Minutes Council Meeting 12th January 2022

MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 12th January 2022 at 7pm.

PRESENT: Councillor R Towse (Chairman), Cllrs. D Bastiman, P Harriott, R Holliday, D Langmead, D Sutton, R Thompson.

ALSO IN ATTENDANCE: Borough Cllr. Sharma (left 7.31pm), Police 9780 Whaley (left 7.20pm), 1 member of public (left 7.17pm), Rev. Hand (7.03pm-8.22pm),

Helen King (Head of Hub & Community Support), Mrs J Marley (Clerk to Council)

ABSENT:       Cllrs. S Barnes, S Foote, D Wiles.

Prior to the start of the meeting it was announced that Colin Lomas (a previous Chairman and member of Council) had died.

102/21             APOLOGIES FOR ABSENCE  The following apologies for absence were accepted and the reasons for absence were approved:- Cllr. Barnes (personal commitment), Cllr. Foote (Covid safety),Cllr. Wiles (Covid isolating).

103/21             DECLARATIONS OF INTEREST: Received from Cllr Bastiman (agenda items 10-12 inclusive as he was a substitute member of SBC’s Planning Committee).

104/21             MINUTES

104/21.1          Having been previously circulated, the minutes of the Council Meeting held on 8th December 2021 were approved as a correct record and authorised for signature by Cllr. Towse.

PROCEDURAL MATTER Suspension of Standing Orders at 7.03pm to allow Public Open Forum.

105/21             PUBLIC OPEN FORUM Items raised included 1] concerns regarding Scalby Village Trust’s letter of objection to the field on the North Street/Barmoor Lane corner being considered for addition to the Local Plan as suitable for housing and the response received from the Parish Council [Minute 94/21.6.1 refers]; 2] concerns regarding parking around Newby School.

PROCEDURAL MATTER Standing Orders were resumed at 7.09pm.

106/21             MATTERS RAISED IN PUBLIC OPEN FORUM Chairman explained the Council had considered the housing issue at its November meeting and sent a letter of objection. The letter from the Village Trust had been sent to the Parish Council for information; any problems with the content of the Village Trust’s letter should be addressed to the Trust. Parking around schools was an ongoing problem which both the Parish Council and the Police were trying to sort with the assistance of the Borough Council’s Parking Enforcement Officers.

At this point (7.17pm) the member of public left the meeting.

107/21             EXTERNAL REPORTS

107/21.1          Police:- The reports for December (emailed to councillors) were received & noted. Work continued to be done regarding parking around schools.

At this point (7.20pm) the Police left the meeting.

108/21.2          County Council:- County Cllr. Bastiman reported 1] Covid figures in North Yorkshire had risen in North Yorkshire due to the Omicron variant; 2] Omicron was causing staffing problems at County level due to the high number of staff isolating; 3] work progressed on the Local Government Review and devolution; 4] there had been no more cases of Avian ‘Flu in North Yorkshire although the outbreak had resulted in over 450,000 birds being culled early-mid December.

108/21.3          Borough Council:-  Borough Cllr. Sharma reported things had been quiet over Christmas. The Argos planning application had been refused but the one for a town square had been approved. He also asked a question of County Cllr. Bastiman in respect of NYCC Trading standards.

At this point (7.31pm) Cllr. Sharma left the meeting.

109/21             UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS

109/21.1          Update by Chairman and Clerk on matters dealt with under delegated powers – a 3 year deal for gas and electricity had been entered into (while more than currently being paid, the existing contract was soon to end and increases in excess of 50% were being predicted for gas and electric prices; the new contract minimised the increase and protected council in the longer term).

109/21.2          A written report by Helen King was tabled at the meeting and received & noted. She also gave further information in response to councillor’s questions.

109/21.3          Reports from Councillors of any highway & footpath or general matters requiring attention – Cllr. Thompson reported 1] potholes near the Hirstead Road/Coldyhill Lane junction and on Cross Lane near the mini roundabout; 2] ponding at the traffic lights Coldyhill Lane side of the junction with Scalby Road.

110/21             CORRESPONDENCE

110/21.1          Received & noted additional information on application NYM/2021/0924/FL [Minute 98/21.1 refers] and agreed Council’s original objections stand without change.

110/21.2          Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:– none.

111/21             FINANCE, REGULATORY & GENERAL MATTERS

111/21.1          Resolved the Schedule of Accounts Payable for January 2022 (Sch 10, £4546-97) be approved. Cllrs. Langmead and Thompson to do the online authorisations within 24 hours. Cheque signed by Cllrs. Bastiman & Thompson.

111/21.2          Christmas Lights Competition 2021 – noted results would be published and vouchers sent to all winners by 19th January 2022.

111/21.3          Devolution – councillors were asked for their suggestions on what opportunities/functions etc this Council would like to take on from the new unitary authority. It was agreed a provisional list would include all the items currently undertaken via the Model Agreement plus litter picking, the parish caretaker and (via the community hub) befriending, community support and volunteer co-ordinating.

