MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Rickinson Hall, St. Laurence’s Church Rooms, Scalby,
on Wednesday, 8th July 2015 at 7pm.

PRESENT: Councillor R Towse (Chairman), Cllrs. D Bastiman, S Foote, S Gething, Mrs R Holliday, TW Miller, R Thompson, BF Watson, Mrs D Wiles.

 ALSO IN ATTENDANCE:  County Cllr.  A. Backhouse, Borough Cllr. L. Backhouse, (from 7.09pm), Borough Cllr. A. Jenkinson,  3 members of public (left 8.02pm), Mrs J Marley (Clerk).

ABSENT:      Cllrs. Mrs Black, G. Edmunds, R. Pickersgill, Mrs C Snow, Borough Cllr V. Inman, P. Afford.

The Chairman reminded those present that filming, photographing or audio recording of the proceedings was allowed – persons wishing to record were asked to notify the Clerk of their intention prior to the start of the meeting. In the interests of encouraging public participation, it was requested that anyone filming did not include members of the public “in shot”.

110/15            APOLOGIES FOR ABSENCE Received & noted from Cllr. Mrs Black (family bereavement), Cllr. G Edmunds (prior commitment), Cllr. R Pickersgill (family commitment), Cllr. Mrs C Snow (illness) and P. Afford (prior commitment).

The Chairman welcomed Cllr. Mrs Holliday to her first meeting of the Parish Council.

111/15            DECLARATIONS OF INTEREST

111/15.1         Cllr. Gething declared a personal interest in agenda item 10.2.

112/15            MINUTES

112/15.1         Having been previously circulated, it was RESOLVED the minutes of the Council Meeting held on 10th June 2015 be approved as a correct record and signed by the Chairman.

PROCEDURAL MATTER  At 7.03pm, Standing Orders were suspended to allow the Public Open Forum.

113/15            PUBLIC OPEN FORUM

113/15.1         The public present explained their objections and concerns in respect of planning application NYM/2015/0197/FL at Ryefield, Hackness Road.

PROCEDURAL MATTER – At 7.06pm, Standing Orders were resumed.

114/15            MATTERS RAISED IN PUBLIC OPEN FORUM Agreed objections to be taken into account when Council considered the application in question at agenda item 11.8.

115/15            POLICE REPORT Resolved written report (circulated with agenda) and additional report (tabled at meeting) be received.

116/15            EXTERNAL REPORTS

116/15.1         County Council:- County Cllr. Bastiman reported the NYCC Executive had yesterday approved the Overview and Scrutiny Committee’s recommendation of 5-7 hours of dedicated library support staff as part of Scalby Library’s proposed downgrade from a hybrid library to a community library.

116/15.2         Borough Council:-  Cllr. Bastiman reminded members that grant applications to Central Rural Area Committee had to be submitted by 15th September. Cllr. Jenkinson had no matters to report. Cllr. A Backhouse reported a parking initiative trial had been agreed today & he would pass on full details as soon as they were available.  Negotiations were still ongoing between SBC and NYCC in respect of future years grass cutting.

116/15.3         FONSA:- No representative present.

116/15.4         In Bloom:- No representative present, possibly due to the fact that the In Bloom summer judging had taken place today

117/15            COUNCILLOR’S REPORTS & UPDATES

117/15.1         Received & noted update [circulated with agenda] from Clerk on highway, footpath and other general matters since last meeting. Also noted the Chairman’s verbal update on item 2.1 of that report – a letter had been received from the Trust on 7/7/15 stating (1] the occupational licence required 3 months notice, so Council’s notice expired on 10/9/15; 2] the Hall Trustees felt it would be less complicated if the Parish Council took all its belongings when it left instead of the Trust purchasing all the furniture etc which was owned by the Council and used by the Trust; 3] decorations to be made good in accordance with licence. Chairman reminded members the licence referred to had expired on 31/5/15.

117/15.2        Received & noted various reports from councillors on matters needing attention (to be passed to highways and SBC as appropriate).

117/15.3         Christmas lights [Minute 101/15.4 refers]. Received & noted report from Clerk that it had transpired the person on Burniston Road mentioned by Cllr. Mrs Black was the same person as the one living at Osgodby and previously identified by the Clerk. As there were potential liability issues if the lights were sold, it was resolved the lights be donated to the person at Osgodby providing he gave Council a letter fully exonerating it from any future liability whatsoever.

