MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY TOWN COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 7th June 2023 at 7pm.

 

PRESENT: Councillor R Towse (Chairman), Cllrs. S Barnes, D Bastiman, J Fennell, S Foote, R Holliday, B Marley, J Smith, D Sutton, R Thompson.

ALSO IN ATTENDANCE: PC636 Flinton (left 7.10pm), NYC Cllr. Sharma, Mrs J Marley (Clerk to Council)

ABSENT:       Cllr. D Wiles.

 

92/23               APOLOGIES FOR ABSENCE Received and accepted from Cllr. Wiles (work commitment).

93/23               DECLARATIONS OF INTEREST:  None.

94/23               MINUTES

Having been previously circulated, the minutes of the Annual Council Meeting held on 10th May 2023 were approved as a correct record and authorised for signature by Cllr. Towse.

96/23               MATTERS RAISED IN PUBLIC OPEN FORUM None.

97/23               VACANCIES (Newby Ward)

97/23.1            Applications for co-option to the Ordinary Vacancy created at the election by reason of insufficient nominations – none to receive.

97/23.2            Applications for co-option to the Casual Vacancy created by the resignation of D. Langmead  – none to receive.

98/23               EXTERNAL REPORTS

98/23.1            Police:- Reports for Newby and Scalby for May incidents were tabled at the meeting. Additional information given by PC636 Flinton on Newby items – the vehicle on Greylands Park Drive had now been removed and speed checks would continue in the vicinity of Moor Lane, Red Scar Drive and Hackness Road.

At this point (7.10pm) PC636 Flinton left the meeting.

98/23.2            North Yorkshire Unitary Council:-  Cllr. Sharma reported action was imminent on the longstanding issue with the hedge on the corner of Dunwell Avenue.  Cllr. Bastiman reported 1] background work on a new Local Plan had been started, 2] improvements to Scarborough West Pier were to go ahead, 3] the selection process for an elected Mayor was about to begin, 4] work on the Cinder Track was to restart.

99/23               UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS

99/23.1            Received & noted written report by Helen King (tabled at meeting).

99/23.2            Update by Chairman and Clerk on matters dealt with under delegated powers:– 1] N. Yorks. & Cleveland Forum [Minute 74/23 refers] was not active due to a lack of funding but North Yorkshire Council was part of the North East Coastal Group.

99/23.3            Update on local government re-organisation – agreed  to remove from future agenda as no longer a need for it to be a standing item.

99/23.4            Update on Scalby Toilets -Cllr. Towse reported he understood the water supply had now been registered and that donations by members of the public using the toilets had dropped considerably.

99/23.5            Reports from Councillors of any highway & footpath or general matters requiring attention – 1] Cllr. Smith mentioned some seats were in need of painting (it was explained it was hoped to do this work in the current financial year); 2] Cllr. Towse reported a new group (similar to In Bloom) had begun though it would look after less flower beds (Clerk to contact Sue Tipple for name of group).

100/23             CORRESPONDENCE

100/23.1          Training [emailed to all councillors 15/5/23] – Wednesday 14th June 2023 1545-1815 in the Hub by the YLCA and covering powers policies and procedures to ensure the council acts lawfully – confirmed Cllrs. Barnes, Fennell and Sutton to attend.  Clerk to do booking.

100/23.2          Noted 1] a letter received from Robert Goodwill MP regarding issues raised by a parishioner about traffic speed and alleging Moor Lane does not have a speed limit in place and 2] Clerk’s initial response [both circulated with agenda]. Clerk updated members – the VAS data from Red Scar Lane showed an 85thspeed percentile of 39.9 mph so the area had been referred to the Police for enforcement. Moor Lane was in a 30mph zone but no columns were adapted to hold a VAS sign – initial enquiries suggested the cost to do this would be £200-£300/column. Unitary Councillor Sharma offered to provide some funding from his Locality budget for Moor Lane and Unitary Councillor Bastiman offered to provide some funding from his Locality Budget for a site on the A171 near the Rugby Club.  Chairman/Clerk to liaise with Highways & Cllrs. Sharma and Bastiman.

100/23.2          Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:– 1] BT contract up for renewal, a local company had matched the renewal – agreed Clerk to find out what would happen if local company ceased trading, item to be re-considered at July meeting.

101/23             FINANCE, REGULATORY & GENERAL MATTERS

101/23.1          Resolved the Schedule of Accounts Payable for June 2023 (Sch 2, £5,447.63) be approved. Cllrs. Sutton and Towse to do the online authorisations within 24 hours, Cllrs. Bastiman and Fennell signed the cheque.

101/23.2          Community Asset Transfer – agreed Chairman/Clerk to approach NYC regarding various locations within the parish (to include Scalby Toilets, Millennium Field, bowling green/tennis courts/community hall area, land near Newby Farm Court, land at bottom of Danes Dyke [proposed building site and previously a playground]).

102/23             PLANNING APPLICATIONS & APPEALS NOTIFIED

Comments on the following application received [circulated with agenda] were agreed:-

  1. 22/02245/HS Erect two storey side extension, front porch, dormers to front and rear and raise main roof ridge height at 47 Westfield Avenue, Newby. No objections.
  2. 23/00341/HS Single storey side extension, 44 North Street, Scalby. No objections.
  3. 23/00434/HS Single and two storey extension to side and rear including annex. Alterations to garage. 53 Coldyhill Lane, Newby. No objections.
  4. 23/00533/HS Two storey extension to side and rear, 60 Moor Lane, Newby. Object – to large, will have overbearing impact on surrounding area.
  5. 23/00537/LB Replace 1 casement window, TV aerial, RWP from 200 to 250mm, solar panels to rear, conservation velux to front elevation, internal timber shutter, built-in wardrobe and garden fence at 96 Throxenby Lane, Newby. Not considered – plans withdrawn, application invalid.
  6. 23/005385/HS Replace 1 window, install 1 rooflight to front, solar panels to rear and erect shed and fence at 96 Throxenby Lane, Newby. Not considered – plans withdrawn, application invalid
  7. ZF23/00654/HS Single storey side extension, 6 Foxglove Way, Scalby. No objections.
  8. ZF23/00867/TD Install 15metre phase 8 monopole and associated ancillary works, junction of Scalby Road and Green Lane, Newby. No objections.
  9. NYM/2023/0126 Demolish pole barn and lent-to agricultural building, convert agricultural outbuildings into three holiday letting units with associated parking and landscaping works, Prospect House Farm, Hay Lane, Scalby. No objections.

103/23             PLANNING DECISIONS – The following were noted:-

  1. 22/00552/OL Erect 2 detached bungalows (all matters reserved) served from private drive, following demolition of existing dwelling, 151 Coldyhill Lane, Newby. Granted with conditions.
  2. 22/01928/OLA Vary condition 3 and remove condition 18 on 19/01248/OL to remove requirement for pedestrian/cycle bridge/route over sea cut/Scalby Beck and provision of shared pedestrian/cycle route on Station Road, Scalby, Land off Mill Way, High Mill, Scalby. Refused.

104/23             PLANNING MATTERS RECEIVED AFTER 31/5/23

Comments on the following applications received [previously notified to councillors] were agreed:-

  1. ZF23/00626/HS Erect two storey and single storey rear extension following demolition of rear extension and conservatory (revised scheme to 22/01421/HS,16 Hackness Drive, Newby. No objections.
  2. ZF23/00673/HS Single storey front porch extension, 19 The Parkway, Newby. No objections.
