Minutes Council meeting 11th November 2015

MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Rickinson Hall, St. Laurence’s Church Rooms, Scalby,
on Wednesday, 11th November 2015 at 7pm.

PRESENT: Councillor R Towse (Chairman), Cllrs. D Bastiman, G Edmunds, S Foote, S Gething, Mrs R Holliday, R. Pickersgill, Mrs C Snow, R Thompson, BF Watson, Mrs D Wiles.

ALSO IN ATTENDANCE:  County Cllr. A Backhouse, Borough Cllr. V Inman, P. Staveley (In Bloom), 6 members of public, Mrs J Marley (Clerk).

ABSENT:      Cllrs. Mrs Black, TW Miller, Borough Cllrs. L Backhouse, A Jenkinson, H Lynskey, Mr Afford.

The Chairman reminded those present that filming, photographing or audio recording of the proceedings was allowed – persons wishing to record were asked to notify the Clerk of their intention prior to the start of the meeting. In the interests of encouraging public participation, it was requested that anyone filming did not include members of the public “in shot”.

156/15            APOLOGIES FOR ABSENCE Received & noted from Cllrs. Mrs Black (family commitment), Borough Cllrs. Jenkinson & Lynskey and Mr Afford (prior commitments).

157/15            DECLARATIONS OF INTEREST

157/15.1         Cllr. Bastiman declared a personal interest in agenda item 4 (development of land at Lady Edith’s Drive) as he was Leader of Scarborough Borough Council.

157/15.2         Cllr. Mrs Snow declared a personal interest in agenda item 11.1 (planning 36 North Street) as the applicant was a family friend.

158/15            MINUTES

158/15.1         Having been previously circulated, it was RESOLVED the minutes of the Council Meeting held on 14th October 2015 be approved as a correct record and signed by the Chairman.

158/15.2         Having been previously circulated, it was RESOLVED the minutes of the Staffing & Review Committee meeting held on 28th October 2015 be received and signed by the Chairman as a correct record.

PROCEDURAL MATTER

At 7.03pm, Standing Orders were suspended to allow the Public Open Forum.

159/15            PUBLIC OPEN FORUM

159/15.1         Planning application 15/00538/FL to erect one detached dwelling on land adjacent 12 Hay Lane, Scalby had been considered at the October Council meeting. Two members of public connected with this application expressed various concerns in respect of 1] the objections which had been submitted by Council and 2] the lack of declarations of interest from councillors living in the area.

159/15.2         At the October Council meeting a pre-planning presentation on behalf of Persimmon Homes had been given regarding the possibility of building 57 properties on land at the corner of Throxenby Lane and Lady Edith’s Drive which was provisionally allocated for development in the emerging Local Plan. Several members of public present were concerned about these proposals and had formed a small committee. They enquired if 1] commenting on the proposed submission of the Scarborough Borough Local Plan which was currently out for consultation would be on the Parish Council’s December agenda; 2] Council would be submitting comments on the Local Plan and 3] if parish councillors would do a site visit to the land at Lady Edith’s Drive.

PROCEDURAL MATTER – At 7.17pm, Standing Orders were resumed.

160/15            MATTERS RAISED IN PUBLIC OPEN FORUM

160/15.1         Nine councillors present tonight had been present at the October Council meeting. It was agreed that 1] the concerns on the planning application had been raised by various councillors; 2] it had been the decision of the Council as a whole to object to the application; 3] the objection submitted by the Clerk was in line with the concerns expressed at the October meeting. The Chairman also pointed out that anybody who believed a councillor had failed to declare an interest could refer the matter to the Monitoring Officer at Scarborough Borough Council.

160/15.2         The Clerk confirmed & it was noted that commenting on the proposed submission of the Scarborough Borough Local Plan (currently out for consultation) was on the Parish Council’s December agenda. Agreed that councillors would not be doing any site visits to the Lady Edith’s land until such time as Council was being consulted on a valid planning application (in order to avoid any inferences of pre-determination). The Chairman explained the decision as to whether or not to submit comments on the local plan (and what those comments would be) would be made at the December Council meeting.  The Chairman also explained the developers had asked to give their presentation in private and he had refused to allow this since he felt there was no justification for that action.

At this point (7.31pm) 5 members of public left the meeting

161/15            POLICE REPORT Resolved crime figures and activity reports (tabled at meeting) be received. The issue of parking on pavements was also mentioned.

162/15            EXTERNAL REPORTS

162/15.1         County Council:- County Councillor Bastiman reported on the 95 Alive scheme intended to address excessive speed in the county and the Trading Standards  department’s recent success in prosecuting scammers. County Councillor Backhouse reported on 1] a forthcoming multi disciplinary presentation about fracking to the Health Scrutiny Committee; 2] revised criteria for resident’s parking when NYCC is commenting on planning applications and 3] the newly introduced Considerate Parking Initiative regarding parking on verges or pavements (two warnings would be given but a third incident would result in a fixed penalty notice being issued).