118/15            CORRESPONDENCE

118/15.1         Yorkshire Coast & Moors County Area Committee – Vacancy for Co-opted Member. Received & noted letter from NYCC dated 18/6/15 that following the elections on 7th May 2015 a vacancy had arisen for one of the three Parish Council representatives. As a member of this parish council was already one of the existing co-optees to the area committee, Council resolved not to make a nomination to the vacancy.

118/15.2         Noted that on 23/6/15 a group of residents had written individually to all councillors in respect of NYM/2015/0197/FL (Ryefield, Hackness Road), asking Council to give further consideration to that application at its meeting on 8th July.

118/15.3         Noted that on 26/6/15 Clerk had contacted all councillors on email regarding amendments to NYM/2015/0197/FL and given advice regarding objecting to the amended application.

118/15.4         Parish member appointment to NYMNP [Minute 102/15.1 refers] – noted Cllr. Thompson had not been re-elected. Mr L Atkinson had received a majority of votes and his appointment had been confirmed by the Secretary of State. Cllr. Bastiman reported Mr Atkinson had not attended the potash planning meeting on 30/6/15 (unable to vote since he had a pecuniary interest). Cllr. Thompson asked members to support Mr Atkinson.

118/15.5         Consultation by SBC on Strategic Housing Market [questionnaire circulated with agenda]. Resolved councillors to return completed questionnaires to Clerk by 13/7/15 for her to collate and submit as this Council’s response.

118/15.6         Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency – none.

FINANCE & GENERAL PURPOSES ISSUES

119/15            FINANCIAL MATTERS

119/15.1         Resolved the Schedule of Accounts payable for July 2015 (Schedule 4) [tabled at meeting] be approved.

119/15.2         Christmas Lights on the Temperance Hall, North Street, Scalby. Received & noted a suggestion by Cllr. Foote that Council erected lights on the Temperance Hall (which is owned by Scalby Village Trust). Cllr. Foote explained he would like to see one of the current (agreed) lighting projects suspended and lighting of the hall be substituted. Clerk advised 1] contract for current lighting projects had been awarded, 2] as the proposal did not involve emergency expenditure, it should be considered for inclusion with the 2016/17 budget, 3] the wisdom of spending public money to light private buildings needed to be considered, 4] as a member of the Management Committee of Scalby Village Trust, Cllr. Foote should consider declaring an interest prior to any vote on this matter this evening. Resolved Cllr. Foote’s proposal that the Temperance Hall be lit this year was not carried. Further resolved the matter would be considered when setting the budget for future years.

ENVIRONMENT AND DEVELOPMENT ISSUES

120/15            PLANNING APPLICATIONS:

120/15.1         Proposed Cllr. Bastiman and resolved the order of the agenda be varied by taking item 8 (application NYM/2015/0197/FL at Ryefield) first.

120/15.2         Cllr. Bastiman & several other councillors spoke strongly against this application. Council had always resisted applications in this area which provided an important break between Newby and Scalby. At the Chairman’s request the Clerk advised on the procedure to be followed should Council wish to reverse its previous decision on NYM/2015/0197/FL. Consequent to that advice, Cllr. Bastiman proposed and it was resolved that Standing Order 18 be suspended for the duration of tonight’s meeting. A special resolution signed by 5 councillors “In accordance with Standing Order 33, we wish to propose that Council re-considers the decision taken at minute 105/15.6” was received and carried unanimously.

Noted that the application had been amended to construction of 1 dwelling instead of 3. Comments made by the public present [Minute 113/15.1 refers] and within the correspondence received from a group of parishioners [Minute 118/15.2 refers] were taken into account.  Resolved 1] the previous comments submitted by Council of “no objections” be withdrawn, 2] Council strongly objected to the application as amended on the grounds it was contrary to Core Policy J (para 1, 2 and 3, by virtue of the fact it was not within the main built up part of Scalby village, did not provide any local needs housing and an essential need for the development had not been proven. Other points raised by councillors were also to be included within Council’s comments to the planning authority.
