MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Rickinson Hall, St. Laurence’s Church Rooms, Scalby,
on Wednesday, 10th April 2019 at 7pm.

2 members of public (left 7.22pm), Mrs J Marley (Clerk).

ABSENT: Cllrs. D Bastiman, TW Miller, R Pickersgill, PC Snow, D Wiles, County Cllr. A Backhouse, Borough Cllrs. L Backhouse, V Inman, A Jenkinson, H Lynskey.

The Chairman reminded those present that filming, photographing or audio recording of the proceedings was allowed – persons wishing to record were asked to notify the Clerk of their intention prior to the start of the meeting. In the interests of encouraging public participation, it was requested that anyone filming did not include members of the public “in shot”.

49/19 APOLOGIES FOR ABSENCE Received & accepted from Cllrs. D Bastiman, TW Miller and R Pickersgill (prior commitments), PC Snow (unwell).

50/19 DECLARATIONS OF INTEREST – None.

51/19 MINUTES
51/19.1 The minutes of the Council Meeting held on 13th March 2019 [circulated with agenda] were approved as a correct record and signed by the Chairman.

PROCEDURAL MATTER Standing Orders suspended at 7.02pm for the public open forum.

52/19 PUBLIC OPEN FORUM Two matters raised. 1] The cutting back of the trees and hedges on the road through Forge Valley to East Ayton & the way in which it had been hacked back without any consideration for wildlife. 2] A decision on planning application 19/00109/FL was to be made at the Borough Council’s Planning Committee on 11th April. It had come to light that NYCC Highways had submitted comments which would result in the removal of up to another six mature trees in order to accommodate a new footway to Throxenby Lane from the proposed development on Lady Edith’s Drive.

PROCEDURAL MATTER – At 7.12pm, Standing Orders were resumed.

53/19 MATTERS RAISED IN PUBLIC OPEN FORUM Agreed Clerk to write to 1] Borough Council, (copy to East Ayton Parish Council) expressing Council’s concerns over the work carried out on the trees and 2] SBC Planning regarding the further loss of mature trees.

At this point (7.22pm) the members of public left the meeting.

54/19 POLICE REPORT
Written reports for Newby and Scalby [tabled at meeting] were received & noted.

55/19 EXTERNAL REPORTS

55/19.1 County Council:- No report to receive.

55/19.2 Borough Council:- No report to receive.

55/19.3 In Bloom:- Cllrs. Martin & Sutton reported they understood the group had now elected a Chairman (Bob Kendall) and Treasurer (Gill Kendall) who would also be jointly carrying out the role of Secretary.

56/19 UPDATES & COUNCILLOR’S REPORTS

56/19.1 Received & noted update [circulated with agenda] from Clerk on highway, footpath and other general matters since last meeting.

56/19.2 Councillors reported 1] potholes on Scalby Beck Road (to pass to Highways); 2] cover hanging off column 5 on Scalby High Street (to pass to Highways); 3] possible unauthorised siting of stable block on field adjacent Hay Lane (to pass to NYMNP Planning).

57/19 CORRESPONDENCE

57/19.1 Unauthorised development at 501 Scalby Road [Minute 41/19.1 refers] – received SBC Planning officer’s reply [circulated with agenda]. Councillors appalled that no action other than inviting the occupier to submit an application was to be taken Agreed response unacceptable and Council wished to take issue with the decision in the strongest possible terms. Clerk to reply outlining points of concern (law, proximity to conservation area and listed buildings, setting of precedent, invitation to submit an application to regularise the situation amounted to predetermination).

57/19.2 From SBC re. street name for the development on the site of the old rugby club [circulated with agenda] – suggested names received and agreed Old Rugby Way was preferred to Old Rugby Ground Way.

57/19.3 Correspondence received after preparation of the agenda which the Chairman of the meeting deems it necessary to consider as a matter of urgency:- Chairman reported 1] there would not be any elections on 2nd May for parish councillors to represent Newby & Scalby Parish Council – the number of nominees had not exceeded the number of seats and so an uncontested result had been declared; 2] the Internal Auditor had carried out the annual audit earlier in the week and commented that as Cllr. Miller had not been re-elected he should no longer be a signatory on any accounts/investments. Clerk reported the same should apply to Cllr. Martin. Agreed Cllr. Miller be removed as signatory on investments at the Skipton Building Society and Cllr. Wiles be added in his place, signatories to be any two of the three. Clerk to make necessary arrangements. In respect of the bank account signatories, this would be considered at agenda item 10.2.

58/19 FINANCIAL MATTERS

58/19.1 Resolved the Schedule of Accounts payable for April 2019 (Schedule 1, £3,904-63) be approved. Cllrs. Edmunds & Holliday to do the online authorisations on the Unity Trust accounts within 24 hours. Cheque signed by Cllrs. Edmunds & Thompson.

58/19.2 Cancellation of the temporary changes to Council’s banking mandate [Minute 17/19 refers]. Agreed Mr McGuinn be removed with immediate effect. Further agreed Cllrs. Martin and Miller also be removed since they ceased to be parish councillors from 7th May 2019. [Minute 60/19.3 refers]. Relevant form signed at meeting by Cllrs. Black and Wiles, Clerk to pass to bankers.

58/19.3 Increase of automatic enrolment pension contributions – noted the minimum contributions increased from 6/4/2019 (employer’s rose from 3.75% to 4% and employee’s rose from 4.25% to 5%).

58/19.4 Loan to Scalby Sports Association [Minutes 126/18.2 and 11/19.3 refer] – noted the funds were transferred to the Association’s bank account on 27th March 2019.
