MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 13th October 2021 at 7pm.
PRESENT: Councillor R Thompson (Vice Chairman as Chairman of Meeting), Cllrs. D Bastiman (left 8.50pm), S Foote, P Harriott, R Holliday, D Langmead, R Towse (from 8.15pm), D Wiles.
ALSO IN ATTENDANCE: Borough Cllr. Sharma (left 8.07pm), Sgt. T Wilkinson (left 7.49pm), Rev. Tony Hand (left 8.07pm), 3 people for allotment prize presentation (left 7.05pm), 10 members of public (9 left at 7.45pm, 1 left 8.07pm), Mrs J Marley (Clerk), Helen King Community Support Co-Ordinator (left 8.15pm).
ABSENT: Cllrs. S Barnes, D Sutton.
PRESENTATION OF ALLOTMENT PRIZES
Prizes were announced and presented by Cllr. Thompson as follows:-
Best Allotment – Ray Wright (plots 25 and 33 South), shield and £25.
Most Improved allotment – Lyn Sadler (plot 9 East), £25.
Largest Marrow – weighed in at 83.8 lbs. and grown by Pete Francis (plot 42), £25. Pete died in August 2021 and his marrow was entered posthumously by his god daughter Sally who has taken over the tenancy of plot 42.
At this point the allotment prizewinners left the meeting.
55/21 APOLOGIES FOR ABSENCE The following apologies for absence were accepted and the reasons for absence were approved:- Cllr. Sutton (Covid isolating).
56/21 DECLARATIONS OF INTEREST: Received from 1] Cllr Bastiman (registerable interest in agenda items 10-12 inclusive as he was a substitute member of SBC’s Planning Committee; 2] Cllrs. Foote and Thompson (registerable interest in agenda item 8.2) as they were Trustees of Newby & Scalby Community Hall.
57/21 MINUTES
57/21.1 Having been previously circulated, the minutes of the Council Meeting held on 5th September 2021 were approved as a correct record and Cllr. Thompson was authorised to sign them.
PROCEDURAL MATTER At 7.09pm, Standing Orders were suspended to allow the Public Open Forum.
58/21 PUBLIC OPEN FORUM Two matters were raised. 1] the general lack of public litter bins for dog poo in the parish. 2] the planning application at Danes Dyke for a women’s refuge. Several residents of Danes Dyke expressed their concerns about the proposed development such as the narrow highway access, lack of alternative access, the inappropriate location (site at the end of an area which was a sheltered housing community for the elderly), lack of evidence proving this was the only suitable location for such a development, local schools were already over-subscribed, impact on resident’s health impact, lack of 365/24/7 staffing, publicity meant the location of the refuge was already widely known. The need for a development of this nature was acknowledged but it needed to be in a more appropriate location.
PROCEDURAL MATTER At 7.31pm, Standing Orders were resumed.
59/21 MATTERS RAISED IN PUBLIC OPEN FORUM 1] Dog poo could be placed in all public litter bins – there was a cost to providing and servicing litter bins and the Borough Council were trying to locate bins at the most effective places. 2] All comments would be taken into account when the application was considered.
60/21 PROCEDURAL MATTER Chairman suggested, and it was agreed that agenda item 12.1 be brought forward and considered as the next item.
61/21 PLANNING APPLICATION 21/02251/RG4 Erect 10 no. self contained units of accommodation and support services for women and children at land east Of 75 And 87 Danes Dyke Scalby [agenda item 12.1]. [In accordance with his Declaration of Interest at Minute 56/21 Cllr. Bastiman did not vote on this item]. When considering this application Councillors took into account the submissions made during the Public Open Forum. While it was acknowledged there may be a need for the proposed facilities, it was felt the proposed location was totally inappropriate and unsuitable. Council agreed to object to the application on the grounds it was contrary to several Adopted Local Plan policies including policies DEC 1, DEC 4 and INF 4.
At this point 9 members of public left the meeting.
62/21 EXTERNAL REPORTS
62/21.1 Police:- The Scalby report for September had been circulated with the agenda and was received & noted. Sgt. Wilkinson introduced himself as the new sergeant for the team which policed the Newby area – he hoped to be able to re-start reports for Newby in the not too distant future.
62/21.2 County Council:- received County Cllr. Bastiman’s report 1] Trading Standards had recently prosecuted some rogue builders – they had been given jail sentences; 2] Covid figures in North Yorkshire were still very high; 3] meetings to progress the devolution and unitary authority continued to progress.
