MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Rickinson Hall, St. Laurence’s Church Rooms, Scalby,
on Wednesday, 12th April 2017 at 7pm.
PRESENT: Councillor R Towse (Chairman), Cllrs. Mrs E Black, G Edmunds, S Foote, Mrs R Holliday, K Martin, TW Miller, D Sutton, RI Thompson.
ALSO IN ATTENDANCE: Borough Cllr. L. Backhouse, R. Kendall (In Bloom), 6 members of public (3 leave at 7.14pm), Mrs J Marley (Clerk).
ABSENT: Cllrs. DJ Bastiman, R Pickersgill, Mrs PC Snow and Mrs D Wiles; County Cllr. A Backhouse, Borough Cllrs. V Inman, A Jenkinson, H Lynskey.
The Chairman reminded those present that filming, photographing or audio recording of the proceedings was allowed – persons wishing to record were asked to notify the Clerk of their intention prior to the start of the meeting. In the interests of encouraging public participation, it was requested that anyone filming did not include members of the public “in shot”.

49/17 DECLARATIONS OF INTEREST – None.
50/17 MINUTES
50/17.1 Cllr. Thompson asked for the words “RI Thompson (prior commitment)” to be deleted from Minute 33/17 since he had been present at the meeting. It was so agreed. Having been previously circulated, it was RESOLVED the amended minutes of the Council Meeting held on 8th March 2017 be approved as a correct record and signed by the Chairman.
PROCEDURAL MATTER At 7.04pm, Standing Orders were suspended to allow the Public Open Forum.
51/17 PUBLIC OPEN FORUM
51/17.1 Concerns were raised regarding the re-submitted planning application at 290 Scalby Road – other than additional information regarding proposed drainage, there seemed to be little difference between the two applications.
PROCEDURAL MATTER – At 7.09pm, Standing Orders were resumed.
52/17 MATTERS RAISED IN PUBLIC OPEN FORUM – The public’s comments noted and would be taken into account when Council considered planning application 17/00719/FL.
With Council’s agreement, the Chairman varied the order of the agenda so that item 13.6 was considered next.
53/17 PLANNING APPLICATION 17/00719/FL
53/17.1 [Brought forward] Agenda item 13.6
Taking into account representations made by members of the public, Council took the view that with the exception of proposed changes to drainage provision, none of its concerns on the previous application had been addressed by the re-submission. Council therefore agreed to object to the application on the grounds of unacceptable impact on area & neighbours including disturbance, parking, drainage, height & scale, size of overall proposals, change of use & hours of use.

54/17 POLICE REPORT Written reports received & noted. Also noted Cllr. Towse’s report that while the Scalby area report had been received without prompting, the intervention of a Chief Inspector had been necessary in order to get the Newby area report.
55/17 EXTERNAL REPORTS
55/17.1 County Council:- No report to receive.
55/17.2 Borough Council:- Borough Cllr. L Backhouse reported the Tour de Yorkshire was due in Scarborough on 28th April and the Red Arrows would be doing a flying display for Armed Forces Day on 24th June. Re-surfacing of Scarborough’s town centre shopping area looked good and should soon be completed.
55/17.3 In Bloom:- Noted Mr Kendall’s report that the bulb audit was almost completed. The annual plant sale would take place on 27th May at the Community Hall and an information day was to be held at Proudfoot’s on 5th May. Entries for the Garden Gems Competition were now open.
56/17 COUNCILLOR’S REPORTS & UPDATES
56/17.1 Received & noted items 8.1.1 and 8.1.2 being an update [circulated with agenda] from Clerk on highway and footpath matters.
56/17.2 Received & noted item 8.1.3 being an update on Scalby Library by the Chairman. As members were aware the Parish Council had been working to secure the future of the library. On 4th April workmen had been on site replacing windows & dealing with a gas leak. Unbeknown to the Chairman or Clerk, on 3rd April the Trustees had asked NYCC if they could manage the building themselves. NYCC had agreed to the Trustees request and undertook to inform the Parish Council. Mid-morning on 4th April a phone call had been received from NYCC saying it would be leasing the library building direct to the Trustees not the Parish Council. NYCC subsequently confirmed its decision in an email which also said 1] it would reimburse the Parish Council’s reasonable expenses for work done/advice taken and 2] the Parish Council’s existing lease with NYCC remained in place. The Clerk had forwarded a copy of that email to all councillors and the same was given to all present at the meeting. The sudden and complete about turn in the proposed management of the library building had incurred an unnecessary expenditure to the taxpayer, significantly changed the working environment and had an adverse effect on our staff. It had also caused further additional work as a result of the Clerk having to cancel agreements with insurers and contractors. Council acknowledged its duty of care to the Clerk and agreed to provide support as appropriate.
56/17.3 Received & noted reports from several councillors in respect of highway matters requiring attention – Clerk to pass to relevant authority.

57/17.1 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency – none.
58/17 FINANCIAL MATTERS
58/17.1 Resolved to approve the Schedule of Accounts to be paid for April 2017 (Schedule 1) in the sum of £5,556-07.
58/17.2 Resolved the 2016/17 Annual Report and Accounts [circulated with agenda] be approved & Chairman be authorised to sign.

62/17.2 NYMNP Coastal Area Parish Forum – Cllr. Thompson reported updates received or matters discussed included Boulby and Whitby potash mines, coastal protection at Runswick Bay and the cinder track. The Joint Parish Forum is to be held during July. The next Coastal Area Forum will be on 26/10/17.
62/17.3 Yorkshire Local Councils’ Association – Next meeting 1/6/17 (Cllr. Towse)
62/17.4 Twinning – Next meeting 23/5/17 (Cllr. Thompson).
62/17.5 Yorkshire Coast & Moors County Area Committee – No report on meeting of 15/3/17 as Cllr. Thompson had been away.
