MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 9th March 2022 at 7pm.
PRESENT: Councillor R Towse (Chairman), Cllrs. S Barnes, D Bastiman, S Foote, P Harriott, R Holliday, R Thompson.
ALSO IN ATTENDANCE: Borough Cllr. Sharma (left 7.51pm), 3 members of public (left various times), Mrs J Marley (Clerk to Council)
ABSENT: Cllrs. D Langmead, D Sutton, D Wiles.
132/21 APOLOGIES FOR ABSENCE The following apologies for absence were accepted and the reasons for absence were approved:- Cllr. Sutton (personal commitment), Cllr. Langmead (Covid after-effects).
133/21 DECLARATIONS OF INTEREST: Received from Cllr Bastiman (agenda items 10-12 inclusive as he was a substitute member of SBC’s Planning Committee).
134/21 MINUTES
134/21.1 Having been previously circulated, the minutes of the Council Meeting held on 9th February 2022 were approved as a correct record and authorised for signature by Cllr. Towse.
PROCEDURAL MATTER Suspension of Standing Orders at 7.04pm to allow Public Open Forum.
135/21 PUBLIC OPEN FORUM Member of public asked questions about Bellway Homes proposals for the next phase of building on the High Mill Estate. They observed there was still only one way in and out of the estate, there were no shops or play facilities.
PROCEDURAL MATTER Standing Orders were resumed at 7.12pm.
136/21 MATTERS RAISED IN PUBLIC OPEN FORUM Chairman & Cllr. Bastiman explained access and facilities such as shops, play areas, bus routes and bridge over the sea cut, along with Section 106 contributions had formed part of the decision on the 2009 outline application. Such things carried forward into the more detailed subsequent applications in respect of each phase of development. This was reinforced by Borough Cllr. Sharma in his capacity as Chairman of SBC’s Planning and Development Committee.
At this point (7.24pm) two members of public and Borough Cllr. Sharma left the meeting.
137/21 EXTERNAL REPORTS
137/21.1 Police:- The Scalby report for February (emailed to councillors 3/3/22) was received & noted.
137/21.2 County Council:- County Cllr. Bastiman reported 1] in light of the recent sanctions imposed against Russia by the UK government, the County Council was checking that none of its contracts had any Russian involvement; 2] the draft Structural Change Order had now been through the committee stages in both houses of parliament and it was hoped the Order would come into law around 16th March; 3] work was being undertaken to set up a Parish Charter between the new unitary authority and town and parish councils – details of a meeting at which this had been discussed had been circulated to councillors and it was agreed to consider the charter at the May Parish Council meeting when newly elected members of all councils would have taken office.
137/21.3 Borough Council:- No report received as Cllr. Sharma had temporarily left the meeting room.
138/21 UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS
138/21.1 Update by Chairman and Clerk on matters dealt with under delegated powers – none.
138/21.2 A written report by Helen King and tabled at the meeting was received & noted. The Chairman reported he and Helen had also met Scalby Fair regarding their Platinum Jubilee events. Councillors gave a big thank you to Helen for all the work she was carrying out.
138/21.3 Reports from Councillors of any highway & footpath or general matters requiring attention – several councillors reported potholes on Station Road and Field Lane (Clerk to refer to Highways).
138/21.4 A proposal from Cllr. Harriott that Council planted a tree to commemorate the Queen’s Platinum Jubilee was received and agreed. The suggested location was on Church Beck Green, possible at the end near the Hackness Road/Church Hill junction. The Clerk is to investigate sources of a tree (Wykeham Mature Trees and the Woodland Trust were suggested) & report to a future meeting.
138/21.5 A proposal from Cllr. Harriott for the next newsletter to include information on the awareness of swifts in the local environment was received and it was agreed that a “ready to print” article should be brought to the next meeting for consideration.
At this point (7.29pm) Cllr. Sharma returned to the meeting room.
138/21.6 Borough Cllr. Sharma asked if there had been any progress with Highways in respect of the overhanging hedge on the corner of Dunwell Avenue and Throxenby Lane [Minute 122/21.3 refers]. Clerk responded that to date nothing had been received.
At this point (7.51pm) Cllr. Sharma left the meeting.
