Minutes Council meeting 9th March 2016

MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Rickinson Hall, St. Laurence’s Church Rooms, Scalby,
on Wednesday, 9th March 2016 at 7pm.

PRESENT: Councillor Towse (Chairman), Cllrs. DJ Bastiman, S Foote, S Gething, Mrs R Holliday, R Pickersgill, Mrs PC Snow, RI Thompson,

ALSO IN ATTENDANCE:  Borough Cllr. L. Backhouse (left 7.20pm), P. Perry Scalby Sports Association (from 7.45pm), P. Staveley (left 8.37pm), 5 members of Scalby Library interim Volunteer Management Team (left 7.20pm), 5 members of public [left at various times], Mrs J Marley (Clerk).

ABSENT:      Cllrs. Mrs E Black, G Edmunds, TW Miller, BF Watson, Mrs D Wiles, Borough Cllrs. V Inman, A Jenkinson and H Lynskey, County Cllr. A Backhouse.

The Chairman reminded those present that filming, photographing or audio recording of the proceedings was allowed – persons wishing to record were asked to notify the Clerk of their intention prior to the start of the meeting. In the interests of encouraging public participation, it was requested that anyone filming did not include members of the public “in shot”.

34/16              DECLARATIONS OF INTERESTReceived & noted from Cllr. Bastiman (agenda item 11.3, applicant had carried out work for him), Cllr. Pickersgill (agenda item 11.4, applicant known to him), Cllrs. Foote, Snow and Thompson (agenda item 10.4, trustee of Newby & Scalby Community Hall).

35/16  MINUTES

35/16.1           Having been previously circulated, it was RESOLVED the minutes of the Council Meeting held on 10th February 2016 be approved as a correct record and signed by the Chairman.

35/16.2           Having been previously circulated, it was RESOLVED the minutes of the Review & Staffing Committee held on 25th February 2016 be received and signed by the Chairman as a correct record.

PROCEDURAL MATTER

At 7.04pm, Standing Orders were suspended to allow the Library Presentation and Public Open Forum.

36/16  LIBRARY PRESENTATION & PUBLIC OPEN FORUM

36/16.1           Library – a presentation about the future of Scalby Library as a community-run library from April 2017 was given by members of the team of Interim Management Volunteers. The background of many of the members was education or NHS related and all had good solid experience of running a business or fundraising. They would soon be applying for charity registration and a volunteer recruitment day was to be held on 28th April. The library was to be known as Scalby with Newby Library & Information Centre. Various questions asked by councillors were answered & the Chairman thanked the ladies for their most informative presentation and commitment. The team then left the meeting.

36/16.2           Public Open Forum – the owner of the land off Lady Edith’s Drive which was the subject of planning application 16/00110/FL by Persimmon Homes (and was for Council’s comments at agenda item 11.3) gave a letter to all councillors. He then spoke in support of the development & asked why, in the past, Council had not objected to the principle of development on this land.

A parishioner explained he had previously spoken against the principle of development on this site (known as HA5 on the emerging Local Plan); he then summarised some of the concerns held by residents regarding the planning application.

PROCEDURAL MATTER – At 7.41pm, Standing Orders were resumed.

37/16              MATTERS RAISED IN PUBLIC OPEN FORUM

37/16.1           Agreed comments regarding planning application at Lady Edith’s Drive be considered at agenda item 11.3; councillors agreed to bring that item forward on the agenda and consider it next.

Councillors considered the letter and comments received during the Public Open forum. It was agreed to defer the matter to an extra ordinary meeting to be held at 7pm on 18th March in order to allow both objectors and supporters to fully present their case.

39/16              POLICE REPORT Resolved crime figures and activity reports (tabled at meeting) be received.

40/16  EXTERNAL REPORTS

40/16.1           County Council:- Cllr. Thompson thanked the County Council for the work recently done to shore up yet another part of the road alongside Church Beck and enquired if any progress was being made in respect of re-routing the beck. County Cllr. Bastiman was unaware of any progress & the Clerk was asked to get an update from the Environment Agency.

