MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY TOWN COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 12th October 2022 at 7pm.
PRESENT: Councillor R Towse (Chairman), Cllrs. S Barnes, , R Holliday, D Langmead, B Marley, D Sutton.
ALSO IN ATTENDANCE: County and Borough Cllr. Sharma (left 8.10pm), J. Shepherd (Scalby Toilets Trust) (left 7.58pm), S. Black (left 7.58pm), K. Avison and J Martin (Gallows Close) (left 7.25pm), 2 members of public (left 7.42pm), Mrs J Marley (Clerk to Council).

90/22 MINUTES
90/22.1 Having been previously circulated, the minutes of the Town Council meeting held on 28th September 2022 were approved as a correct record and authorised for signature by Cllr. Towse.
PROCEDURAL MATTER 7.02pm – Suspension of Standing Orders.
91/22 PUBLIC OPEN FORUM K. Avison and J Martin spoke about the work being done by Gallows Close in their community and a robust exchange of views took place between Mrs Avison and the Chairman.
Mrs Avison and Mr Martin left the meeting at this point (7.25pm).
A High Mill resident spoke about their concerns regarding the planning application to remove the requirement for a bridge. Mr Black spoke regarding keeping Scalby Toilets open.
PROCEDURAL MATTER 7.28pm – Resumption of Standing Orders.
92/22 MATTERS RAISED IN PUBLIC OPEN FORUM K. Avison and J Martin were invited to formally contact the Town Council so a meeting could be arranged. Comments on the High Mill bridge planning application and Mr Black’s update on Scalby Toilets would be taken into consideration when Council discussed the items.
PROCEDURAL MATTER With Council’s agreement the order of the agenda was varied and agenda items 13.4 (High Mill planning) and 8.4 (Scalby Toilets) were taken next.
93/22 PLANNING APPLICATION, 22/01928/OLA, HIGH MILL ESTATE
This was an application to vary condition 3 and remove condition 18 on decision 19/01248/OL dated 03.09.2020 so as to delete the requirement for pedestrian/cycle bridge/route over Sea Cut/Scalby Beck. Councillors took into account comments by the member of public. There was unanimous strong objection to this application. The bridge over the sea cut had been an integral part of the original outline consent for the High Mill development (condition 17 of 09/00717/OL granted 22/10/2010) and had been conditioned in order to ensure adequate provision was made for pedestrian and cycle routes to maximise the sustainability of the proposed development. Council did not consider anything had changed and the provision of a bridge was absolutely vital to ensuring safe access between the estate and the parish to the south. It was not for the Borough Council’s Estates Dept. or the Environment Agency to say the bridge would not deliver wider public benefits. Difficulties experienced by the applicant in getting agreement with the Borough Council and Environment Agency in respect of landing and air rights were not a good reason for asking for removal of the condition.
The High Mill residents left the meeting at this point (7.42pm).
94/22 SCALBY TOILETS – [Minute 77/22 refers] noted updates from Mr Black and Chairman regarding meeting last week. Chairman reported a local businessman had pledged support of £2,000 a year. An offer had also been received from a local businessman for his staff to open and close the toilets free of charge on a daily basis. Clerk reported SBC was happy for running of the toilets to be taken over by the Town Council on basis of current lease being handed in and a 12 month lease being agreed with the Town Council. Council agreed to this course of action. Mrs Shepherd confirmed the Toilet Trust was happy to hand in its lease. Chairman and Clerk to continue negotiations and revert to Council as necessary.
Mr Black and Mrs Shepherd left the meeting at this point (7.58pm).
95/22 VACANCIES UNFILLED AT THE ELECTION BY REASON OF INSUFFICIENT NOMINATIONS
Noted a preliminary expression of interest had been received.
96/22 EXTERNAL REPORTS
96/22.1 Police:- :- The Scalby report for incidents 1/9/22-30/9/22 [emailed to councillors 7/10/22] was received & noted.
96/22.2 County Council:- County Cllr. Sharma reported the new unitary authority would be setting up a licensing committee comprising around 25 councillors with a smaller sub-committee specifically for alcohol and premises licenses.
96/22.3 Borough Council:- No matters to report.
County Cllr. Sharma left the meeting at this point (8.10pm).
97/22 UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS
97/22.1 Report from H King on Community and Wellbeing Hub – Chairman reported the launch of the Menopause Calendar was to take place the following day with local and regional media coverage expected. It was hoped there would be with national coverage later in the month in women’s magazines.
97/22.2 Received update on Neighbourhood Plan – Scalby Village Trust had submitted some documents to SBC without them being seen by the NHP Working Group – this situation had been rectified and SVT now understood the Town Council was the lead for the Plan. A useful document had been drawn up by Jonny Barker.
97/22.3 Update on local government re-organisation – none to receive.
97/22.4 Update on Scalby Toilets – see Minute 94/22
97/22.5 Reports from Councillors of any highway & footpath or general matters requiring attention – [SB] request for additional litter bins near Field Lane caravan site and in layby near Brad’s Pad entrance and damaged bus stop post in Station Road still not replaced.
98/22 CORRESPONDENCE
98/22.1 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:– none.
99/22 FINANCE, REGULATORY & GENERAL MATTERS
99/22.1 Potential one-off expenditure items for the next financial year which need to be included in the 2023/24 budget calculations – only project mentioned was the de-silting and tidying of Foulsyke Pond and surrounding area including under-road drainage.
99/22.2 Resolved the Schedule of Accounts Payable for October 2022 (Sch 7, £11,426-69) be approved. Cllrs. Langmead and Sutton to do the online authorisations within 24 hours, cheque signed by Cllr. Langmead and Towse.
99/22.3 Christmas tree to the front of the Town Council’s office – in view of increased energy costs and inflation agreed no tree be erected this year.

- NYM/2022/0335 Certificate of lawfulness for use of agricultural buildings as dwelling house in excess of four years, construction of extension more than ten years ago and use of land as domestic garden in excess of ten years, Stag Hall Farm, Harwood Dale Road, Burniston. Granted.
