MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Rickinson Hall, St. Laurence’s Church Rooms, Scalby,
on Wednesday, 8th October 2014 at 7pm.
PRESENT: Councillor Mrs G Kendall (Chairman), Councillors Mrs E Black, W Black, S Foote, S Gething, TW Miller, Mrs C Snow (from 7.02pm), RI Thompson, R. Towse, BF Watson (from 7.09pm).
ALSO IN ATTENDANCE: County Cllr. A. Backhouse, P. Staveley (In Bloom), PC1975 Rogers and PCSO5208 Lockey (left 7.15pm), 4 members of public for allotment presentation (left at 7.08pm), 2 members of public (1 photographing), Mrs J Marley (Clerk).
ABSENT: Borough Cllrs. Mrs S Backhouse and A. Jenkinson, Cllrs. D. Bastiman and R. Pickersgill.
As Chairman of the meeting, Cllr. Mrs Kendall reminded those present that filming, photographing or audio recording of proceedings was allowed – persons wishing to record were asked to notify the Clerk of their intention prior to the start of the meeting. In the interests of encouraging public participation, it was requested that anyone filming did not include members of the public “in shot”.
PROCEDURAL MATTER Standing Order 64 was suspended for the duration of this meeting.
129/14 APOLOGIES FOR ABSENCE Received & accepted from Cllr. Bastiman (prior commitment), Cllr. Pickersgill (family illness), Messrs. Afford & Perry (Scalby Football and Cricket Clubs) (prior commitments).
130/14 DECLARATIONS OF INTEREST
130/14.1 Cllr. Watson declared a personal interest in agenda items 13, 14 and 15 as he was a member of SBC Planning Committee.
During the next item Cllr. Mrs Snow arrived.
131/14 MINUTES
131/14.1 RESOLVED the minutes of the Council Meeting held on 10th September 2014 be approved as a correct record and signed by the Chairman.
PROCEDURAL MATTER At 7.04pm, Standing Orders were suspended to allow the Public Open Forum.
132/14 PRESENTATION OF ALLOTMENT PRIZES
132/14.1 Prizes were presented by the Chairman as follows:
- Best Allotment – Rick and Pat Ireland (plot 65), shield and £25.
- Most Improved allotment – Ray Wright (plot 26), £25.
- Largest Marrow – Ken Gill (30lb. 8oz) bottle of port and a stilton cheese.
The prize winners left the meeting at 7.08pm.
133/14 PUBLIC OPEN FORUM No matters the remaining two members of public wished to raise.
PROCEDURAL MATTER At 7.09pm, Standing Orders were resumed.
At this point, Cllr. Watson arrived and submitted a Declaration of Interest form (see Minute 130/14.1).
134/14 MATTERS RAISED IN PUBLIC OPEN FORUM – None.
135/14 POLICE REPORT
RESOLVED written report (circulated with agenda) be received. Councillors asked questions regarding the Newby beat’s 100% increase of violence against the person and 55% increase in arson & criminal damage. It was explained that the Newby beat included area outside the parish eg Briercliffe and the Barrowcliffe estate.
136/14 EXTERNAL REPORTS
136/14.1 County Council:- County Cllr. Backhouse reported the waste recovery plant at Allerton Park was to proceed. A further review of library service was to take place.
136/14.2 Borough Council:- Borough Cllr. Watson reported the licence at the Waterpark had been granted from 10am to 10pm with an option to extend beyond that (with prior notification) on 4 occasions during the year.
136/14.3 FONSA:- No report to receive.
136/14.4 In Bloom:- Mr Staveley reported the Best Kept Garden prizes had been presented by Cllr. Towse on 27th September. Newby & Scalby In Bloom had again received a Silver Gilt award at the Yorkshire In Bloom presentation in York on 16th September, The planters for Stony Lane corner were now in place and it was hoped to have it finished soon and the spring bulbs planted.
137/14 COUNCILLOR’S REPORTS & UPDATES
137/14.1 RECEIVED & NOTED update [circulated with agenda] from Clerk on highway & footpath and other general matters since last meeting. Verbal report given on extent of amended speed limits for Field Lane and agreed by vote of 7 for, 2 against, that NYCC be asked to move the 30mph sign on Field Lane from the proposed 260 metres after the junction to 20 metres after the junction (the junction itself would still be in the 40mph zone). Clerk to inform Highways.
137/14.2 RECEIVED & NOTED Various highway & footpath or general matters reported by councillors:- 1] collapsed fence and missing post at Lawrence Grove entrance to Linden Road open space (Clerk to refer to SBC).
138/14 CORRESPONDENCE
138/14.1 Received & noted letter from NYCC regarding proposals for part-night street lighting in Scalby [circulated with agenda] and map [displayed on committee room wall] – concerns there were a lot of side streets without any lights left on. Councillors also asked Clerk to find out what would happen in all the new housing developments which will be coming online eg. High Mill development on Field Lane.
