MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL,
held in the Committee Room, Newby & Scalby Community Hall, Scalby Road, Scalby,
on Wednesday, 10th November 2010 at 7.15pm
PRESENT: Councillors S G Foote (Vice-Chairman in the Chair), D J Bastiman, Mrs G Kendall, R Pickersgill, C Ridley, Mrs P C Snow, R I Thompson, A Tyson and B F Watson
ALSO IN ATTENDANCE: County Councillor A Backhouse, Mr R Kaye (SBC), Mr P Staveley and T Spencer (Clerk)
Prior to the meeting Councillor S G Foote addressed the Council on the current position in relation to the Community Hall
190/10 APOLOGIES FOR ABSENCE Councillor B Miller, Mr P Afford and Mr G Dale
191/10 DECLARATIONS OF INTEREST
191/10.1 Councillors C Ridley and B F Watson declared their respective personal interests in all Borough Council planning applications as members of the Borough Council’s Planning Committee and took no part in the decisions.
191/10.2 Councillor Bastiman declared a personal and prejudicial interest in all planning issues and applications in his capacity as Portfolio Holder on Scarborough Borough Council with responsibility for Planning Issues and withdrew from the meeting prior to the planning matters being considered.
191/10.3 Councillor R Pickersgill declared a personal interest in minute 200/10(2)
191/10.4 Councillors S G Foote, C Ridley, R I Thompson, Mrs P C Snow and Mrs G Kendall declared their respective personal and prejudicial interests, as Community Hall Trustees, in the matters on the agenda relating to the Community Hall
PROCEDURAL MATTER
RESOLVED that (i) the meeting be suspended at 7:15 pm to allow Roger Kaye of Scarborough Borough Council to provide feedback on previously raised road traffic or street scene issues and to receive new issues requiring attention. Mr Kaye provided feedback from the previously raised issues.
The following new/revised issues were reported to Mr Kaye for action/comment:
- Grit bins require filling on Hillcrest Avenue
- A large pot hole requires repair on Throxenby lane
- Damaged verges caused by deliver lorries outside ‘The Rosette’ require repair
- Litter bins are required between Lady Edith’s and the Rugby Club
- Lamp no. 33 on Hay Lane is out and the head of the lamp is obscured by trees
(ii) the Clerk ask the Headteacher of Newby School to advise parents to desist from parking on the grass verges near the school as damage is being caused by the vehicles to the grassed areas

192/10.2 In Bloom Group – Mr P Staveley reported on the Silver Gilt award won by the group in the summer judging and that he had personally received an Achievement award. The Council congratulated Mr. Staveley on the work of the Group and on his personal Award

192/10.6 Coastal Area Parish Forum – Councillors B F Watson reported on his recent meeting with the Chairman of Natural England

192/10.9 Twinning Association – Councillors R I Thompson reported that the AGM would be held on 4 January 2011 and that the provisional dates for the Pornic visit in 2011 were 12-18 May

192/10.11 Yorkshire Coast & Moors County Area Committee – Councillor R I Thompson reported on the last two meetings of the Committee

193/10 MINUTES
RESOLVED that the minutes of the Council Meeting held on 13th October 2010 be approved as a correct record and signed by the Chairman
194/10 MATTERS OF REPORT FROM THE MINUTES
Further to minute 175/10.12 the Clerk reported that the NYMNPA had not yet received a planning application from the Allotments Friends’ Group to site a container on the allotment site
195/10 CORRESPONDENCE
195/10.1 The Council considered an email from Mr P Afford regarding a suggested visit to Scalby Junior Football. RESOLVED that the following Councillors attend on the 12th December 2010 at 10:15 a.m.: Councillor D J Bastiman, Councillor Mrs G Kendall., Councillor C Ridley, Councillor A Tyson
195/10.2 The Council considered a letter dated 5 October 2010 from the Health and Community Manager of the SBC concerning a review of dog control legislation. RESOLVED that the manager be advised that a dog ban should be imposed for the Community Hall grounds and that a dogs on leads order be imposed for the Linden Road Village Green
195/10.3 RESOLVED that the notes of a meeting held on 8 October concerning the termination of the highways agency be received
195/10.4 Further to minute 188/10.1 of the last meeting the Council considered a letter from the Highways Services Manager of the SBC. RESOLVED that the letter be received and the Manager be advised that it is not the responsibility of residents neither to monitor gullies/drains nor to be responsible for removing any build up of debris
195/10.5 Further to minute 178/10.1 of the last meeting the Council considered a letter from the Public Transport Officer of the NYCC regarding the bus stop adjoining Proudfoots. RESOLVED that the letter be received and the Officer be advised that there are a high percentage of elderly residents who use this service and therefore the situation should be reviewed and every effort be made to install raised kerbs perhaps on a discretionary basis. In addition, the Coldyhill Lane stop is on a different route to the Scalby Road stop outside the Proudfoots store

200/10.2 RESOLVED that the Enforcement Officer of the SBC be asked to check the status of the property built adjoining 476 Scalby Road and the response considered at the next meeting; Councillor Bastiman to be sent a copy of the response as Ward Councillor.

RESOLVED that the planning decision notices received since the last meeting be received
204/10 FLOODING ISSUES
Councillor D Bastiman reported that the Flood Working Group were awaiting a scheme from the Environment Agency with regard to the alleviation of flooding at Church Becks/Scalby Beck Road. RESOLVED that the report be received
205/10 PARTICIPATORY BUDGETING
Councillor Ridley reported on participatory budgeting with regard to projects in the rural area being conducted by the NYCC and the SBC. RESOLVED that the report be received
It was noted that as a result of five members declaring a personal and prejudicial interest in items 18 and 19 on the agenda in relation to the Community Hall, the Council meeting was not quorate and therefore item 19 would be considered at the next meeting. Agenda item 18 was to be considered by the Community Grants Chest Committee after the Chairman had returned from holiday.
There being no further business on the agenda the Chairman declared the meeting closed at 8:30 pm
