MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL
held in the Community Hub, Council Office, 445b Scalby Road, Scalby,
on Wednesday, 9th February 2022 at 7pm.
PRESENT: Councillor R Towse (Chairman), Cllrs. S Barnes, S Foote, D Sutton, R Thompson.

118/21 APOLOGIES FOR ABSENCE The following apologies for absence were accepted and the reasons for absence were approved:- Cllr. Bastiman and Rev. Hand (work commitment), Cllrs. Harriott, Holliday and Wiles (personal commitment), Cllr. Langmead (Covid safety).

120/21 MINUTES
120/21.1 Having been previously circulated, the minutes of the Council Meeting held on 12th January 2022 were approved as a correct record and authorised for signature by Cllr. Towse.
PROCEDURAL MATTER Suspension of Standing Orders at 7.02pm to allow Public Open Forum.
121/21 PUBLIC OPEN FORUM Member of public asked questions about the forthcoming devolution, what information/consultations there had been for parish councils and what (if anything) was the parish council likely to take on under the new authority
PROCEDURAL MATTER Standing Orders were resumed at 7.12pm.
122/21 MATTERS RAISED IN PUBLIC OPEN FORUM Chairman outlined the consultations which had taken place, the background to existing funding and functions carried out and the potential for additional functions to be carried out subject to mutual agreement with the emerging unitary authority.
122/21 EXTERNAL REPORTS
122/21.1 Police:- The Scalby report for January (tabled at meeting ) was received & noted.
122/21.2 County Council:- On behalf of County Cllr. Bastiman, the Clerk reported 1] Covid figures – there was a gradual decrease in numbers of people infected (especially in primary school children); 2] there had been an outbreak of Avian ‘Flu at Whitby Wildlife Centre which had resulted in a cull of all the birds on site (including 3 ospreys); 3] he had spent time at Malton Livestock Market with Trading Standard’s Animal Health Officer who works with the market authority and farmers to ensure the wellbeing and safety of livestock present is of the highest standard; 4] a visit to the rural part of the Yorkshire Dales to see how 5G is being delivered to the remote areas in order to help the rural economy and businesses as well as assisting in day to day living.
122/21.3 Borough Council:- Borough Cllr. Sharma reported he was again getting complaints about the overhanging hedge on the corner of Dunwell Avenue and Throxenby Lane – it was causing problems for people on mobility scooters. (Cllr. Sharma to try to get complainant’s consent to pass their details to Clerk who would refer this long-standing matter to Highways). He’d also had a parishioner contact him re parking around Newby School – it transpired the parishioner had also contacted Cllr. Towse about the same matter. The parishioner had been asked to discuss his concerns with the school and SBC Parking Services before taking any action in their own right.
At this point (7.29pm) Cllr. Sharma left the meeting.
123/21 UPDATES ON VARIOUS MATTERS & COUNCILLOR’S REPORTS
123/21.1 Update by Chairman and Clerk on matters dealt with under delegated powers – the following were noted. 1] the outside WC shared-drain had again been blocked – an old manhole had been found about 12 inches below the level of the drive – the drain had been unblocked, the chamber raised and a new manhole cover installed); 2] the back gates into the courtyard had been getting progressively more difficult to close so they had been re-hung; 3] the cctv system including doorbells at both entrances had been finalised.
123/21.2 A written report by Helen King (emailed to all councillors 9/2/22) and tabled at the meeting was received & noted. Councillors were impressed with the amount of work being carried out.
123/21.3 Reports from Councillors of any highway & footpath or general matters requiring attention – Cllr. Sutton reported 1] pothole on the corner of Hackness Road and Hackness Gardens.
124/21 CORRESPONDENCE
124/21.1 Correspondence received after preparation of the agenda which the Chairman of the meeting deemed it necessary to consider as a matter of urgency:– letter of 3/2/22 from Cllr. Harriott received – 1] tendering apologies for tonight’s meeting (see Minute 118/21); 2] formally proposing Council plants a tree to commemorate the Queen’s Platinum Jubilee 022 (to March agenda); 3] request for next newsletter to include information on awareness of swifts in local environment (to March agenda); 4] request for Twinning Association’s Easter event to be publicised in Council newsletter (see item 5 of Minute 129/21.2).
125/21 FINANCE, REGULATORY & GENERAL MATTERS
125/21.1 Resolved the Schedule of Accounts Payable for February 2022 (Sch 11, £4,964-99) be approved. Cllrs. Towse and Thompson to do the online authorisations within 24 hours.
125/21.2 VAT registration and opting to tax [Minute 65/21.2 refers]. RFO’s report (circulated with agenda) received. Proposed Cllr. Sutton, seconded Cllr. Thompson and resolved that this Council opts to tax Newby & Scalby Parish Council and Community Hub, 445b Scalby Road, Scarborough, YO12 6UA from 1st April 2022 and that the Parish Clerk and Responsible Financial Officer be authorised to undertake such actions as may be necessary, including the signing of all forms and correspondence for submittal to HMRC in respect of this Option to Tax.
125/21.3 Noted Environment Locality grants [Minute 111/21.6 refers]. A final total of £3,000 towards improving Newby Farm Road corner had been awarded by ward councillors:- £1,000 from Cllr. Bastiman, £1,000 from Cllr. Lynskey, £500 from Cllr. E. Murphy and £500 from Cllr. Sharma. Council greatly appreciated these donations and letters of thanks are to be sent to each councillor.
126/21 PLANNING APPLICATIONS & APPEALS NOTIFIED
Comments on the following applications received & appeals notified [circulated with agenda] were agreed:-
- 21/02655/HS Erect single storey rear extension, 14a Newlands Avenue, Newby. No objections.
- 21/02844/FL Install replacement monopole (2om in height) with 6 antennae, 1 replacement equipment cabinet with ancillary works, outside Rosette, Hackness Road, Scalby. No objections.
- 21/02947/FL Replace timber windows with upvc, Flat 5, Scalby Hall, Hall Park Close, Scalby. No objections.
- NYM/2022/0003 Install 9 replacement windows and 3 doors together with secondary glazing to 15 windows at The Old Farm House, Low Road, Throxenby. No objections.

