MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held virtually on the Zoom platform, on Wednesday, 10th February 2021 at 7pm
PRESENT: Councillor R Towse (Chairman), Cllrs. S Barnes, DJ Bastiman (left 8.20pm), S Foote (by phone), P Harriott, R Holliday (by phone), D Langmead, D Sutton, R Thompson.
ALSO IN ATTENDANCE: Borough Cllr. Sharma (left 8.01pm), Rev. Tony Hand, T Squire (St. Laurence’s, left 8.17pm), 1 member of public, Mrs J Marley (Clerk).
ABSENT: Cllrs. E Black, D Wiles.
The meeting was called to order at 7.03pm.

143/20 DECLARATIONS OF INTEREST: None.
144/20 MINUTES
144/20.1 Having been previously circulated, the minutes of the Council Meeting held on 13th January 2021 were approved as a correct record and Cllr. Towse was authorised to sign them.
PROCEDURAL MATTER At 7.07pm, Standing Orders were suspended to allow the Public Open Forum.
145/20 PUBLIC OPEN FORUM No matters raised.

146/20 MATTERS RAISED IN PUBLIC OPEN FORUM None.
147/20 EXTERNAL REPORTS
147/20.1 Police:- The reports for Scalby (emailed to councillors 3/2/21) and Newby (emailed to councillors 7/2/21) were received & noted.
147/20.2 County Council:- received County Cllr. Bastiman’s report that 1] for 2021/22 NYCC was proposing to increase its council tax by 1.99% and its adult social care precept by 1.5%; 2] NYCC and PFCC elections were due to be held 6th May; 3] government’s response to the submitted devolution bids was expected this month (an 8 week consultation period would then follow); 4] Corporate & Partnerships Scrutiny Committee had recommended to full Council that the release of Chinese lanterns and helium balloons from NYCC owned/controlled land be banned.
147/20.3 Borough Council:- Borough Cllr. Sharma thanked the Parish Council for its efforts in getting the streetlight column on Newlands Park Crescent [Minute 108/20.3 refers] repaired and the moss removed from the pavement at The Uplands [Minute 121/20.3 refers]. He reported SBC was proposing to freeze its council tax for 2021/22.
148/20 UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS
148/20.1 Clerk reported various potholes, blocked gullies and flooding had been reported to Area 3 Highways since the last meeting. Ponding on Scalby Road outside 1 Throxenby Lane had been swept and filled with tarmac. Illegible street nameplates on Coldyhill Lane/Green Lane corner had been replaced. A complaint regarding illuminated signs on Newby Farm Road had been passed to SBC Planning for investigation.
148/20.2 Reports from Councillors of any highway & footpath or general matters requiring attention Cllr. Barnes highlighted several problems on the High Mill estate and Station Road between the bridge and Burniston Road (photos had been sent to councillors and were viewed on screen). Council noted that as building was ongoing at High Mill the roads had not yet been adopted by NYCC and therefore remediation of highway problems on the estate was for the developers. Clerk thought that NYCC did informally monitor unadopted highways on developments under construction so Clerk to contact NYCC and request involvement. Issues with standing water on the highway impacted the bus stop and users of the track to the farm – believed there may be some works re. this in the 2022/23 Highways budget, if not then to request resurfacing be included in that budget, Clerk to make enquiries. Clerk also to contact the S106 officer at SBC Planning to find out if there was a commuted sum for highways works.
149/20 CORRESPONDENCE
149/20.1 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency – email of resignation from the Parish Council dated 4th February 2021 was received and noted. Further noted that as a result of Cllr. Fieldhouse’s resignation the Clerk had informed SBC Electoral Services and posted the initial Notice of Casual Vacancy to noticeboards on the 5th February 2021.
150/20 FINANCIAL MATTERS
150/20.1 Resolved the Schedule of Accounts Payable for February 2021 (Sch 11, £13,049.35) [emailed to councillors 10/2/21] be approved. Cllrs. Langmead and Towse to do the online authorisations within 24 hours.
150/20.2 JJ Burchell Bequest gilts [Minute 123/20.2 refers] – noted these are now held in the Parish Council’s name.
150/20.3 AJ1 fund and VAS signs [Minute 137/20.3 refers] – noted 1] the Chairman has signed the VAS Installation Agreement with NYCC; 2] the purchase order has been placed (the invoice for having been approved at Minute 150/20.1).
150/20.4 Community Hub and Premises – The Clerk gave an update, which was noted and included 1] the Building Regs. application was now in hand with R. Green; 2] in order to provide security now and in the future an extension of Council’s existing cctv contract was necessary (new equipment to cater for the current and some of our future requirements would cost £565) and it was agreed this work should be done; 3] prices for repairing and painting the railings at the front of the property were awaited; 4] a possible problem had arisen which required specialist legal advice and it was agreed this should be obtained – Council also agreed that should any forms of authority need signature so the Clerk could speak the legal people on behalf of Council these were authorised for signature; 5] there had been problems with customers of the dental practice parking on Council land or bothering our tenants – changing the property address to Newby Farm Road would prevent much of this, Clerk had investigated – and reported to dental practice – that this was a simple process which could be done online at a minimal cost; 6] an email from the dental practice had suggested they erect signs on our side of their fence – the image of the proposed sign was shown to those present and it was agreed Council did not wish to accede to the request.

