Minutes of Extra Ordinary Council Meeting 19th October 2022

MINUTES OF EXTRA ORDINARY MEETING OF NEWBY AND SCALBY TOWN COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 19th October 2022 at 7pm.

PRESENT: Councillor R Towse (Chairman), Cllrs. D Bastiman, J Fennell, S Foote, R Holliday, D Langmead, B Marley, D Sutton, R Thompson.

ALSO IN ATTENDANCE: Shepherd and J Smith (Scalby Toilet Trust), 1 member of public, Mrs J Marley (Clerk to Council).

ABSENT:       Cllr. S Barnes.

106/22             APOLOGIES FOR ABSENCE  The following apologies for absence were accepted and the reasons for absence were approved:- Cllr. Barnes (personal commitment).

108/22             SCALBY TOILETS  [Minutes 94/22 and 77/22 refer]

Council is wishful to take over the running of the toilets so they can remain available to the public. In discussions with Scarborough Borough Council it has become clear there are two courses of action open to achieve this namely:-

  1. to negotiate a new 12 month lease with Scarborough Borough Council (this will be a relatively lengthy and costly process); or
  2. to have the existing lease assigned to the Town Council (this will be speedy and inexpensive).

Approaches for a Community Asset Transfer are not acceptable to SBC since it falls within the final six months of its existence. They recommend that an approach is made to the new North Yorkshire Unitary Authority after 1st April 2023.

Concerns were expressed that assignment of the lease may result in the Town Council being responsible for big repairs.  It was agreed

  1. the existing Scalby Toilet Trust CIO to re-open the toilets and continue to run them under the existing lease they had with Scarborough Borough Council;
  2. the Town Council to make its £650 contribution to the toilet running costs for the current financial year [Minute 148/19.2 refers];
  3. the Chairman to approach the local businessman to see if his offer of assistance (£2,000 per annum plus open and close toilets free of charge) stood;
  4. from 1/4/2023 the Town Council to approach North Yorkshire Unitary Council regarding taking over the toilets in some manner (likely to be Community Asset Transfer or acquiring the freehold)

There being no further business, the Chairman declared the meeting closed at 7.31pm.
