MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL,
held in the Committee Room, Newby & Scalby Community Hall, Scalby Road, Scalby,
on Wednesday, 8th December 2010 at 7.15pm

 

PRESENT:  Councillors B Miller (Chairman in the Chair), D J Bastiman, S G Foote Mrs G Kendall, R Pickersgill, C Ridley, R I Thompson, A Tyson and B F Watson

206/10            APOLOGIES FOR ABSENCE  Councillor Mrs P C Snow, Mr G Dale, Mr T Teasdale and Mr and Mrs Gilbert

207/10            DECLARATIONS OF INTEREST
207/10.1         Councillors C Ridley and B F Watson declared their respective personal interests in all Borough Council planning applications as members of the Borough Council’s Planning Committee and took no part in the decisions together with personal and prejudicial interests in minute 212/10.8.

207/10.2         Councillor Bastiman declared a personal and prejudicial interest in all planning issues and applications in his capacity as Portfolio Holder on Scarborough Borough Council with responsibility for Planning Issues and withdrew from the meeting prior to the planning matters being considered together with a personal and prejudicial interest in minute 212/10.8.

207/10.4         Councillors S G Foote, C Ridley, R I Thompson and Mrs G Kendall declared their respective personal and prejudicial interests, as Community Hall Trustees, in the matters on the agenda relating to the Community Hall and withdrew from the meeting prior to the matters being considered.

PROCEDURAL MATTER 1
RESOLVED that the meeting be suspended at 7:16 p.m. for the Chairman to present the following Allotment Awards and congratulate the winners:

  1.           Best Kept Allotment             –           Mr and Mrs R Gilbert (Plot 28 South)
    (Mr and Mrs Gilbert had sent their apologies due to being on holiday)
  2.           Most Improved Allotment    –           Mr P Francis (Plot 42)
  3.           Largest Marrow                     –           Mr K Gill (Plots 1, 9 and 10)

PROCEDURAL MATTER 2
RESOLVED that in the absence of Mr Roger Kaye of Scarborough Borough Council the following new/revised issues be reported to Mr Kaye for action/comment:

  1. Grit bins still require filling on Hillcrest Avenue
  2. The bench seat at Hay Lane/Scalby Nabs requires repair
  3. Lamp no. 26 is off opposite the Miners Home Cottages/Hackness Road
  4. A lamp is off outside Derwent Manor on Hackness Road
  5. Lamp no. 5 is off on Cross Lane

208/10            REPORTS FROM OUTSIDE BODIES
The following Reports from Council Representatives, where indicated below, were RECEIVED:

208/10.1         Allotments Friends Group – Mr K Gill reported that new posts and numbers were needed for the allotment plots and that the gate to the allotments adjoining plot 12(South) should now be sealed off.

RESOLVED that      (i)         the Allotments Friends’ Group be asked to pursue the installation of posts and numbers and advise the Clerk of the Council of the costs for consideration at a future meeting

  • the sealing off of the gate to the allotments adjoining plot 12(South) be approved and the Friends’ group be authorised to conclude the matter without disturbing the gate concerned
  • the Friends’ Group be advised that should they wish to pursue the matter, the Parish Council will submit an application for planning permission for the storage container at the allotments site

208/10.2         In Bloom Group – No report

208/10.3         Scalby Football Club – Mr P Afford reported that due to the bad weather, the site visit on 12 December had been cancelled. Planning was continuing for the new Clubhouse.

208/10.6         Coastal Area Parish Forum – Councillor B F Watson reported on a meeting concerning the performance assessment of the National Park

208/10.7         North Yorkshire and Cleveland Coastal Forum – No report

208/10.10      York and North Yorkshire Playing Fields – No report

209/10            MINUTES
RESOLVED that the minutes of the Council Meeting held on 10th November 2010 be approved as a correct record and signed by the Chairman

210/10            MATTERS OF REPORT FROM THE MINUTES  None

211/10            NEWBY AND SCALBY LIBRARY
The Council considered a proposal by Councillor D Bastiman “that this Council opposes the proposal to close or vary the opening times to Newby and Scalby Library and will work closely with the NYCC to ensure the Library’s future is guaranteed”

RESOLVED, unanimously, that the proposal be fully supported and strong representations be made against any proposal to close or vary the opening hours of the Library

212/10            CORRESPONDENCE
212/10.1         The Council considered an email from Mr F Thompson seeking the Council’s support in objecting to the new (shorter) opening hours of the Nat West Bank on Scalby Road. RESOLVED that the Council strongly opposes the action taken and representations be made to NatWest that the previous opening hours should be re-instated

212/10.2         The Council considered a letter dated 30 November 2010 from the Community Partnerships Manager of SBC concerning a ‘Take Part’ training programme

