held in the Committee Room, Newby & Scalby Community Hall, Scalby Road, Scalby,
on Wednesday, 13th February 2013 at 7pm
PRESENT: Councillor Mrs G Kendall (Vice Chairman in the chair), Councillors D Bastiman, S Gething, R Pickersgill, R Thompson (from 7.07pm), A Tyson, BF Watson.

16/13 MINUTES
16/13.1 RESOLVED the minutes of the Council Meeting held on 9th January 2013 be approved as a correct record and signed by the Chairman.
PROCEDURAL MATTER At 7.02pm, Standing Orders were suspended to allow the Public Open Forum.
17/13 PUBLIC OPEN FORUM
Parishioners reported 1] problem on railway line near Lancaster Way – drains broken when large hole dug out by Northern Gas several weeks ago, width of line severely restricted; 2] several lengths of bird’s mouth fencing alongside Church Beck missing or damaged.
PROCEDURAL MATTER At 7.06pm, Standing Orders were resumed.
18/13 MATTERS RAISED IN PUBLIC OPEN FORUM
RESOLVED 1] Clerk to write to SBC Estates Manager M. Close and solicitor D Kitson asking if they could bring pressure to bear on Northern Gas; 2] Clerk to contact NYCC Highways & ask for speedy repairs.
19/13 POLICE REPORT RESOLVED written report (tabled at meeting) be received.
20/13 EXTERNAL REPORTS
20/13.1 County Council:- County Councillor Backhouse reported his suggested changes to the street light changes had been unsuccessful and he understood the work would start in May. He also reported it was likely that glass could be put into the household blue waste bins by the end of 2013.
20/13.2 Borough Council:- No report to receive.
20/13.3 FONSA:- Mr Kendall reported revetting of the allotment track from the Hackness Road entrance had been completed & he was trying to source some planings for the track surface. A Special General Meeting was to be held on 20th February at which changes to the Constitution were to be considered.
20/13.4 In Bloom:- Mr Staveley reported the group was now on Facebook and Twitter.
20/13.5 Scalby Football Club:- No report to receive.
21/13 COUNCILLOR’S REPORTS & UPDATES
21/13.1 RECEIVED & NOTED verbal report from Cllr. Mrs Kendall on informal meeting of Parish Council Chairmen/Vice Chairmen with York Potash. RECEIVED & NOTED draft Statement of Support prepared by York Potash update [circulated with agenda] and RESOLVED Council was happy to sign.
At this point County Cllr. Backhouse left the meeting.
21/13.2 RECEIVED & NOTED update [circulated with agenda] from Clerk on highway & footpath or general matters since last meeting.
21/13.3 RECEIVED & NOTED Cllr. Bastiman’s report that the sheet piling on Church Beck [Minute 8/13.2 refers] had now been carried out by the Borough Council on behalf of the County Council. Various highway & footpath or general matters reported by councillors as requiring attention:- 1] various street lights out; 2] various potholes and road surface problems. RESOLVED Clerk to pass to highways.

22/13.2 From NYMNP dated 18th January 2013 – guidance note on planning policies for residential and holiday change of use proposals [circulated with agenda] – RECEIVED & NOTED.
22/13.3 From SBC Planning Enforcement regarding abandoned cars to rear of 35 & 37 Moor Lane [enclosed] – to note no evidence of any breach of planning control found RECEIVED & NOTED.
22/13.4 From NYMNP dated 15th January 2013 [circulated with agenda], asking for names of councillors interested in being involved in the community forum event planned for October. Cllrs. Gething, Thompson & Watson expressed an interest. RESOLVED Clerk to inform NYMNP.
FINANCE & GENERAL PURPOSES ISSUES
23/13 FINANCIAL MATTERS
23/13.1 RECEIVED Special Resolution proposed in accordance with Standing Order 33, and RESOLVED “in the light of new information received from Scarborough Borough Council and communicated to us by the Responsible Financial Officer in the form of a written report (in draft) dated 22nd January 2013, this Parish Council re-considers the level of precept it sets for financial year 2013/14, as recorded at Minute 163/12.5”.
23/13.2 RECEIVED the Clerk’s written report [circulated with agenda] on localised support for council tax and its implications for the setting of precepts in 2013/14 and beyond. RESOLVED 1] Council did not wish to accept SBC’s LSCT grant allocation for 2013/14 and 2] the level of precept Council wished to set for 2013/14 to remain at £41,252.
23/13.3 RESOLVED the Schedule of Accounts for February 2013, Schedule 11 be approved & paid
23/13.4 RECEIVED & NOTED the internal auditor’s unqualified report for October to December 2012 [circulated with agenda].
24/13 GENERAL PURPOSE & REGULATORY MATTERS
24/13.1 Christmas Lights Competition – RESOLVED 1] to add a Best Commercial category; 2] to introduce a rule to the effect that someone winning a category for two consecutive years would not be considered for a prize in the third year; 3] to increase public awareness by getting more publicity prior to the competition; 4] to re-distribute the prize money to ensure it is stepped within each category; 5] these changes to take effect for the 2013 competition.
24/13.2 Data Protection & Freedom of Information requests – NOTED that since Christmas the Clerk had spent 9 hours 50 minutes answering one data protection and FOI request.
ENVIRONMENT AND DEVELOPMENT ISSUES

25/13.1 RECEIVED request from resident of Gatesgarth Close [circulated with agenda] and RESOLVED Clerk write to Yorkshire Coast Homes.
26/13 GRIT BINS
26/13.1 Councillors considered if there was a need for this council to provide more grit bins in the parish. RESOLVED the matter be deferred to the September Council meeting.

29/13 REPORTS FROM OUTSIDE BODIES
The following were RECEIVED:
29/13.1 CAP meeting – Cllr. Mrs Kendall reported problems caused by unruly children were being addressed by the Police.
29/13.2 Yorkshire Local Councils Association – Cllr. Mrs Kendall reported items raised included the need for more training courses to be held in Scarborough, car sharing when attending courses, the council tax reforms coming into effect on 1st April 2013.
29/13.3 Twinning Association – Cllr. Thompson reported on the recent AGM. Meetings were now held at the Rugby Club. A French social evening was arranged for 9th April.
29/13.4 York and North Yorkshire Playing Fields – Cllr. Watson reported he understood a meeting had been arranged for 19th February.
29/13.5 Yorkshire Coast & Moors County Area Committee – Cllr. Thompson reported an update had been given on the progress of the street light energy reduction programme – many felt the matter was a fait accompli and the consultation had only paid lip service to the idea of seeking local views.
29/13.6 North York Moors National Park Authority – Cllr. R I Thompson (in his capacity as a member of the Authority) reported on various meetings of the authority which he had attended. The planning application for the potash minehead had now been submitted and should be determined by summer. The planning application for the pipeline was likely to be submitted to the National Infrastructure Planning body in the next month.
29/13.7 CPRE – Cllr. Mrs Kendall reported on a recent meeting where debate had focussed on the proposed potash mine.