At this point (8.22pm) the Rev. Hand left the meeting.

111/21.4          2022/23 budget and precept calculations received and resolved the 2022/23 budget be approved. The agenda showed a recommended precept of £96,025 – this had been changed since the wrong base figures had been provided by SBC. The RFO’s amended report [tabled at the meeting] recommending the precept was increased to £91,710 was noted and resolved the 2022/23 precept be set at £91,710.

111/21.5          In order to enable bills etc to be paid if Council was unable to hold virtual meetings or face to face meetings, the Clerk/RFO recommended that Council 1] suspended Financial Regulation 3.5 for a period to be agreed (not in excess of 12 months) and 2] for the same period varied Financial Regulation 19.2 FROM “19.2 With the agreement of the Chairman or Vice Chairman of Council, urgent expenditure exceeding £500 which is specifically for the purpose of ensuring Council meets its legal or contractual obligations” TO “19.2 With the agreement of the Chairman or Vice Chairman of Council, expenditure exceeding £500”. It was agreed to 1] suspend Financial Regulation 3.5 with immediate effect for a period of 12 months and 2] for the same period, to vary Financial Regulation 19.2 to read “With the agreement of the Chairman or Vice Chairman of the Council, expenditure exceeding £500”.

111/21.6          Noted Environment Locality grants [Minute 101/21.2 refers] totalling £2,000 had been awarded via some of the Borough Councillors for Newby Ward and for Scalby Ward.

112/21             PLANNING APPLICATIONS & APPEALS NOTIFIED

Comments on the following applications received & appeals notified [circulated with agenda] were agreed:-

  1. 21/02127/HS Change window to patio doors with balcony, 8 Wynbrook Court, North St, Scalby. No objections.
  2. 21/02268/HS Erect single storey extension to front and render all elevations, 13 Tibby Butts, Scalby. No objections.
  3. 21/02438/HS Install dormer windows to front and rear, 140 Moor Lane, Newby. No objections.
  4. 21/02502/FL Convert, extend and alter garage wing to form 4no. guest rooms, billiard room and plant room, Wrea Head Hotel, Barmoor Lane, Scalby. No objections.

113/21             PLANNING DECISIONS – The following were noted:-

  1. 21/01579/FL Construct 2no. padel courts and extension to café bar, Scarborough RUFC, 569 Scalby Rd, Scalby. Granted with conditions.
  2. 21/01701/HS Loft conversion with front and rear dormers and erect porch, 3 Newlands Avenue, Newby. Granted with conditions.
  3. 21/01830/HS Erect summerhouse, install railings, fence, gates and retrospective roller garage door, First floor flat, 433 Scalby Road, Scalby. Granted with conditions.
  4. 21/01831/LB Install railings, retrospective garage door and internal doors, First floor flat, 433 Scalby Road, Scalby. Granted with conditions.
  5. 21/02272/HS Erect 2m high fence to side and rear, 10 Scalby Beck Road, Scalby. Granted with conditions.
  6. 21/02343/FL Change of use of double garage into holiday accommodation with associated alterations, 94 Station Rd, Scalby. Refused.
  7. 21/02405/HS Erect rear conservatory, 2 Butterbur Lane, Scalby. Granted with conditions.
  8. 21/02519/HS Erect single storey side extension, 27 High Mill Drive, Newby. Granted with conditions.

             PLANNING MATTERS RECEIVED AFTER 5/1/22
– The following was received:-

  1. 21/02712/FLA Vary condition 1 of 19/00108/FL to allow external and layout changes to cottage at 21 Hackness Road, Newby. No objections

115/21             REPORTS FROM OUTSIDE BODIES  None to receive.

116/21             EXCLUSION OF PRESS AND PUBLIC

Resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next item of business on the grounds it related to legal/commercially sensitive/contractual matters.

117/21             VARIOUS ITEMS

117/21.1          Cllr. Towse reported he had discussed with H. King what she felt was needed in order to progress the work of the Community Hub, ensure it had its own identity and, in the medium to long term, work at arm’s length from the parish council. In the short term the hub needed to be under the umbrella of the parish council. Main items suggested in the short term were a dedicated phone line, access to the bank accounts and petty cash. A dedicated noticeboard was also suggested. Agreed 1] Clerk to investigate the options for the phone; 2] Helen King be given “View” access to internet banking; 3] Chairman, Clerk and H .King to consider ways to address the petty cash request; 4] Clerk to investigate noticeboard (it was possible planning consent may be needed).

117/21.2          Purchase of additional land [Minute 101/21.2 refers] – a verbal update by the Chairman was noted :- 1] Heads of Terms had been returned to SBC and we were waiting to hear back from them; 2] a price of £500 plus disbursements in respect of advice and carrying out the legal side of the purchase had been agreed with solicitors Wellers Hedley.

There being no further business, the Chairman declared the meeting closed at 9.03pm.
