MINUTES OF ANNUAL MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Committee Room, Newby & Scalby Community Hall, Scalby Road, Scalby,
on Wednesday, 9th May 2012 at 7pm.
PRESENT: Councillor TW Miller (Chairman), Councillors D Bastiman (to 8.22pm), Mrs E Black, W Black, S Gething, Mrs G Kendall, Mrs C Snow, A Tyson, BF Watson.
ALSO IN ATTENDANCE: R. Kaye (SBC Liaison), P. Staveley (In Bloom), R Kendall (FONSA), P Afford (Scalby Football Club), M Morley (CAP group) (to 7.45pm), PC Bilton (7.20-7.45pm), Mrs J Marley (Clerk).
ABSENT: County Cllr. Mrs Swiers, County Cllr. Backhouse, Borough Cllrs. Cooper and Jenkinson, Councillors Foote, Pickersgill & Thompson.
PROCEDURAL MATTER In his capacity as retiring Chairman, Councillor T W Miller chaired the meeting until a new Chairman was elected.
49/12 ELECTION OF CHAIRMAN
49/12.1 In accordance with Standing Order 12(B) the Chairman sought any further nominations for Chairman of Council for the Year 2012 to 2013. There were none.
49/12.2 In accordance with Standing Order 12(B) consideration was given to the nominations received prior to the meeting, details of which the Clerk read out.
49/12.3 The nomination received was for Councillor T W Miller. Following a ballot, it was RESOLVED to elect Councillor Miller as Chairman of the Council for the Year 2012 to 2013.
50/12 CHAIRMAN’S DECLARATION OF ACCEPTANCE OF OFFICE
In accordance with Section 83(a) of the 1972 Local Government Act the elected Chairman signed his Declaration of Acceptance of Office which was witnessed by the Clerk as the Proper Officer of the Council.

51/12 APOLOGIES FOR ABSENCE
Received and accepted from County Cllr. Mrs Swiers, County Cllr. Backhouse, Cllr. Foote, Cllr. Pickersgill (all prior commitments), Cllr. Thompson (work).
52/12 ELECTION OF VICE CHAIRMAN
52/12.1 In accordance with Standing Order 12(B) the Chairman sought any further nominations for Vice Chairman of Council for the Year 2012 to 2013. There were none.
52/12.2 In accordance with Standing Order 12(B) consideration was given to the nominations received prior to the meeting, details of which the Clerk read out.
52/12.3 The nominations received were for Councillor Mrs Kendall and Councillor R Pickersgill. Following a ballot, it was RESOLVED to elect Councillor Mrs Kendall as Vice-Chairman of the Council for the Year 2012 to 2013.
53/12 DECLARATIONS OF INTEREST
53/12.1 Councillor Bastiman declared a personal and prejudicial interest in agenda items 18 and 19 as he was SBC Cabinet member & held the Strategic Planning and Regeneration portfolio.
53/12.2 Councillors Mrs Black, W Black, Mrs Kendall and Mrs Snow declared a personal and non-prejudicial interest in agenda items 15.5 and 17 as they were hall trustees.
53/12.3 Councillor BF Watson declared a personal and non-prejudicial interest in agenda item 18 as he was a member of the Borough Council’s Planning & Development Committee.

55/12 MINUTES
55/12.1 RESOLVED the minutes of the Council Meeting held on 11th April 2012 be approved as a correct record and signed by the Chairman;
PROCEDURAL MATTER At 7.26pm, Standing Orders were suspended to allow the Public Open Forum & external reports.
56/12 POLICE REPORT
RESOLVED written report (tabled at meeting) be received. Additional detail given on various items by PC Bilton and information on various minor problems exchanged.
57/12 PUBLIC OPEN FORUM
Mr Morley reported the perennial problem of vehicles parking on the pavement continued unabated and he intended to raise it at the next CAP meeting.
58/12 COUNTY COUNCILLOR’S REPORT None to receive.
59/12 SBC LIAISON OFFICER’S REPORT
NOTED Mr Kaye’s report that consultations on relocating the Town Hall and closing Manor Road nurseries would run till the end of May, with recommendations going to the Cabinet meeting in July. AGREED Chairman, Vice Chairman & Clerk to complete Town Hall accommodation review on behalf of Council
PROCEDURAL MATTER At 7.45pm, Standing Orders were resumed.
60/12 MATTERS RAISED IN PUBLIC OPEN FORUM Pavement parking problems NOTED.
61/12 COUNCILLOR’S REPORTS ON HIGHWAY & FOOTPATH MATTERS
61/12.1 RECEIVED updates from Clerk (circulated with agenda) on previously reported highway and footpath matters;
61/12.2 NOTED various reports of potholes, unlit streetlights & other highway matters RESOLVED Clerk to pass to relevant authority for action. Trees overhanging pavement near Scalby road bridge (Clerk to speak with householder). Cllr. Gething mentioned continuing problems with Scalby School Playing fields fence overhanging path – noted Cllr. Miller was taking this up with County Council (Cllr. Watson asked to be kept informed).

