MINUTES OF SPECIAL MEETING OF NEWBY AND SCALBY PARISH COUNCIL,
held in the Council Offices, Scalby Road, Scalby,
on Wednesday, 27th May 2009 at 7.15pm
PRESENT: Councillors R I Thompson, (Chairman in the Chair), J Attwood, D J Bastiman, B Miller, R Pickersgill and Mrs P C Snow

127/09 DECLARATIONS OF INTEREST
127/09.1 Councillor Bastiman declared a personal and prejudicial interest in all planning issues and applications in his capacity as Portfolio Holder on Scarborough Borough Council with responsibility for Planning Issues. He indicated that he would take no part in the discussions or decision recorded in minute 129/09 below and would withdraw from the meeting prior to its consideration.
127/09.2 The Chairman (Councillor R Thompson) declared a personal interest in minute 129/09 below in his capacity as a member of the Management Committee of Scalby Village Trust. He indicated that he would observe the proceedings but would take no part in the discussions or decision.
PROCEDURAL MATTER
It was RESOLVED to suspend the meeting to allow members of the public to speak on the planning application referred to in minute 129/09 below.

Members of the public explained their range of views in relation to the application. Councillor Bastiman explained the various strategies of Scarborough Borough Council in relation to the application and clarified the basis of the applicant’s decision to submit the application having regard to National Planning Guidance. Following his declaration in minute 127/09.1 above, Councillor Bastiman then withdrew from the meeting at 7.26pm. A letter from Councillor S G Foote was read regarding the application.

128/09 APPOINTMENT OF CHAIRMAN
In view of the declaration made by the Chairman in minute 127/09.2 above, it was RESOLVED to appoint Councillor B Miller as Chairman of this meeting.

129/09 PLANNING APPLICATION – SCARBOROUGH BOROUGH COUNCIL
The following planning application was considered and the decision taken thereon is as shown below:

Mixed use residential and employment development (B1), including provision of open space and access Land at High Mill Farm, Station Road, Scalby, YO13 0PU Provincial Land Developments Ltd 09/00717/OL Committee Unanimously opposed on the following grounds: 1. the proposed development is out of character with the area 2. the proposed three-storey houses would lead to overlooking of neighbouring properties 3. the ‘cul de sac’ infrastructure design of the proposal would lead to potential traffic problems with vehicles attempting to enter or exit the site 4. there are no shops or services proposed at the site which would exacerbate the potential traffic problems in 3 above 5. the site is in Zones 2 and 3 of the Flood Risk area 6. any surface water flowing from the site as a result of the proposed buildings would enter the Beck which would not be able to deal with high flows 7. the proposed industrial units would be out of character with the existing residential area 8. the proposed development would have a detrimental effect on the wildlife existing on the site 9. the proposal should not be considered further until studies are undertaken with regard to Environmental Impact, Flood and Sewerage risks, Traffic, Nature Conservation, Public Transport and its potential effect on School admissions in the area |
