MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 8th December 2021 at 7pm.
PRESENT: Councillor R Towse (Chairman), Cllrs. S Foote, P Harriott, R Holliday, R Thompson.
ALSO IN ATTENDANCE: Borough Cllr. Sharma (left 7.45pm), PCSO 4307 Loureiro and PC 47 Holtby (both left 7.15pm), Mrs J Marley (Clerk).
ABSENT: Cllrs. S Barnes, D Bastiman, D Langmead, D Sutton, D Wiles.
87/21 APOLOGIES FOR ABSENCE The following apologies for absence were accepted and the reasons for absence were approved:- Cllrs. Bastiman (family/health), Cllr. Langmead (work), Cllr. Sutton (Covid isolating), Cllr. Wiles (family commitment).
88/21 DECLARATIONS OF INTEREST: None.
89/21 MINUTES
89/21.1 Having been previously circulated, the minutes of the Council Meeting held on 10th November 2021 were approved as a correct record and authorised for signature by Cllr. Towse.
PROCEDURAL MATTER No suspension of Standing Orders as no public present
90/21 PUBLIC OPEN FORUM No matters raised.
PROCEDURAL MATTER No resumption of Standing Orders was necessary.
91/21 MATTERS RAISED IN PUBLIC OPEN FORUM None.
92/21 EXTERNAL REPORTS
92/21.1 Police:- The Scalby report for November (emailed to councillors on 6th December) was received & noted. PCSO Loureiro reported crime in Newby was down. Councillors were very pleased to learn work had been done on parking – Newby & Scalby Primary, St. Peter’s and Barrowcliff schools have all had leaflets and letters highlighting the Police being aware of parking concerns. The SBC Considerate Parking Initiative is to be again used for parking near schools. PCSO O’Reilly’s written report was received & noted.
At this point the Police left the meeting.
92/21.2 County Council:- On the heels of power cuts exceeding 24 hours suffered in nearby parishes after Storm Arwen, Cllr. Thompson asked why the Parish Council couldn’t be more involved with emergency planning in the parish now we had the hub and what could be done – this resulted in a prolonged discussion, the outcome of which was that NYCC held the remit for resilience and emergency planning. As a consequence of the long debate the Clerk had been unable to give the verbal report of information on County matters as requested by County Cllr. Bastiman.
92/21.3 Borough Council:- Borough Cllr. Sharma reported 1] he had submitted a grant request to his SBC Locality Grant allocation and 2] concerns regarding the clearance of the building site at 79 Cross Lane in respect of A] it was believed badgers were resident there and B] some of the adjoining landowners maintained they owned land which the developer was trying to claim as his.
At this point Cllr. Sharma left the meeting.
93/21 UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS
93/21.1 Update by Chairman and Clerk on matters dealt with under delegated powers – 445 Scalby Road – an assured shorthold tenancy had been signed and the property was now occupied.
93/21.2 A written report by Helen King was tabled at the meeting and received & noted.
93/21.3 Reports from Councillors of any highway & footpath or general matters requiring attention – Cllr. Thompson reported potholes on Field Lane between the caravan site bus stop and Coastal Road.
93/21.4 Noted the November 2021 Parish Council Community Newsletter has been distributed to households in the parish.
94/21 CORRESPONDENCE
94/21.1 Casual Vacancy (Newby Ward) – received & noted email 8/12/21 from SBC Elections Office confirming they had not received any requests for an election so the Parish Council could proceed to co-opt to the vacancy.
94/21.2 Received & noted email of 17/11/21 [redacted version circulated with agenda] from parishioner requesting support for a pedestrian refuge island on Burniston Road near the two parts of the North Cliff Golf Club. Agreed request be supported, Clerk to inform Highways.
94/21.3 Received & noted email of 23/11/21 from SBC containing letter from Royal Pilgrim Communications [both circulated with agenda] re. proposed redevelopment of Argos building in Scarborough town centre.
94/21.4 Received & noted email of 26/11/21 [redacted version circulated with agenda] from parishioner regarding Christmas Lights Competition and environmental damage/light pollution. Agreed Chairman to respond.
94/21.5 Received & noted email of 28/11/21 [redacted version circulated with agenda] from parishioner regarding cherry trees on Coldyhill Lane. Agreed Clerk to refer to Highways.
94/21.6 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:–
1] received & noted email from parishioner in respect of their concerns about Scalby Village Trust’s recent communication re. Site 18/04 which has been proposed as a possible site for future development – councillors noted the parishioners concerns;
2] received & noted email from parishioner in respect of their concerns about the state of the Cinder Track – Clerk reported she had referred the matter to Anna Waite at SBC who had responsibility for track maintenance & this action was confirmed by councillors;
3] received & noted email from parishioner disputing the casual vacancy in Newby Ward due to non-attendance for a period in excess of six months [Minutes 79/21.1 and 64/21.1 refer] – Clerk to make SBC Elections Office aware.
95/21 FINANCE, REGULATORY & GENERAL MATTERS
95/21.1 Resolved the Schedule of Accounts Payable for December 2021 (Sch 9, £22,294-76) be approved. Cllrs. Thompson and Towse to do the online authorisations within 24 hours.
95/21.2 Received & noted the Internal Audit report for April-October 2021 [circulated with agenda].
95/21.3 Christmas Lights Competition 2021 – noted 1] all councillors emailed 15/11/21 with judging forms and details of areas to be judged, 2] reminder that judging was to be done 18th to 28th December.
96/21 PLANNING APPLICATIONS & APPEALS NOTIFIED
Comments on the following applications received & appeals notified [circulated with agenda] were agreed:-
- 21/01830/HS Erect summerhouse, install railings, fence gates and retrospective roller garage door, First Floor Flat, 433 Scalby Road, Scalby. No objections.
- 21/02272/HS Erect 2m high fence to side and rear, 10 Scalby Beck Road, Scalby. Object – overbearing impact and out of keeping on an open plan housing development, property is on a corner, so side boundary abuts a highway and appears to be part of the front.
- 21/02519/HS Erect single storey rear extension at 27 High Mill Drive, Newby. No objections.
97/21 PLANNING DECISIONS – The following were noted:-
- 21/02129/HS Hip to gable extension and installation of rear dormer with Juliet balcony at 12 Willow Garth, Newby. Granted with conditions.
- 21/02163/HS Erection of single storey rear extension at 39 Newlands Park Drive, Newby. Granted with conditions.
98/21 PLANNING MATTERS RECEIVED AFTER 29/11/2021 – The following was received:-
- NYM/2021/0924/FL Variation of condition 2 of planning approval NYM/2020/0207/FL so as to allow the summerhouse/office building to be used as temporary residential accommodation for 12 months at South Beck House, Hackness Road, Scalby – agreed object – no demonstrated clear functional need for proposed use.
99/21 REPORTS FROM OUTSIDE BODIES
99/21.1 Cllr. Towse reported he had 1] laid a wreath on behalf of the Parish Council at the Remembrance Day service and 2] attending the installation of the new vicar at Newby St. Mark’s.
100/21 EXCLUSION OF PRESS AND PUBLIC
Resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next item of business on the grounds it related to legal/commercially sensitive/contractual matters.
101/21 VARIOUS ITEMS
101/21.1 Cllr. Towse reported he and H. King were to meet a local business person to discuss a possible joint working project.
101/21.2 Purchase of additional land – update by Chairman :- 1] Heads of Terms had been received; 2] the result of grants applied for was awaited.
There being no further business, the Chairman declared the meeting closed at 9.00pm.
