards.
137/16.3 Received & noted reports from several councillors in respect of highway matters requiring attention. (Clerk to refer to Highways).
138/16 CORRESPONDENCE
138/16.1 Barclays Bank (Cllr. Black) – noted Scalby branch will close on 4th November 2016 – agreed Clerk to send a letter of objection.
138/16.2 Request for change to part night lighting in Newby Farm Close (Cllr. Bastiman) – received & noted Cllr. Bastiman’s verbal report that following the theft of garden ornaments a parishioner had requested a change to the street lighting. The matter had been referred to the NYCC Street Lighting Team.
138/16.3 Letter of thanks from Mr B. Watson – received & noted.
138/16.4 Correspondence received after preparation of the agenda which the Chairman of the meeting deems it necessary to consider as a matter of urgency:- received & noted an email (dated 9th September) from a parishioner regarding the planning application at 5 Hillcrest Avenue. All councillors present at tonight’s meeting had been given a copy – see Minute 132/16.2.

139/16 FINANCIAL MATTERS
139/16.1 Resolved the Schedule of Accounts Paid for August 2016 (Schedule 5) and Payable for September 2016 (Schedule 6) be approved.
139/16.2 Trusteeship of JJ Burchell Bequest as it relates to Carr Lane Playing Field. Clerk’s report [circulated with agenda] was considered and all three recommendations therein were agreed.
139/16.3 2015/16 external audit – noted an unqualified opinion had been received and the Conclusion Of Audit notice posted.
139/16.4 The Internal Auditor’s Report [circulated with agenda] for April-June 2016 was received & noted.
