MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY TOWN COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 13th July 2022 at 7pm.
PRESENT: Councillor R Towse (Chairman), Cllrs. S Barnes, DJ Bastiman (left 7.45pm), J Fennell, S Foote, R Holliday (from 7.28pm), B Marley, D Sutton.
ALSO IN ATTENDANCE: County and Borough Cllr. Sharma (left 7.43pm), Mrs J Marley (Clerk to Council)
ABSENT: Cllrs. D Langmead, R Thompson.
The Chairman welcomed Cllr. Mrs Fennell to her first meeting of the Town Council.
55/22 APOLOGIES FOR ABSENCE The following apologies for absence were accepted and the reasons for absence were approved:- Cllr. Langmead (work commitment), Cllr. Thompson (personal commitment), Helen King (personal commitment).
56/22 DECLARATIONS OF INTEREST: Received from Cllr. Bastiman (agenda items 11-13 inclusive as he was a substitute member of SBC’s Planning Committee), Cllr. Marley (agenda items 11 and 13 as he was a member of the NYMNP Planning Committee).
57/22 MINUTES
57/22.1 Having been previously circulated, the minutes of the Town Council meeting held on 8th June 2022 were approved as a correct record and authorised for signature by Cllr. Towse.

59/22 MATTERS RAISED IN PUBLIC OPEN FORUM None.
60/22 VACANCIES UNFILLED AT THE ELECTION BY REASON OF INSUFFICIENT NOMINATIONS
Noted it had only been possible to fill one of the four Ordinary Vacancies within the 35 day timeframe. Further noted advice from YLCA and SBC Elections Office that Council should continue to seek to fill the three remaining Ordinary Vacancies by co-option.
61/22 EXTERNAL REPORTS
61/22.1 Police:- :- The Scalby report for 1/4/22-30/6/22 [circulated with agenda] was received & noted.
61/22.2 County Council:- County Cllr. Sharma reported he was on the local government re-organisation licensing workstream & it had become apparent that taxi regulation and minimum fares varied widely across the county. He also asked if it would be possible for the pavement between Kingsway and Scalby Avenue to be sided out – agreed Clerk to investigate with a view to work being done by Parish Caretaker. County Cllr. Bastiman reported interviews for the Chief Executive of the new unitary authority were to take place towards the end of the month. A Community Governance Review was to be considered by NYCC Executive next week. Agreed he should again ask for the areas to be moved which we asked to be moved to Woodlands Ward in July 2017 when the SBC Electoral Review took place (Heathcliffe Gardens, Endcliff Crescent, numbers 61-81 odds on Colescliffe Road and numbers 105-123 odds St. Leonard’s Crescent) and also to rectify the anomaly at Charles William Apartments on North Leas Avenue (parish boundary runs through middle of the building).
61/22.3 Borough Council:- Borough Cllr. Sharma reported it was hoped an Extra Ordinary Meeting would held next week to discuss the Yorkshire Coast DBID project. Cllr. Bastiman reported Mr Greene (Chief Executive) would be moving (probably in November) to become Managing Director at Stockton Borough Council.
62/22 UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS
62/22.1 Neighbourhood Plan Working Group – submission of a map covering the whole parish (as first stage of a NHP) had been made to SBC and NYMNP.
62/22.2 Update on local government re-organisation – the various workstreams and working groups continued to work towards providing a fully functioning unitary authority on 1st April 2023.
62/22.3 A report from Helen King re. Community Hub [circulated with agenda] was received & noted. The Chairman reported that there were now two social prescribers working with GP practices in the area and this would result in more referrals for assistance via The Hub.
Cllr. Holliday joined the meeting during the above item.
62/22.4 Reports from Councillors of any highway & footpath or general matters requiring attention – 1] the new pedestrian refuge on Scalby Road near the sea cut bridge is proving very useful; 2] the potholes and poor road surface on Station Road and at the junction with Scalby Road had been marked up but no repairs had taken place so far.
63/22 CORRESPONDENCE
63/22.1 National Park Parish Member Elections – noted at the vote count held at Helmsley on 14/6/22 Bob Marley (proposed by Burniston Parish Council) had received the majority vote and the appointment had now been confirmed by the Secretary of State.
63/22.2 Received & noted letter from NYMNP re NYM/2022/0355 and reply by Clerk [both circulated with agenda] request for dispensation [circulated with agenda]. Agreed Council had no evidence to contradict that already laid before the NYMNP and objection to be withdrawn.
63/22.3 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:– none.
Cllr. Sharma left the meeting at this point.
64/22 FINANCE, REGULATORY & GENERAL MATTERS
64/22.1 Resolved the Schedule of Accounts Payable for July 2022 (Sch 4, £7,765-34) be approved. Cllrs. Sutton and Towse to do the online authorisations within 24 hours. Cheque signed by Cllrs. Bastiman and Holliday.
Cllr. Marley was out of the room for the above item.
Cllr. Bastiman left the meeting at this point.
65/22 PLANNING APPLICATIONS & APPEALS NOTIFIED
In accordance with his Declaration of Interest [Minute 56/22 refers], Cllr. Marley took no part in the discussion or decision in respect of the NYMNP applications.

Concern that conversion of old farm buildings could remove long-standing nest areas of swallows/swifts/house martins or bat roosts – request mitigation measures be included.

68/22 REPORTS FROM OUTSIDE BODIES None.
69/22 EXCLUSION OF PRESS AND PUBLIC
At 8.13pm it was resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next item of business on the grounds it related to legal/commercially or financially sensitive/contractual matters.
70/22 CONFIDENTIAL ITEMS
70.22.1 Banking arrangements. A confidential report tabled at the meeting in respect of the Council’s accounts held at the Nat West bank and with NS&I was received & noted. The interest rates on these accounts was abysmal compared to that on Council’s Unity Trust accounts. Proposed Cllr. Barnes, seconded Cllr. Sutton and resolved 1] The RFO’s recommendation to close both accounts and transfer the balance to Council’s Instant Access Savings account at Unity Trust be carried and 2] The RFO and Chairman authorised to take the action necessary to carry out the closure of accounts and transfer of funds.
There being no further business, the Chairman declared the meeting closed at 8.23pm.