62/21.3 Borough Council:- Borough Cllr. Sharma reported 1] concerns regarding East Yorkshire motor Services withdrawing bus services from Moor Lane; 2] water outside 91 Moor Lane which both NYCC and Yorkshire Water said was not their responsibility and 3] speed of traffic on Endcliff Crescent.
At this point Rev. Hand, Cllr. Sharma and the final member of public left the meeting.
63/21 UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS
63/21.1 Clerk reported 1] a water meter had now been fitted for 445b Scalby Road and 2] a new 3 year long term agreement with a slightly reduced premium had been made with Council’s insurers.
63/21.2 Helen King reported regular bookings for the hub were now coming in as were requests for bereavement support and “walk and talk”. Loneliness seemed to be the common denominator behind many of the issues people were facing She had now begun to look at grant funding in the longer term for the hub and its projects.
63/21.3 Reports from Councillors of any highway & footpath or general matters requiring attention – Cllr. Langmead report that he had resigned from the position of governor at Newby Infants and Junior School was noted. Agreed the Clerk to contact the school and establish if a replacement is required.

64/21 CORRESPONDENCE
64/21.1 Casual Vacancy (Newby Ward) – noted the Clerk had sent a letter to Cllr. Black on 14th September informing her that she was no longer a councillor as she had failed to attend a Council meeting for six consecutive months (last attendance 10/3/21) or had her reasons for non-attendance accepted by Council. An email had been received earlier that day from Mrs Black disputing the date of last attendance and in view of this Council deferred declaring a casual vacancy. Agreed Clerk to respond to the email and report to next meeting.
64/21.2 Letter [redacted, circulated with agenda] from parishioner re. enhancing the Community Hall – agreed letter be received; if a formal approach was made by the Trustees to Newby and Community Hall Trust then it would be considered
64/21.3 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency – noted Clerk’s report that several parishioners had rung or emailed regarding East Yorkshire Motor Services proposed changes to bus routes in the parish. She also reported that the other company which ran a bus service up Moor Lane hoped to increase the frequency of their services.
65/21 FINANCE, REGULATORY & GENERAL MATTERS
65/21.1 Resolved the payment of £131-19 to Business Stream be rejected (invoice no longer accurate as a water meter had been installed). Further resolved the remaining items on the Schedule of Accounts Payable for October 2021 (Sch 7, £11,3852.40) be approved. Cllrs. Langmead and Thompson to do the online authorisations within 24 hours. The cheque was signed by Cllrs. Bastiman and Thompson.
65/21.2 Community Hub – noted 1] VAT Partial Exemption (7 year calculation) indicated de-minimus limit not breached; 2] an application to register for VAT has been submitted.
65/21.3 Request for sponsorship/financial assistance for Scarborough gymnasts in GB Team – [details circulated with agenda] – agreed to provide sponsorship of £390 for the team tracksuits.
65/21.4 Staffing – [Minute 54/21.1 refers] noted on the advice of the YLCA a feasibility study had been undertaken in respect of creating a new contract as a variation of the original terms and conditions of employment. Agreed to formally vary the terms and conditions of the Community Support Co-Ordinator post with effect from 1st September 2021 such that the post is forthwith known as Head of Hub and Community Support Services (20 hours/week on SCP24, 1 year contract to be reviewed after 6 months).
At this point Cllr. Bastiman left the meeting.
66/21 PLANNING APPLICATIONS & APPEALS NOTIFIED
Comments on the following applications received & appeals notified [circulated with agenda] were agreed:-
- 21/01701/HS Proposed loft conversion with front and rear dormers and erect porch, 3 Newlands Avenue. No objections.
- 21/02163/HS Erect single storey rear extension, 39 Newlands Park Drive, Newby. No objections.
67/21 PLANNING DECISIONS – The following were noted:-

69/21 REPORTS FROM OUTSIDE BODIES
69/21.1 YLCA:- Cllr. Towse reported on the Scarborough Branch meeting where items discussed had included devolution and the forthcoming arrangements for town and parish council.
70/21 EXCLUSION OF PRESS AND PUBLIC
Resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next item of business on the grounds it related to contractual matters.
71/21 445 SCALBY ROAD TENANCY
71/21.1 Noted Clerk’s report that the current tenants were leaving and it was hoped to have the property re-let by the middle of November.
There being no further business, the Chairman declared the meeting closed at 9.04pm.