138/14.2 Received & noted letter of September 2014 from Scalby & Newby Library Volunteers [circulated with agenda].
138/14.3 Received & noted letter of 17/9/14 from Scalby Toilet Trust [circulated with agenda].
138/14.4 Received & noted letter of 22/9/14 regarding St. Laurence’s Remembrance Sunday reading (10am 9th November). Agreed Cllr. Mrs Kendall to do a bible reading & lay a wreath.
138/14.5 Road traffic Island at Stony Lane corner – Received & noted email of 25/9/14 from a parishioner regarding the fact the work was not completed by 8th July as anticipated and asking 1] if the proposed planting during autumn of spring bulbs was still to take place and 2] for a revised schedule of works. The Chairman invited Mr Staveley to update members – he reported the planters were in situ and it was hoped siting of the seat and bulb planting would be done within the next six weeks. Agreed Clerk to write to parishioner.
138/14.6 Received & noted exchange of emails between a parishioner and the Clerk regarding some aspects of the planning application on the old site of the Rugby Club.
138/14.7 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:- Received & noted email from member of public regarding a problem known as Angel wing with the ducks and geese at Foulsyke Pond and a draft press release prepared by the Clerk [circulated at meeting]. Resolved Clerk to prepare and erect notices at the pond and contact media as appropriate with press release.
FINANCE & GENERAL PURPOSES ISSUES
139/14 FINANCIAL MATTERS
139/14.1 RESOLVED the Schedule of Accounts payable for October 2014 (Schedule 7) [tabled at meeting] be approved.
139/14.2 Discretionary Grant Applications [circulated with agenda] from Scalby Football Club and Scalby Cricket Club. Deferred to future meeting at applicant’s request.
139/14.3 Christmas lights on St. Laurence’s schoolroom. Received & noted verbal report by Clerk that some repairs were needed and lights unlikely to last much longer – need to consider action to be taken both short and long term. Resolved 1] Clerk authorised to spend up to £300 to repair all lights for this year and 2] Clerk to investigate rental of lights as opposed to ownership and report to future meeting.
139/14.4 External auditor’s report on 2013/14 accounts [circulated with agenda] received & noted the audit has been successfully completed and no matters of concern raised.
139/14.5 Internal auditor’s report for Quarter 1 of 2014/15 account year [circulated with agenda] on 2013/14 accounts [circulated with agenda] received & noted.
139/14.6 Noted Clerk’s report that the annual ROSPA safety inspection report had recommended various maintenance work be carried out (eg, routine replacement of chains, bolts, shackles). Resolved Clerk be authorised Clerk to proceed as appropriate.
140/14 GENERAL PURPOSE & REGULATORY MATTERS
140/14.1 Casual Vacancy in Newby Ward. Noted that with effect from 13th September a casual vacancy has existed in Newby Ward due to the non-attendance of Cllr. Tyson over a period of six months. Received Clerk’s report that to the best of her knowledge an election had not been requested though official confirmation of this was awaited from SBC. Council resolved they wished to fill the vacancy by co-option and authorised the Clerk to post a notice inviting applications for the vacancy (closing date to be 8am on Monday 3rd November 2014).
140/14.2 Permanent variation of Standing Orders (as considered at meeting of 10/9/14). Received amended orders [circulated with agenda] and agreed Standing Orders 2, 3, 4, 63 and 64 be amended with effect from 9th October 2014.
140/14.3 Meeting with police [Minute 118/14 refers]. Received & noted verbal reports by Chairman and Cllr. Towse on their meeting. It had been agreed there was a need to increase Police’s community involvement & with onset of dark nights the provision of timer lights could also help with crime prevention. Suggested Police (via its working partners) identified elderly and vulnerable persons who would benefit from the provision of timer lights. Timers could be bought for under £2-50 each. Council would purchase and Police would distribute. Council authorised expenditure not exceeding £300. Chairman/Cllr. Towse and Clerk to proceed as appropriate.

144/14.4 North Yorkshire and Cleveland Coastal Forum – no report (no one had been able to attend the meeting on 17/9/14).
144/14.5 Yorkshire Local Councils’ Association – Cllr. Mrs Kendall reported on a presentation by Arriva buses. Various matters had been discussed including forthcoming changes to pensions and the audit regime, NYCC’s proposed grass cutting reduction and the new legislation regarding recording of meetings and how to deal with it.
144/14.6 Twinning Association – next meeting 21/10/14. (Cllrs. Mrs Snow & Thompson).
144/14.7 Yorkshire Coast & Moors County Area Committee – Cllr. Thompson reported matters discussed at today’s meeting had included Whitby Park & Ride and NYCC’s proposed grass cutting reduction.
144/14.8 North York Moors National Park Authority – Cllr. Thompson reported the new planning application for the potash mine had been received and a decision was likely during January 2015. The planning application at Ox Pasture Hall had been refused.
144/14.9 CPRE – next meeting 21/10/14 (Cllr. Mrs Kendall).
144/14.10 Any other reports not previously notified – None.