RESOLVED that additional details be obtained and the matter be considered further at the next meeting

212/10.3         The Council considered a letter dated 18 November 2010 from the Secretary of the Allotments Friends’ Group concerning the footpath through the allotments. RESOLVED that a site meeting be arranged with representatives of the Friends’ Group, Councillor Tyson and the Clerk to pursue the matter further and report at a subsequent meeting

212/10.4         The Council considered an invitation from the SBC to attend a further discussion at 2 p.m. on Friday 28 January 2011 in the Sea View conference Room at the Town Hall, regarding the protocols and procedures following the termination of the Highways Agency agreement on 31 March 2011. RESOLVED that the Chairman be authorised to attend

212/10.5         The Council considered a letter dated 11 November 2010 from the NYMNPA concerning the National Park Governance Review. RESOLVED that the NYMNPA be advised that Parish Meeting representatives should serve for four years in the same way as Parish Council members

212/10.6         The Council considered a letter dated 11 November 2010 from the NYMNPA regarding the undergrounding of overhead electricity wires. RESOLVED that the NYMNPA be advised that the Council support any site where undergrounding of electricity wires can be achieved

212/10.7         The Council considered a letter dated 15 November 2010 from the Waste Operations Manager of the SBC regarding the service Improvement Project 2010/2011. RESOLVED that the Chairman be authorised to attend all meetings

212/10.8         The Council considered a letter dated 12 November 2010 from the Major Projects officer of the SBC regarding a consultation on revised validation requirements for planning applications. RESOLVED that      (i)         the proposals be noted
(ii)        the SBC be asked to supply the planning application booklet for circulation to all members

212/10.9         Further to minute 195/10.4 of the last meeting, the Council considered a letter dated 23 November 2010 from the Highways Services Manager of the SBC regarding gully cleaning. RESOLVED that the letter be received

212/10.10      Further to minute 195/10.5 of the last meeting, the Council considered a letter dated 23 November 2010 from the Public Transport Officer of the NYCC. RESOLVED that the letter be received

213/10            QUALITY STATUS  The overall aims of quality status to remain on the agenda pending developments.

214/10            SCALBY VIADUCT  Issue to remain on the agenda pending developments.

215/10            COLD CALLING ZONES  Issue to remain on the agenda pending developments.

FINANCE & GENERAL PURPOSES ISSUES

216/10            FINANCIAL MATTERS
216/10.1         RESOLVED that the Schedule of Accounts to be paid for December 2010, Schedule 9 be approved and paid

216/10.2         The Council considered a report on the 2010/2011 budget and precept and considered the level of the Parish Precept for 2011/2012. RESOLVED that the report be received and no increase be applied to the precept level set for 2010/2011.

216/10.3         RESOLVED that it be noted that grants have been awarded under the Sports and Recreational Community Chest Awards Scheme in respect of:

  1. Boys Brigade, 2nd Scarborough Company. £500 (towards cost of building a garage to store minibus and camping equipment)
  2. Scalby School Drama Club £500 (towards costs of hiring props, costumes, scenery at SJT and printing of posters/programmes)

Further to minute 200/10.2 of the last meeting, the Council noted that the SBC had acknowledged the request of the Council for the Enforcement Officer to inspect the site and that a full response would be made as soon as possible.

221/10            FLOODING ISSUES
Councillor D Bastiman reported that piling had taken place following a collapse adjacent to Hackness Road and that a plan of works was awaited from the Environment Agency following which a further meeting of the Flood Working Group would be held to consider the matter further. RESOLVED that the report be received with thanks

222/10            EXCLUSION OF THE PUBLIC
RESOLVED that in accordance with Section 100A(4) of the Local Government Act 1972, the public be excluded from the meeting for the following items of business on the grounds that they involve the likely disclosure of exempt information (as defined in Part 1 of Schedule 12A of the Act) relating to the financial affairs of any individual/organisation.

(Having declared a personal and prejudicial interest in the following two matters, the Parish Councillors who were Trustees of the Newby and Scalby Community Hall, withdrew from the meeting until a decision had been made)

223/10            COMMUNITY HALL CAR PARK
The Council considered a request from the Clerk to Newby and Scalby Community Hall Trustees for a contribution towards repairs to the Hall car park. RESOLVED, unanimously, that the request be not approved

224/10            GRANT APPLICATION
The Council considered an application from the Clerk to Newby and Scalby Community Hall Trustees for a grant towards the running costs of the Hall in 2010-2011 and 2011-2012. RESOLVED, unanimously, that the request be not approved.

There being no further business on the agenda the Chairman declared the meeting closed at 8:45 pm