150/20.5 Community Engagement [Minute 137/20.5 refers] – noted interviews to take place week beginning 15th February on zoom, panel to comprise Chairman, Cllr. Holliday, Cllr. Wiles & T Boden. Agreed Cllr. Towse be authorised to appoint the candidate selected by panel.
Cllr. Bastiman left the meeting at this point.
151/20 PLANNING APPLICATIONS NOTIFIED
Comments on the following applications received & appeals notified [circulated with agenda] were agreed:-
- 20/02822/FLA Vary condition 1 of 19/00474/HS so as to remove the sun room at 36 Lady Edith’s Avenue Newby – agreed no objections;
- 20/02837/HS Remove flat roof, replace with pitched roof, erect part two storey/single storey extension following demolition of existing store, replace all windows and doors at 50 High Street, Scalby – agreed no objections, as property in an important part of Scalby village request every attempt made to create a high quality building which blended in with the existing building and the surroundings;
- 21/00079/FL Change of use of ground floor from C3 (residential) to Use Class E (music recording studio), first floor to retain C3 use at 487 Scalby Road, Scalby – agreed no objections;
- NYM/21/0052/FL Change of use of land to form manege (revised scheme to NYM/2020/0352/FL) Beacon Cottage Farm, Beacon Brow Road, Scalby – agreed no objections.

- 20/01866/FLA Amendment to decision reference 18/01587/FL to provide extension of South-West elevation at second floors level to allow the reconfiguration and enlargement of 2no. apartments at 454 Scalby Road, Scalby. Granted.
- 20/02459/FL Erect 2 no. 2.4 metre high fences at Cross Lane Hospital, Cross Lane, Newby. Granted with conditions.
- 20/02492/HS Erect two storey side extension and single storey rear extension, 73 Cross Lane. Granted with conditions.

153/20 PLANNING MATTERS RECEIVED AFTER 2/2/2021 – Comments on the following applications received [notified after distribution of agenda, to members on email] were agreed
- 20/02774/HS Erect first floor side extension with side facing Juliet balcony over existing garage and erect single storey rear extension following demolition of existing conservatory/utility at 43 Newlands Park Grove Newby – agreed no objections.
154/20 REPORTS FROM OUTSIDE BODIES
154/20.1 YLCA:- The Chairman reported on the Scarborough Branch meeting held on zoom which had included a presentation on climate change by Friends of the Earth. He reminded all members to attend the special branch meeting tomorrow night when a presentation was to be given on the proposed changes at Scarborough Hospital as proposed by York NHS Trust.
There being no further business, the Chairman declared the meeting closed at 8.29pm.