139/21 CORRESPONDENCE
139/21.1 A card of thanks from Scarborough Gymnasts Team for Council’s sponsorship to the 2021 European Team Gym Championship was received and noted.
139/21/2 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:–
1] received & noted email from Bellway Homes with site layout plan for phase 3 of High Mill development – some comments (only 1 ingress/egress to site, no shops etc) were relevant to the outline application’s decision in 2010 though councillors did agree they had concerns about the proposed density of housing on a site which was known to regularly carry a lot of water. Clerk to relay these informal comments to Bellway Homes planners.
2] received & noted letter of resignation from Cllr. Wiles due to being unable to give the time and dedication the position deserved. Casual vacancy declared, Clerk to inform SBC. Chairman to write a letter of thanks to Mrs Wiles.
3] received & noted letter from parishioner regarding the state of the ginnel running from opposite community hall to South Street and the poor state of the pavement on Station Road between Scalby Road and Ridge Green. The ginnel is a public right of way and the Clerk is to ask the parish caretaker to see if it could be tidied. The pavement on Station Road has been reported numerous times by County Councillor Bastiman. Clerk to refer to Highways and also write to parishioner.
4] received & noted email from Royal Pilgrim on behalf of David Wilson Homes in respect of A 900 new home development on the allocated housing site on land off Scalby Road next to the Rugby Club. Council welcomed the opportunity to engage on the design etc. of the site but suggested it would be better to wait until after the elections on 5th May since the composition of all councils would change on that date. Clerk to contact Royal Pilgrim.
140/21 FINANCE, REGULATORY & GENERAL MATTERS
140/21.1 Resolved the Schedule of Accounts Payable for March 2022 (Sch 12, £7,318-02) be approved. Cllrs. Towse and Thompson to do the online authorisations within 24 hours. Cheque signed by Cllrs. Bastiman and Thompson.
140/21.2 Internal Auditor’s report on accounts (Oct. 2021 to Dec. 2021) received & noted.
140/21.3 Noted the National Joint Council for Local Government Services had agreed a pay award of 1.75% from 1/4/21 and agreed to pay this award (backdated to 1/4/21) at the earliest opportunity.
141/21 PLANNING APPLICATIONS & APPEALS NOTIFIED
Comments on the following applications received & appeals notified [circulated with agenda] were agreed:-
- 22/00191/HS Erect single storey rear and side extension and front porch, 49 Moor Lane, Newby. No objections.
- 22/00229/HS Erect front porch, 10 Southlands Grove, Newby. No objections.
142/21 PLANNING DECISIONS – The following were noted:-
- 21/02127/HS Change window to patio doors with balcony, 8 Wynbrook Court, North Street, Scalby. Granted with conditions.
- 21/02172/FLA Variation of condition 1 of decision 19/00108/FL dated 12/3/19 to allow external and layout changes to cottage, 21 Hackness Road. Granted with conditions.
- 21/02655/HS Erect single storey rear extension, 14a Newlands Avenue, Newby. Granted with conditions.
- 21/02844/FL Install replacement monopole (20m. height) with 6no. antennae, 1no. replacement equipment cabinet with ancillary works, land adjacent The Rosette, Hackness Road, Scalby. Granted with conditions.
- NYM/2021/0924/FL Vary condition 2 of NYM/2020/0207/FL to allow summerhouse/office building to be used as temporary residential accommodation for 12 months, South Beck House, Hackness Road, Scalby. Granted with conditions.
143/21 PLANNING MATTERS RECEIVED AFTER 1/3/22 – None.
144/21 REPORTS FROM OUTSIDE BODIES None.
145/21 EXCLUSION OF PRESS AND PUBLIC
At 8.19pm it was resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next item of business on the grounds it related to legal/commercially sensitive/contractual matters.
At this point (8.19pm) the remaining member of public left the meeting.
146/21 VARIOUS ITEMS
146/21.1 Staffing [Minute 65/21.4 refers]. To carry out a six month review on the post of Head of Hub and Community Support Services. It was agreed to defer discussion/decision to an extra ordinary meeting of Council to be held at 6pm on Wednesday 16th March 2022, said meeting to only consider this item.
There being no further business, the Chairman declared the meeting closed at 8.42pm.
