NEWBY AND SCALBY TOWN COUNCIL

will be held in the

THURSDAY, 8th May 2025, AT 2 P.M.

 

All councillors are hereby severally summoned and required to attend in order to transact the business on the agenda.

1          NON-ATTENDANCE OF COUNCILLORS

1.1       To receive and note apologies from councillors who are unable to attend the meeting.

1.2       To consider reasons for absence provided by councillors who cannot attend and resolve the council’s acceptance of these if felt relevant.

 

2          DECLARATIONS OF INTEREST

To receive any declarations of interest in items on this agenda.

 

3          MINUTES

3.1       To approve and authorise the Chairman to sign the minutes of the Extraordinary Meetings of Council held on 9th April and 22nd April 2025 (enclosed).

3.2       To approve and authorise the Chairman to sign the minutes of the Review & Staffing Committee Meeting held on 28th April 2025 (enclosed).

 

4          EXTERNAL REPORTS

4.1       Police – To receive & note report (enclosed)  for April 2025 incidents covered by Rural Policing Team.

4.2       Joint Council Working Group on Fracking – to receive & note verbal report from Cllr. Bore.

 

5          UPDATES ON VARIOUS MATTERS & CLERK’S/COUNCILLOR’S REPORTS/ITEMS

5.1       Persistent traffic offences near Newby & Scalby Primary School [Minute 24/25.1 refers] – to receive & note responses (enclosed) from Highways Area Manager North Yorkshire Council and Police.

5.2       Alleged problems with Scalby School pupils [Minute 24/25.4 refers] – to receive response (enclosed) from Headteacher.

5.3       Speed of traffic on Barmoor Lane [Minute 24/25.5 refers] – to receive response from Police and verbal report by Clerk on VAS sign.

5.4       To note that all complaints to the Monitoring Officer in respect of alleged breaches of the Code of Conduct by councillors have been finalised – no breaches have been found and no further action is to be taken.

5.5       To note a request for “reasonable adjustments” under equality legislation has been received by the Clerk and further information is awaited.

5.6       To receive reports from Councillors of 1] any event they have attended on behalf of Council; 2] any highway & footpath matters requiring attention.

 

6          CORRESPONDENCE

6.1       Electoral Review of North Yorkshire Council – draft recommendations (emailed to councillors 1/4/25) – to receive and agree comments.

6.2       Duchy of Lancaster – letter increasing allotment rent [enclosed] – to receive & agree action as appropriate.

6.3       YLCA Scarborough Branch – to note the annual meeting is 12th June and agree any items to put forward for the agenda of that meeting.

6.4       Correspondence received after 30/4/25 which the Chairman of the meeting deems it necessary to consider as a matter of urgency.

 

FINANCE & GENERAL PURPOSES ISSUES

 

7          FINANCE, REGULATORY & GENERAL MATTERS

7.1       To authorise the Schedule of Accounts Payable for May 2025 (Schedule 2).

7.2       2024/25 accounts [enclosed] – to receive & authorise Chairman to sign.

7.3       To receive & note Internal Audit report for Feb. 25-March 25 and year end (enclosed).

7.4       Appointment of Internal Auditor for 2025/26 – to note Mr Carey has now retired & agree action as appropriate

7.5       Policies Review – to receive a report and recommendations [enclosed] from the Review & Staffing Committee and resolve that the recommendations of the report be carried.

 

ENVIRONMENT AND DEVELOPMENT ISSUES

 

8          PLANNING APPLICATIONS & APPEALS NOTIFIED:-

To agree comments on the following:-

  1. ZF25/00358/HS Retrospective application for double garage, 18 Eat Park Road, Scalby.
  2. ZF25/00379/HS Demolish existing lean-to and first floor access stair. Replace first floor door with window. Erect single story rear extension with extraction flue. Replace 1 uPVC window at front in timber, Yew Tree Café, 30-32 High St, Scalby.
  3. ZF25/00384/HS Instal external first floor door, form roof terrace with railing. Instal solar tiles to extension. Demolish outbuilding and erect replacement outbuilding with solar, The Manse, Low St, Scalby.
  4. ZF25/00385/HS Erect two storey side extension, 31 The Parkway, Newby.
  5. ZF25/00491/LB Install external 1st floor door and form first floor roof terrace with railing. Installation of photovoltaic slates to existing single storey extension. Erection of outbuilding following the demolition of the existing outbuilding, all at The Manse, Low St, Scalby.

 

9          PLANNING DECISIONS/APPEALS/WITHDRAWALS:- to receive & note

  1. ZF24/00332/FL (APPEAL). Demolish existing building, erect one 3 bed bungalow and 1 4 bedroom house, 143-145 Burniston Road, Newby. Appeal dismissed.
  2. ZF24/01990/FL Change of use, garage to dog grooming salon (sui generis), 28 The Uplands, Newby. Granted with conditions.
  3. ZF25/00093/HS Erect single storey rear extension, 21 Red Scar Lane, Newby. Granted with conditions.

 

10        PLANNING MATTERS RECEIVED AFTER 30/4/25

(as notified after distribution of agenda to members on email) – To agree comments as appropriate.

 

OTHER MATTERS

 

11        EXCLUSION OF PRESS AND PUBLIC

To consider a motion – That, under the provisions of the Public Bodies (Admission to Meetings) Act 1960 §1(2), the press and public be excluded from the meeting on the grounds the next items relate to legal, personnel or contract matters.

12.1     External auditor PKF Littlejohn [Minute 23/25.4 refers] – to receive details of objections, consider reports drafted as Council’s potential response to PKF and agree action as appropriate in respect of PKF’s questions about objections lodged by two persons against the 2023/24 AGAR.
