MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 10th November 2021 at 7pm.
PRESENT: Councillor R Towse (Chairman), Cllrs. S Foote, P Harriott, R Holliday, D Langmead, R Thompson.
ALSO IN ATTENDANCE: Borough Cllr. Sharma (left 7.20pm), PCSO 3677 O’Reilly and PCSO 4307 Loureiro (both left 7.13pm), Mrs J Marley (Clerk).
ABSENT: Cllrs. S Barnes, D Bastiman, D Sutton, D Wiles.
72/21 APOLOGIES FOR ABSENCE The following apologies for absence were accepted and the reasons for absence were approved:- Cllrs. Barnes and Bastiman (prior commitments), Cllr. Sutton (holiday), Cllr. Wiles (work).
73/21 DECLARATIONS OF INTEREST: None.
74/21 MINUTES
74/21.1 Having been previously circulated, Minute 64/21.2 was amended from “Newby and Community Hall Trust” to “Newby and Scalby Community Hall Trust”. The amended minutes of the Council Meeting held on 13th October 2021 were approved as a correct record and authorised for signature by Cllr. Towse.
PROCEDURAL MATTER No suspension of Standing Orders as no public present
75/21 PUBLIC OPEN FORUM No matters raised.
PROCEDURAL MATTER No resumption of Standing Orders was necessary.
76/21 MATTERS RAISED IN PUBLIC OPEN FORUM None.
77/21 EXTERNAL REPORTS
77/21.1 Police:- The Scalby and Newby reports for October (emailed to councillors on 7th and 8th November) were received & noted. Parking near schools was again becoming a problem and PCSO O’Reilly was to see if SBC’s Considerate Parking Initiative could be resurrected.
At this point both PCSO’s left the meeting.
77/21.2 County Council:- no report to receive.
77/21.3 Borough Council:- Borough Cllr. Sharma reported 1] concerns regarding trees/hedges projecting into the road on the stretch of Lady Edith’s Drive from Throxenby Lane to the junction with Scalby Road. He confirmed he had received the Chairman’s request to all five SBC ward councillors for a contribution from their locality grant allocation but was awaiting advice as to whether the request came within the terms of the grant.
At this point Cllr. Sharma left the meeting.
78/21 UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS
78/21.1 Update by Chairman and Clerk on matters dealt with under delegated powers – no items to receive.
78/21.2 A written report by Helen King was tabled at the meeting and received & noted.
78/21.3 Reports from Councillors of any highway & footpath or general matters requiring attention – Cllr. Towse reported on an exchange of correspondence with Robert Goodwill MP who had suggested Newby and Scalby Parish Council should consider joining with Scarborough Town in the forthcoming devolution re-organisation as it would be of benefit to the parish. Cllr. Towse had taken issue with this and Council supported his stance.
79/21 CORRESPONDENCE
79/21.1 Casual Vacancy (Newby Ward) – noted an email had been received earlier that day from Mrs Black in response to the letter of 14th October from Council. Agreed 1] a casual vacancy in Newby Ward be declared; 2] all correspondence be forwarded to Elections Officer, SBC for information.
79/21.2 Received & noted letter from developers re. views on upgrading telecoms mast near The Rosette to one capable of giving 5G coverage – agreed no objections to the principle of replacing the current mast with one which is capable of 5G.
79/21.3 Noted two new sites (details emailed to councillors 22/10/21) had been submitted for inclusion on the Local Plan list of potential development sites. Agreed strongly object to both site 18/03, north of Field Lane, Scalby and site 18/04, west of North Street and south of Barmoor Lane, Scalby.
79/21.4 Northstead School (tabled by Cllr. Barnes) – noted the school was inviting applications from persons interested in becoming a governor, contact details are held by the Clerk to the Parish Council.
79/21.5 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency – received & noted email from parishioner objecting to proposal to include the field at the corner of North Street/Barmoor Lane into the housing allocation. Agreed this site had already been discussed (see Minute 80/21.3), Clerk to copy its objections to the parishioner for information.
80/21 FINANCE, REGULATORY & GENERAL MATTERS
80/21.1 Resolved the Schedule of Accounts Payable for November 2021 (Sch 8, £124,892.43) be approved. Cllrs. Langmead and Towse to do the online authorisations within 24 hours. The cheque was signed by Cllrs. Holliday and Thompson.
80/21.2 Community Engagement – noted 1] the contract with T. Boden comes to an end on 3/12/21, 2] it is understood she is happy to work with Council in the future on an ad hoc basis. Agreed contract not be renewed, future work to be done on an ad hoc basis.
80/21.3 Christmas Lights Competition 2021 – agreed 1] councillors to more clockwise one judging zone, 2] judging to be done 18th to 28th December. Clerk to send out necessary paperwork.
81/21 PLANNING APPLICATIONS & APPEALS NOTIFIED
Comments on the following applications received & appeals notified [circulated with agenda] were agreed:-
- 21/02129/HS Hip to gable extension and installation of rear dormer with Juliet balcony, 12 Willow Garth, Newby. No objections.
- 21/02405/HS Erect rear conservatory, 2 Butterbur Lane, Scalby. No objections.
82/21 PLANNING DECISIONS – The following were noted:-
- 19/00505/FLA Variation of Condition 1 relating to application reference 17/01241/FL dated 11.2017 for demolition of three dwellings and erection of a 60 room Residential Care Home to allow part retrospective alterations to the approved drawings at 75 Burniston Road Newby. Disposed of.
- 21/02019/HS Erection of single storey rear extension at 15 East Avenue Scalby. Granted with conditions.
- 21/02031/HS Erection of a single storey rear extension following removal of existing conservatory and extension to existing decking at 29 Lady Edith’s Avenue Newby. Granted with conditions.
83/21 PLANNING MATTERS RECEIVED AFTER 2/11/2021 – The following were received:-
- 21/01831/LB Install railings, retrospective garage door, internal doors, 433 Scalby Road, Scalby – agreed no objections.
- 21/02343/FL Change of use double garage to holiday accommodation with associated alterations, 94 Station Road, Scalby – agreed object (Policy DEC 4, loss of privacy, intrusive, unacceptable impact on residential amenity).
84/21 REPORTS FROM OUTSIDE BODIES
84/21.1 NYMNP Coastal Forum:- Cllr. Thompson reported on the meeting held at Loftus where items raised had included the replacement of Bilsdale television mast and the North Yorkshire Rural Commission’s report to the County Council.
85/21 EXCLUSION OF PRESS AND PUBLIC
Resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next item of business on the grounds it related to legal/commercially sensitive/contractual matters.
86/21 445 SCALBY ROAD
86/21.1 Tenancy – Noted several prospective tenants had viewed the property and a shortlist for interview had been made.
86/21.2 An enquiry had been received as to whether Council wished to sell the property. Agreed this did not accord with Council’s current plans.
86/21.3 Purchase of additional land – having agreed a maximum sum for the purchase (excluding legal fees etc) Council authorised the Chairman and Clerk to continue negotiations on its behalf.
There being no further business, the Chairman declared the meeting closed at 9.02pm.