162/15.2         Borough Council:-  Cllr. Inman asked if the Parish Council would be commenting on the pre-submission Local Plan – the Clerk confirmed the item was on the December agenda for consideration.

162/15.3         FONSA:- No representative present.

162/15.4         In Bloom:- For the benefit of newer councillors, Mr Staveley explained the In Bloom Group cared for many of the highway flower beds in the parish.

At this point (7.49pm) County Cllr. A Backhouse and Mr Staveley left the meeting

163/15            COUNCILLOR’S REPORTS & UPDATES

163/15.1         Received & noted update [circulated with agenda] from Clerk on highway, footpath and other general matters since last meeting. Also noted report by Clerk that the Christmas fund raising display [Minute 117/15.3 refers] to which lights had been donated began on 28th November & all councillors were welcome to attend.

163/15.2        Received & noted report from Cllr. Gething of slow running/blocked gully near 44/48 Linden Road (Clerk to refer to Highways).

163/15.3         2016 Twinning Civic Reception [Minute 150/15.6 refers]. Clerk’s report received & agreed 1] Prosecco at £3-95/person was acceptable 2] Chairman and Clerk authorised to sort the ‘crisp-type nibbles’ with Mr Coates of SANTA.

164/15            CORRESPONDENCE

164/15.1         Queen’s 90th Birthday Celebrations, June 2016 – received & noted copy of letter to Lord Lieutenant of North Yorkshire and advice from Borough Council [both circulated with agenda].

164/15.2         Gallows Close Community Shine Awards – received a request for sponsorship [details circulated with agenda]. Agreed to sponsor the “Young  Person of the Year” award in the sum of £25, Chairman to present the award.

At this point (7.57pm) Borough Cllr. Inman left the meeting

164/15.3         Variation of Premises Licence at The Plough – 1] received & noted parishioner’s letter of objection [circulated with agenda]; 2] (in accordance with Standing Order 51) noted that following consultation with the Chairman & other councillors, a letter of objection [circulated with agenda] was submitted to the licensing authority by the Clerk on behalf of Council; and 3] noted the application has now been withdrawn

At this point (8pm) Cllr. Bastiman left the meeting

164/15.4         Road Liaison Committee – received letter [circulated with agenda] regarding proposed dissolution. Cllr. Thompson gave the background of the group for the benefit of the newer councillors. Agreed disbanding the committee seemed the most appropriate action under the circumstances.

164/15.5         Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency – none.

FINANCE & GENERAL PURPOSES ISSUES

165/15            FINANCIAL MATTERS

165/15.1         Model Agreement 2016/17[circulated with agenda]. Agreed to accept the £4,923-05 offered.

165/15.2         Resolved the Schedule of Accounts Payable for November 2015 (Schedule 8) [tabled at meeting] be approved.

165/15.3         Received & noted the RoSPA Inspection report for Linden Road Playground [pages 1-11 circulated with agenda]. Agreed Clerk to ask SBC to give a price for carrying out repairs to the starred items.

165/15.4         Pension auto-enrolment [Minute 150/15.4 refers]received report [circulated with agenda] containing the recommendations of the Review & Staffing Committee. Agreed the Committee’s recommendations be accepted in full.

165/15.5         Received & noted Internal Auditor’s report [circulated with agenda] for Schedules 1-6.

165/15.6         Request by Scalby Cricket and Football Clubs for 10 year extension of their lease of Carr Lane Playing Fields – 1] noted Clerk’s report (in accordance with Standing Order 51) that following consultation with the Chairman, a 10 year extension had been offered on behalf of Council [letter circulated with agenda]; and 2]  agreed the offer be formally confirmed.

169/15            REPORTS FROM OUTSIDE BODIES

The following were RECEIVED:

169/15.1         CAP Group – Cllr. Gething reported matters raised at the recent meeting had included fly tipping, the Considerate Parking Initiative (7 tickets issued on 1 day), crime reporting boxes in shops and boy racers in Burniston. The next meeting was 21/1/16 (Cllrs. Gething & Mrs Wiles).

169/15.2         Roads Liaison Committee – awaiting outcome of proposal to disband.

169/15.3         NYMNP Coastal Area Parish Forum – next meeting 27/4/2016 (Cllr. Mrs Wiles)

169/15.4         North Yorkshire and Cleveland Coastal Forum – no report, next meeting date unknown.

169/15.5         Yorkshire Local Councils’ Association – Next meeting January 2016. (Cllr. Towse).

169/15.6         Twinning Association – Cllr. Thompson reported the next meeting was the AGM on 17/1/16. The annual dinner was to be at Fledglings Restaurant.

169/15.7         Yorkshire Coast & Moors County Area Committee – Next meeting 13/1/16 (Cllr. Thompson).
