Minutes Council meeting 10th September 2014

MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Rickinson Hall, St. Laurence’s Church Rooms, Scalby,
on Wednesday, 10th September 2014 at 7pm.

PRESENT:  Councillor R. Towse (Vice Chairman in the chair), Councillors D Bastiman (left 8.30pm), Mrs E Black, W Black, S Gething, TW Miller, R Pickersgill, Mrs C Snow, BF Watson..

ALSO IN ATTENDANCE:  Mr Colbourne (Scalby Toilets Trust) left 7.53pm, County Cllr. A. Backhouse (left 7.53pm), Bob Kendall (In Bloom and FONSA), 4 members of public (left at 7.16pm), 1 member of public (from 7.09pm), Mrs J Marley (Clerk).

ABSENT:      Borough Cllrs. Mrs S Backhouse and A. Jenkinson, Cllr. S Foote, Cllr. Mrs G Kendall, Cllr. RI Thompson, Cllr. A Tyson and Mr Afford.

As Chairman of the meeting, Cllr. Towse reminded those present that filming, photographing or audio recording of proceedings was allowed – persons wishing to record were asked to notify the Clerk of their intention prior to the start of the meeting. In the interests of encouraging public participation, it was requested that anyone filming did not include members of the public “in shot”.

PROCEDURAL MATTER Standing Order 64 was suspended for the duration of this meeting.

113/14            APOLOGIES FOR ABSENCE Received from Cllr. Tyson (reason – been busy all summer with businesses but hoped to attend October meeting – not accepted). Received & accepted from Cllr. Foote (poorly), Cllr. Mrs Kendall (poorly), Cllr. RI Thompson (holiday), and Mr Afford (Scalby Toilet Trust) (prior commitment).

114/14            DECLARATIONS OF INTEREST

114/14.1         Cllr. Bastiman declared a personal interest in agenda items 9.3, 12, 13 and 14 as he was a SBC Cabinet member & held the Strategic Planning & Regeneration portfolio.

114/14.2         Cllr. Watson declared a personal interest in agenda items 12, 13, and 14 as he was a member of SBC Planning Committee.

115/14            MINUTES

115/14.1         RESOLVED the minutes of the Council Meeting held on 9th July 2014 be approved as a correct record and signed by the Chairman.

PROCEDURAL MATTER  At 7.02pm, Standing Orders were suspended to allow the Public Open Forum.

116/14            PUBLIC OPEN FORUM Four members of the public expressed their concerns regarding loss of privacy, overlooking and access in respect of the planning application to erect two 3 bed houses on land to the rear of 22 Princess Close, Newby.

PROCEDURAL MATTER  At 7.08pm, Standing Orders were resumed.

At this point, a member of public arrived.

117/14            MATTERS RAISED IN PUBLIC OPEN FORUM – As the only matter raised related to a planning application on land to the rear of 22 Princess Close, Newby the Chairman proposed and it was resolved that Council considered that application now.

Details of a planning application to erect 2 number 3 bed detached houses with detached garages on land adjoining 22 Princess Close, Newby had been notified to councillors on email at 8.38am on Monday 8th September 2014. Councillors took into account the representations made by members of the public. Due to the proximity of the old railway line (which was owned by the Borough Council) there was concern some of the proposed access road may belong to the Borough Council. It was also unclear if the access road was to be a private road or a highway maintainable at public expense. It was resolved to object to the application on the grounds it was contrary to saved Local Plan Policies H10, E12 and R10.

At this point, 4 members of public left the meeting.

118/14            POLICE REPORT

RESOLVED written report (circulated with agenda) be received. Concern expressed that police did not attend Council’s meetings more regularly.  Noted report by Cllr. Towse that he and Cllr. Mrs Kendall hoped to have a meeting later in the month with the new sergeant for the area in order to discuss Council’s concerns.

119/14            EXTERNAL REPORTS

119/14.1         County Council:- County Cllr. Bastiman reported there was to be a meeting on 15/9/14 in an attempt to progress the flood prevention measures proposed for Church Beck. County Cllr. Backhouse reported a provisional approval by the NYCC Executive for a waste recovery plant at Allerton Park was to be considered at a special NYCC meeting on 24/9/14.

119/14.2         Borough Council:-  Borough Cllr. Backhouse reported the numbers of large recycling bins for glass were now being reduced in order to encourage people to use their domestic bins for glass. Notices had been posted at all community recycling sites and the removal of bins would continue over the next few weeks. He also reminded people that changing the timings on traffic lights (eg. Coldyhill lane) could have an impact on other sets of lights on Scalby Road since they worked in an overall sequence.

119/14.3         FONSA:- Mr Kendall reported the storage shed was now in place and being put to good use.  Most of the allotments were in a good state, those which were untidy had recently received warning letters.

119/14.4         In Bloom:- Mr Kendall reported the In Bloom results would be announced at a presentation on 16/9/14 and the Best Kept Garden competition results on 27/9/14. The planters for Stony Lane corner were almost ready.

120/14            COUNCILLOR’S REPORTS & UPDATES

120/14.1         RECEIVED & NOTED update [circulated with agenda] from Clerk on highway & footpath and other general matters since last meeting.

