held in the Committee Room, Newby & Scalby Community Hall, Scalby Road, Scalby,
on Wednesday, 11th January 2012 at 7pm

152/11 DECLARATIONS OF INTEREST
152/11.1 Councillor Bastiman – personal and prejudicial – agenda items 15 and 16 as he was a Cabinet member of Scarborough Borough Council and Portfolio Holder for Strategic Planning and Regeneration.

153/11 MINUTES
153/11.1 RESOLVED the minutes of the Council Meeting held on 14th December 2011 be approved as a correct record and signed by the Chairman;

154/11 POLICE REPORT RESOLVED written report (tabled at meeting) be received. [PCSO Newcombe then left the meeting].
155/11 PRIZE PRESENTATION – CHRISTMAS LIGHTS COMPETITION
The winners were:- Large Display – 46 Newby Farm Crescent and 2 Rockingham Drive; Medium Display – 33 Ridge Green and 3 Beck View; Small display – 11 Scalby Avenue and 113 St Leonard’s Crescent. The Chairman presented certificates & prize vouchers to the winners present.
156/11 PUBLIC OPEN FORUM
Most of the public were present to voice their objections to a planning application for a 34metre high wind turbine at Scalby Hayes. A previous application a few months ago had been withdrawn, however the current resubmission was substantially the same, although additional background information and a noise assessment were now included. Concerns remained on many aspects of the application including danger to wildlife, proximity to existing properties, impact on tourism due to the number of holiday properties likely to be adversely affected. Many of those present supported the principle of wind turbines, but felt it vital they were appropriately sited – this sentiment was shared by Cllr. Bastiman who also expressed opposition to this application since it was inappropriately sited.
157/11 COUNTY COUNCILLOR’S REPORT
County Cllr. Backhouse reported the youth café at Moor Lane had closed last autumn and was unlikely to re-open. Work was in progress to find a new home for the café and its equipment. He also reported the volunteer committee at Scalby Library was seeking a chairman.
PROCEDURAL MATTER At 7.20pm, Standing Orders were resumed.
158/11 MATTERS RAISED IN PUBLIC OPEN FORUM
Cllr. Miller proposed that agenda item 15.5 be brought forward and it was so RESOLVED. Councillors therefore considered planning application 11/02572/FL submitted by Mr Tulley for the erection of a 50kW wind turbine (34m. high to blade tip) at Scalby Hayes, Barmoor Lane, Scalby. Following a discussion which took into account the points which had been made during the Public Open Forum, Council resolved unanimously to object to the application on the grounds it did not accord with several planning policies including policies E1, E3, E12, E35, E36 and H10. 159/11 COUNCILLOR’S REPORTS ON HIGHWAY & FOOTPATH MATTERS
159/11.1 RECEIVED updates from Clerk (circulated with agenda) on previously reported highway and footpath matters;
159/11.2 NOTED & to be passed to relevant authority for action, reports of 1] various road surfaces in need of repair; 2] dangerous pavement near Hackness Road bridge; 3] various streetlights in need of work; 4] ponding at Newby Farm Estate entrance opposite library. County Cllr. Backhouse to see if he can get a list of planned maintenance for this area.
159/11.3 RECEIVED report by Cllr. Bastiman on recent Flood Working Group meeting – re-alignment of beck is best option but will require Duchy of Lancaster consent and planning consent. A meeting with Duchy’s agent has been arranged for later this month. [7.30pm Cllr. Backhouse left the meeting
160/11 REPORTS FROM OUTSIDE BODIES
The following Reports were RECEIVED:
161/11.1 Allotments Friends Group – Cllr. Watson reported he understood an annual lunch was to be held in the near future though he was not able to attend.
161/11.2 In Bloom Group – Mr Staveley reported they had now started on with work with the schools for a Jubilee Competition and this year’s Potato Competition. Winners would be shown on the Yorkshire In Bloom portfolio.
161/11.3 Scalby Football Club – Mr Afford reported this was the club’s Centenary Year and one of their members had been chosen to be an Olympic Torch bearer.
161/11.4 Twinning Association – Cllr. Thompson reported the AGM was to be held on 16th January.. He asked that the Council send a formal invitation to the dignitaries of Pornic (Clerk to organise).
161/11.5 York and North Yorkshire Playing Fields – Cllr. Miller would be attending a meeting on 13th January. Noted Cllr. Murkett (who had been involved with the association for a very long time) was very poorly and agreed he be wished well and thanked for all his hard work.
161/11.6 North York Moors National Park Authority – Cllr. Thompson had attended various meetings but none had discussed any matters relevant to the parish. The next Coastal Forum meeting (on 21st February) would include an update on the potash project.
161/11.7 CPRE – No report.
162/11 CORRESPONDENCE
162/11.1 RECEIVED letter & questionnaire (circulated with agenda) from NYCC on proposed opening hours for Scalby Library. RESOLVED Option 1 was this council’s choice.
162/11.2 RECEIVED letter of 21/12/11 from YLCA (circulated with agenda) regarding matters which members wished to be discussed with SBC Planning Dept at next branch meeting. RESOLVED Clerk to submit questions on retrospective applications, permitted development and paperless planning. Issues with planning portal and SBC home page websites not being user friendly to be taken back to SBC by Roger Kaye. If a planning decision differs from Council’s view, Clerk to ensure this is noted on the agenda
