MINUTES OF ORDINARY MEETING OF NEWBY AND SCALBY PARISH COUNCIL,
held in the Council Offices, Scalby Road, Scalby,
on Wednesday, 8th April 2009 at 7.15pm
PRESENT: Councillors R I Thompson, (Chairman in the Chair), D J Bastiman, S G Foote, B Miller, R Pickersgill, C Ridley & B F Watson
ALSO IN ATTENDANCE: County Councillors A Backhouse & H Swiers, R Kaye, Scarborough Borough Council, Mr P Staveley, T Spencer (Clerk) and M McGuinn (Clerk and RFO)

71/09 DECLARATIONS OF INTEREST
71/09.1 Councillors Ridley and Watson declared personal interests in all Borough Council planning applications as members of the Borough Councils Planning Committee and took no part in the decisions. Councillor Watson also declared a personal interest in minutes 84/09 and 89/09
71/09 2 Councillor Bastiman declared a personal & prejudicial interest in all planning issues and applications in his capacity as Portfolio Holder on Scarborough Borough Council with responsibility for Planning Issues. He observed the proceedings and took no part in the discussions or decisions.
PROCEDURAL MATTER
It was RESOLVED to suspend the meeting to allow Roger Kaye of Scarborough Borough Council to provide feed back on previously raised road traffic or street scene issues and to receive new issues requiring attention.

R Kaye provided feedback from the previously raised issues. The following new/revised issues were reported for action:
- The Council is still concerned about the delays at the Green Lane/Throxenby Lane junction
- The Council would not agree to the removal of railings surrounding the tennis courts and bowling green at Scalby and felt that these should be repaired
- Deep potholes near Foulsyke Pond are still in need of repair
- Damaged kerbstones on High Street, Scalby are in need of repair
- Deep potholes on Hackness Road bridge are in need of repair
- A trench on Throxenby Lane needs filling

72/09.1 Allotments Friends Group – No report
72/09.2 In Bloom Group – Mr P Staveley reported on the previous day’s judging and that feedback seemed good. The Group is to ask local schools to produce information signs for visitors describing water feature sites, in particular Foulsyke Pond.
72/09.3 Scalby Football Club – No report
72/09.4 CAP Group. – The Police report was circulated to Members
72/09.5 Safety Council – No report
72/09.6 Roads Liaison Committee – Councillor R I Thompson reported that the next meeting would be held on 28 May 2009
72/09.7 Coastal Area Parish Forum – Councillor S G Foote reported that the next meeting would be held on 20 April 2009
72/09.8 North Yorkshire & Cleveland Coastal Forum – Councillor B F Watson reported that the next meeting would be held on 21 April 2009

72/09.10 Twinning Association – Councillor R I Thompson reported on the spring dinner held on 31 March 2009. The next meeting would be held on 9 April 2009

73/09 MINUTES
It was RESOLVED to approve and sign as a correct record the minutes of the Council Meeting held on 11th March 2009 and ascertain from the YLCA as to the correct position of this item on the agenda
74/09 MATTERS OF REPORT FROM THE MINUTES None
75/09 CORRESPONDENCE
75/09.1 A letter dated 1 April 2009 from SBC on a consultation exercise in relation to the Taxi and Private Hire Policy was considered and it was RESOLVED that no comments be made
75/09.2 A letter dated 26 March 2009 from Mrs P Moss regarding the possible provision of a dog waste bin at Lancaster Way was considered and it was RESOLVED to ask the Borough Council to install a bin with the Parish Council funding 50% of the cost.
75/09.3 A letter dated 29 March 2009 from Mr J Robinson regarding facilities in High Street, Scalby was considered and it was RESOLVED to forward this matter to the Borough Council’s relevant Portfolio Holder for attention
75/09.4 An email from Mr P Gridley was considered and it was RESOLVED to ask the Borough Council to repair the verge damage on Church Close and to consider the remaining item at the next meeting
75/09.5 A letter dated 1 April 2009 from the Area Forum Support Officer inviting representatives to the next Scarborough Rural Area forum was considered and it was RESOLVED that representatives attend as necessary
75/09.6 An application from Mr A Tyson to be co-opted as a Member of the Council was considered and it was RESOLVED to co-opt him before the next meeting
FINANCE & GENERAL PURPOSES ISUES
76/09 FINANCIAL MATTERS
76/09.1 It was RESOLVED to approve the Schedule of Accounts to be Paid for April 2009, Schedule 1 and that Parish Hall Financial matters be included on future agenda as a separate item from F & GP issues
76/09.2 It was RESOLVED to receive the Cash Book and Statement of Account for March 2009.
76/09.3 It was RESOLVED to receive the Internal Audit Report for March 2009.
76/09.4 It was noted that with regard to the forthcoming External Auditors report, the Council was one of 5% selected for a spot check
77/09 BUDGET REPORTING
It was RESOLVED to approve the Budget Report to the end of March 2009

A verbal report from the clerk on the next issue was RECEIVED.

It was RESOLVED that this matter remain on the agenda pending developments.

It was RESOLVED to receive the Training and Development Programme 2009 and the new Members consider the document

Councillor S G Foote reported on a letter from Government Departments to Chief Planning Officers and Directors of Transport and it was RESOLVED to receive his report
89/09 SCARBOROUGH RUGBY CLUB – PROPOSED NEW LANDSCAPING SCHEME
The Clerk and RFO reported on what could be introduced on the verge area and that the In Bloom Group would be preparing a plan for consideration by the Council. It was RESOLVED to note that a plan was awaited

94/09 PARISH HALL
An update from Councillor Bastiman and the Clerk was considered and it was RESOLVED that:
- Mick Hopper and his team be congratulated on the excellent work they had carried out
- Professional advice be sought regarding registration of the Trust for VAT
- Consideration regarding accepting bookings on Bank Holidays be considered further at the next meeting
- A list of proposed works to the Hall be placed on the Hall’s Noticeboard
95/09 ANNUAL REVIEW OF CLERK’S TERMS AND CONDITIONS OF EMPLOYMENT
The Clerk’s terms and conditions of employment were considered and it was RESOLVED to defer consideration to the next meeting to enable the Clerk and RFO to report further details and backdate any award to 1 April 2009.