120/14.2         RECEIVED & NOTED Various highway & footpath or general matters reported by councillors:- 1] overhanging vegetation snicket from Barmoor Close to Scalby Road (Clerk to email Area3 Highways); 2] rotten decking on bridge at Church Becks (Clerk to email Area3 Highways); 3] various overhanging trees Moor Lane (reported August) – no action yet, Clerk to email Area3 Highways.

121/14            CORRESPONDENCE

121/14.1         Received & noted email of thanks [circulated with agenda] from Wreyfield Rainbows.

121/14.2         Received invitation to North Yorkshire & Cleveland Coastal Forum Annual Conference  10-3.45pm Wed 17 Sept at Whitby [circulated with agenda]. Noted Cllrs. Thompson and Watson unable to attend.

121/14.3         Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:- Received & noted copy of public notice [circulated at meeting] regarding Borough Council’s proposed sale of an area of Public Open Space adjacent 1 Newby Farm Road. Following robust debate it was resolved not to make any objections or representations.

FINANCE & GENERAL PURPOSES ISSUES

122/14            FINANCIAL MATTERS

122/14.1         RESOLVED the Schedules of Accounts payable for August 2014 (Schedule 5) [circulated with agenda] & September 2014 (Schedule 6) [tabled at meeting] be approved.

122/14.2        RECEIVED Clerk’s report [circulated with agenda] regarding allotment rent charges from 1st October 2014 and resolved rent to be increased to £33 for a full plot for the period 1st October 2014 to 30th September 2017.

122/14.3         Financial support for Scalby Toilets [deferred from July meeting, minute 106/14.3 refers] – With the Chairman’s permission, Mr Colbourne reported on the refurbishment work (including replacement of the hand driers) which the Toilet Trust wished to undertake in the future. Following robust discussion Cllr. Bastiman proposed and it was resolved that the Council pay £500 a year towards the cost of providing and running the toilets in Scalby High Street commencing in financial year 2015/16 and running to financial year 2019/20 or until such time as the toilets close if that be earlier.

At this point, County Cllr. Backhouse and Mr Colbourne left the meeting.

123/14            GENERAL PURPOSE & REGULATORY MATTERS

123/14.1         Committees, policies & procedures. Received & noted Clerk’s report & background papers [circulated with agenda]. Resolved 1] to set up a standing committee, to be known as the Review & Staffing Committee & operated in accordance with the Terms of Reference as amended; 2] committee to comprise of 5 councillors, not 6, namely Council Chairman and Vice Chairman plus Councillors Bastiman, Gething and Watson; 3] changes to committee membership could made by the full council; 4] Clerk to organise first meeting of Committee; 5] the Complaints, Disciplinary, Grievance & Vexatious Policies [circulated with agenda] be adopted with immediate effect.

123/14.2        Change of meeting date [Minute 106/14.4 refers]. Noted 1] due to circumstances beyond Council’s control it has not been possible to carry out the resolved action; 2] with the consent of the Chairman and Vice Chairman the Rickinson Hall at St. Laurence’s Church Rooms had (where possible) been booked for Council meetings on the second Wednesday of the month.

123/14.3        Variation of Standing Orders. Received & noted Clerk’s verbal advice on the need to permanent vary Standing Orders 2 to 4 (so as to permit changes to meeting days and dates) and Standing Orders 63 to 64 (so as to accord with current legislation). Resolved the permanent variation of Standing Orders 2, 3, 4, 63 and 64 be adjourned without discussion to the next ordinary meeting of the Council.

127/14            REPORTS FROM OUTSIDE BODIES

The following were RECEIVED:

127/14.1         CAP Group – Cllr. Gething reported on the meeting of 29/7/14 – it had been noted from the various police reports that the police were not involved in any youth or community work in the area. The Chairman (Mike Morley) is leaving the area soon and a new chairman will be required. Next meeting 2/12/2014.

127/14.2         Road Liaison Committee – no report, next meeting 25/9/2014.

127/14.3         NYMNP Coastal Area Forum – Nobody had been able to attend the meeting on 23/7/14. Next meeting 25/2/15 at Hawsker.

127/14.4         North Yorkshire and Cleveland Coastal Forum – no report, next meeting 17/9/14.

127/14.5         Yorkshire Local Councils’ Association – no report, next meeting 6/10/14

127/14.6         Twinning Association – Cllr. Mrs Snow reported a Social Evening was to be held on 1st October at the Yew Tree Cafe – tickets were £10. The association had asked if they could borrow some of the Pornic pictures held by the Parish Council and loan them out for a short time to raffle winners. Councillors were not keen on this idea. Next year’s visit to Pornic would be over the weekend of 20/21st June. The next SANTA meeting would be on 21/10/14.

127/14.7         Yorkshire Coast & Moors County Area Committee – no report, next meeting 8/10/14.

127/14.8         North York Moors National Park Authority – on Cllr. Thompson’s behalf the Clerk reported Cllr. Thompson had attended various meetings including a site visit for the planning application at Ox Pasture Hall.

127/14.9         CPRE – last meeting 12/8/14 but no report available due to Cllr. Mrs Kendall’s absence.

127/14.10      Any other reports not previously notified – None.

128/14            CIRCULATION – None.

There being no further business on the agenda, the Chairman declared the meeting closed at 8.39pm.