40/16.2           Borough Council:-  Borough Cllr. L Backhouse’s written report was received.

40/16.3           FONSA:- No representative present.

40/16.4           In Bloom:- Mr Staveley reported hyacinth sales by the In bloom group had raised £130.  The Potato Competition was to start soon – 255 children from 4 schools were to be involved.

41/16  COUNCILLOR’S REPORTS & UPDATES

41/16.1           Received & noted update [circulated with agenda] from Clerk on highway, footpath and other general matters since last meeting.

41/16.2           Received & noted reports from several councillors in respect of highway matters requiring attention. (Clerk to refer to Highways).

42/16  CORRESPONDENCE

42/16.1           Noted the Roads Liaison Committee had now been dissolved and the £10 annual subscription fee refunded.

42/16.2           Noted exchange of correspondence [circulated with agenda] between a resident of the High Mill estate and the Clerk regarding the poor bus service & lack of shops.

42/16.3           Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency – none.

FINANCE & GENERAL PURPOSES ISSUES

43/16  FINANCIAL MATTERS

43/16.1           Resolved the Schedule of Accounts Payable for March 2016 (Schedule 12) be approved.

43/16.2           Received & noted letter [circulated with agenda] from Savills as agents for Duchy of Lancaster regarding rent review and rent increase from £815/year to £840. Resolved review and increased rent be accepted.

43/16.3           Received & noted 1] Clerk’s report [circulated with agenda] regarding lease of Carr Lane Playing Field and 2] update by Chairman and Clerk on legal advice obtained. With Council’s consent Mr Perry of Scalby Sports Association addressed the meeting. Councillors felt that any new lease should not reserve the playing field for the exclusive use of Scalby Cricket and Football clubs since it was conveyed to Council for use as a public recreation ground and playing field. Cllr. Bastiman asked Mr Perry to remove his name from the minutes of Scalby Sports Association’s 2016 AGM as he had not attended the meeting or agreed to be their Chairman.  Resolved 1] it was not appropriate for Council to be a member of Scalby Sports Association, 2] taking into account the legal advice received, the existing lease not to be assigned to Scalby Sports Association, 3] taking into account the legal advice received, recommendation 4 of the Clerk’s report be carried and a new 30 year lease be granted to Scalby Sports Association providing it was able to pass all Council’s due diligence checks and legal advice was that matters were in order. Council authorised the Cllr. Towse and Clerk to ensure the necessary checks were undertaken in respect of any agreement with Scalby Sports Association. Council authorised Cllr. Towse, Cllr. Thompson and the Clerk to sign any new lease on Council’s behalf, 4] recommendation 5 of the Clerk’s report be placed on the agenda of the May council meeting.

43/16.4           £300/year contribution to raised bed planting at Newby & Scalby Community Hall [Minute 105/11.2 refers]resolved it no longer remained appropriate to fund these beds for financial year 2016/17 onwards.

43/16.5           Annual review of policies, financial regulations and contracts etc. Received Cllr. Towse’s report [circulated with agenda] on the recommendations of the Review & Staffing Committee meeting of 25th February 2016. Resolved the report be noted in its entirety and the committee’s recommendations be approved.

At this point (8.37pm) Mr Staveley left the meeting.

47/16.4           North Yorkshire and Cleveland Coastal Forum – next meeting Sept. 2016 (Cllr. Mrs Wiles).

47/16.5           Yorkshire Local Councils’ Association – Next meeting 2/6/16 (Cllr. Towse).

47/16.6           Twinning Association –  Cllr. Thompson reported on committee meeting of 8th and 29th February. 43 people were coming from Pornic on this year’s visit. An invitation to the formal dinner after the civic reception was to be sent to the Council Chairman. A request was made for the Scalby village name signs to be checked and any missing letters in the phrase “twinned with Pornic” replaced.