127/21 PLANNING DECISIONS – The following were noted:-
- 21/02268/HS Erect single storey extension to front and render all elevations, 13 Tibby Butts, Scalby. Granted with conditions.
- 21/02438/HS Install dormer windows to front and rear, 140 Moor Lane, Newby. Granted with conditions.
- 21/02502/FL Convert, extend and alter garage wing to form 4no. guest rooms, billiard room and plant room, Wrea Head Hotel, Barmoor Lane, Scalby. Granted with conditions.
128/21 PLANNING MATTERS RECEIVED AFTER 1/2/22 – The following was received:-
- 21/02858/HS Erect single storey side and rear extension at 3 West Avenue, Scalby. No objections.
129/21 REPORTS FROM OUTSIDE BODIES
129/21.1 Cllr. Towse reported on the YLCA Scarborough Branch meeting – attempts to get the Police, Fire and Crime Commissioner to attend a meeting had been unsuccessful as they wanted to address several branches at the same time – the YLCA is trying to set this up.
129/21.2 Cllr. Thompson reported on the previous evening’s meeting of the Twinning Association – 1] it was unlikely the French would be coming here this year; 2] a leaflet drop will be done on the High Mill Estate; 3] a lunch at North Cliff Golf Club was planned for 29th March; 4] there was to be a stall at Scalby Fair on 18th June; 5] there was no event planned for the Easter period (see item 4 of Minute 124/21.1).
130/21 EXCLUSION OF PRESS AND PUBLIC
At 8.12pm it was resolved that in accordance with section 1 of the Public Bodies (Admission to Meetings) Act 1960 the press and public be excluded from the meeting for the next item of business on the grounds it related to legal/commercially sensitive/contractual matters.
At this point (8.12pm) the member of public left the meeting.
131/21 VARIOUS ITEMS
131/21.1 Cllr. Towse reported on a meeting he and Helen King had attended with two people connected with the Temperance Hall – the focus of the meeting was to explore the possibility of the Parish Council helping the Village Trust with the physical running of the hall. It was agreed that due to the Parish Council’s existing commitments to its new office and community hub it did not have the time or resources to be involved at this stage.
There being no further business, the Chairman declared the meeting closed at 8.24pm.