62/12.4 CAP Group – Cllr. Mrs Kendall reported NYCC Highways had never received anything from SBC regarding Parish Council’s comments on highways aspect of proposed High Mill development.

62/12.7 North Yorkshire & Cleveland Coastal Forum – Next meeting September.
62/12.8 Yorkshire Local Councils’ Association – Next meeting 11 June.
62/12.9 Twinning Association – Cllr. Mrs Black reported the finishing touches for this year’s visit in hand were proceeding. She asked why the twinning didn’t include Newby.
62/12.10 York and North Yorkshire Playing Fields – date of next meeting unknown.
62/12.11 Yorkshire Coast & Moors Area Committee – next meeting 4th July.
62/12.12 North York Moors National Park Authority – no report to receive.
62/12.13 CPRE – Cllr. Miller reported N. Yorkshire Branch AGM was 25th May and Coastal Branch AGM was 22nd May.
62/12.14 SBC Transport Forum – (Cllrs Miller & Thompson had not attended this event). Cllr. Black reported various highway issues connected to the forthcoming High Mill development had been raised. Apparently the Parish Council’s concerns and comments on the original planning application had not been made known to NYCC Highways. The Clerk was asked to liaise with the relevant officer at Whitby Highways.
63/12 CORRESPONDENCE
63/12.1 RECEIVED letter of thanks from Boy’s Brigade for Diamond Jubilee donation.
63/12.2 RECEIVED letter of 30/3/12 from SBC [circulated at April meeting] regarding consultation on Futurist and Town Hall Development Brief. RESOLVED no comment to be submitted.
FINANCE & GENERAL PURPOSES ISSUES
64/12 FINANCIAL MATTERS
64/12.1 RESOLVED the 2011/12 Annual Report and Accounts [circulated with agenda] be received & Chairman be authorised to sign.
64/12.2 RESOLVED the Internal Auditor’s report [ circulated with agenda] be received and noted.
64/12.3 2011/12 Annual Return – RESOLVED 1] the Internal Auditor’s unqualified report (Section 4) be noted; 2] the figures at Section 1 be confirmed and the chairman authorised to sign; 3] all the questions in the Governance Statement (Section 2) be answered in the affirmative and Chairman authorised to sign.
64/12.4 Appointment of Internal auditor for 2012/13 – RESOLVED Mr R. Carey be re-appointed.
64/12.5 [In accordance with their Declarations of Interest, Cllrs. Mrs E Black, W. Black, Mrs G Kendall and Mrs C Snow left the room for consideration of this item] Rental agreement for Council offices. NOTED Hall Trustees offering a 3 year rolling licence at £300/month inclusive of cleaning & utilities to commence 1st June 2012. RESOLVED the Chairman and Clerk be authorised to sign the agreement on behalf of Council.
64/12.6 RESOLVED that the Schedule of Accounts for May 2012, Schedule 2 be approved and paid
ENVIRONMENTAL AND DEVELOPMENT ISSUES
65/12 TRAFFIC SPEED
RECEIVED written proposal tabled by Cllr. Thompson “that the 40mph speed limit on Coastal Road be extended to cover Field Lane junction (due to accidents which have happened there in past & imminent High Mill development). It was thought this was already in hand at County level. RESOLVED Clerk to liaise with NYCC Highways traffic officer.
66/12 PARISH HALL – CREATION OF JUBILEE BEDS
Bob Kendall handed out copies of sketch plan of proposed design & planting of central bed. RESOLVED proposals accepted, works to be undertaken this year.
